RE: Encroachment into Public Right-of-Way – W. Lasalle Ave. & N. Willims St. and
Western Ave. & Williams St.
Dear Ms. Mannix:
At its August 13, 2024 meeting, the Board of Public Works approved your request for
the installation of new neighborhood signage at W. Lasalle Ave. & N. Willims St. and Western
Ave. & Williams St. subject to the association to maintain the signage and the landscaping
as well as to have a minimum of five (5) feet separation from the city’s utility box. This
encroachment was approved subject to the improvements not becoming a safety hazard.
Enclosed please find copies of the permit and application.
The encroachment will be permitted to remain and continue until such time as the Board
of Public Works of the City of South Bend shall determine that such encroachment is in any way
impairing or interfering with the highway or with the free and safe flow of traffic thereon. Said
encroachment shall not in any way prejudice or preclude the City’s rights with respect to the
future use of that portion of the right-of-way.

with the free and safe flow of traffic thereon, and it is recommended that the
encroachment be permitted to remain.
2. Said encroachment shall not in any way prejudice or preclude the City’s rights with
respect to the future use of the portion of the right-of-way.
PUBLIC WORKS: Traffic & Lighting- Favorable with requirement to maintain and a

RE: Ignite Grant - Near West Side Neighborhood Signage – Revocable Encroachments
To Whom It May Concern:
Our neighborhood (NWSNO) was awarded 2023 Ignite Grant funds to allow for the installation of (2)
neighborhood signs to be located on the corners of Williams & Lasalle, and Williams & Western.
These locations are the Eastern corners of our neighborhood as deflned by the City’s Neighborhood
Plan for the Near West Side, which was ratifled last year.
The proposed signs are as follows:
1)Size: The overall dimensions of installation is 6’2” height by 6’ width (5’6” + (2) 3” posts). The
main sign face is 16.5 SF. The ancillary panel along the bottom crossbar is 2 SF. Total sign
area of 18.5 SF.
2)Location:
a.See earth view images and dimensions on following pages. If possible, we would
appreciate a small level of fiexibility on post locations to account for utility locates
and angle of signage, such as +/- 2’ if allowable.
b.Initially, with sign locations being in long vacant and RDC-owned property, we began
the grant application process with the signs located on the corners, not in the
R.O.W. The response from city officials has led us to believe this is a better solution
for the placement of the signs.
c.With R.O.W. widths of 10’ and 12’, there should be no concern regarding 6’ wide
signs on an angle.
3)Misc. Details: The signs will be routed out of High Density Urethane (HDU) so they will be
fairly maintenance free. If necessary, we are requesting a total area of 4’ x 8’ around the sign
to allow for landscaping and potentially edging beneath. The signs will be installed in the
ground by the professionals at North American Signs.
In conjunction with the above information, the NWSNO would like to formally request approval from
the Board of Public Works. Thank you for your consideration of this request. Please feel free to

safe flow of traffic thereon;
2)Said encroachment shall not in any way prejudice or preclude the CITY’S rights with respect to the future use of
the portion of the right-of-way;
3)The encroachment as it now exists shall in no manner be added to or enlarged in its present scope or dimensions;
4)In the event of change of ownership of the fixture or any other item of personal property which constitutes the
aforesaid encroachment, this permit shall become null and void;
5)The CITY shall not be liable to APPLICANT for any damages caused to APPLICANT that arise out of or is incidental
to any activity and/or incidences authorized by this permit;
6)In consideration of the granting of this Permit by the BOARD, APPLICANT shall indemnify, hold harmless and
defend the CITY from and against any and all actions or causes of action which the CITY may suffer or incur by
reason of bodily injury, including death, to any person or persons, or by reason of damage to or destruction of any
property, including the loss thereof, arising out of or in any manner connected with any activity and/or incidences
authorized by this permit and/or any activities and/or incidences incidental thereto, or which the CITY may
sustain or incur in connection with any litigation, investigation, or other expenditures incidental thereto, including
any suit instituted by the CITY to enforce the obligation of this agreement of indemnity.
It is the intent of the parties hereto that the APPLICANT shall indemnify the CITY under this indemnification
clause to the fullest extent permitted by law.
This approval shall be binding upon everyone past or present, claiming any interest in and to the aforementioned
encroachment.
