This package includes the new splashpad and relocated kid's zone, as well as a new restroom and splashpad support building. This package also includes the decking system for the 211 floor, which was to be a part of phase 1, but could not be due to design issues which have now been resolved. These will go into construction following the end of this season and should be complete prior to the next season. The construction schedule is attached to the document. Following this Phase 2 Work, the final amendment for Phase 3 will come to the Board for approval following the bid process later this year. We anticipate opening bids for Phase 3 on November 181". These all will be considered as one Guaranteed Maximum Price for the full project. Please let me know if you have any questions. Thank you. EARLY RELEASE 2: EXHIBIT 2 Assumptions and Clarifications The following assumptions and clarifications apply to the Scope of Work included in this Early Release Work. 1. The Scope of Work included in the Early Release Work is that described in the specifications (Exhibit 3), drawings (Exhibit 4), and allowances (Exhibit 7), subject to the assumptions and clarifications noted below. 2. The Scope of Work also includes the work of Bid Package 3-Riser Systems for the Upper Decks Bid Event. The Upper Decks drawings and specifications are noted in Exhibits 3 & 4, respectively of Early Release Work Authorization 1. This work of the Bid Package 3-Risers Systems is described in section 01 12 00 Subcontracts Summary, included in those specifications 3. A portion of the total Construction Manager Staffing and Other General Conditions costs estimated for the entire project are included in this Early Release Work. The portion of these costs allocated to this Early Release Work are not enough to support the Early Release Work if it were an independent project. 4. No testing for, or demolition and removal of, Hazardous Materials is included, regardless of notes regarding or allusions to the presence of Hazardous Materials in the Contract Documents. A Hazardous Material is any substance or material identified now or in the future as hazardous under any federal, state or local law or regulation, or any other substance or material including mold, fungi, or bacteria which may be considered hazardous or otherwise subject to statutory or regulatory requirement governing handling, disposal or clean-up. The Construction Manager shall not be obligated to commence or continue work until any Hazardous Material discovered at the project Worksite has been removed, rendered or determined to be harmless by the Owner as certified by an independent testing laboratory and approved by the appropriate government agency. 5. Costs or fees assessed by utility companies related to the project or required to complete the work are not included in the Early Release Work. These costs or fees include, but are not limited to, tap fees, impact fees, line installation charges, meter charges, inspection fees, connection charges, etc. 6. Neither removal nor re -installation of existing furnishings and equipment are included in the Early Release Work. These existing furnishings and equipment include, but are not limited to, signage and artwork, banners, food and souvenir vendor carts, storage shelves and cribs, tables, desks, chairs, projectors, televisions, computers, phones, and other technology devices. 7. Commissioning of systems is not included in the Early Release Work. Start-up requirements noted in the specifications are included. Unsuitable soil removal and replacement is not included in the Early Release Work. This price assumes that all natural soils found at subgrade elevations shown or derived from the requirements of the Early Release Work documents provide the required bearing strength for the new construction those soils will support. 9. Relocation of any existing utilities or other subsurface plumbing or electrical lines not specifically noted on the Early Release Work documents is not included in the Early Release Work. Where the plans note to verify the location of existing utilities, the existing location is assumed to not conflict with the new work. 10. No additional building permit fees are included in the Early Release Work. Early Release Authorization 1 included $15,000 for building permit fees as an allowance. That allowance covered the current Contract Sum at the permit fee schedule for Remodels. The permit fee allowance will be increased to the total project amount at the GMP. If the City of South Bend requires payment for the entire project permit cost before the GMP, an additional Early Release Authorization will be required for additional permit fees. 11. Builder's Risk or equivalent Property Insurance is not included in the Early Release Work. This changes Agreement Exhibit B — Insurance and Bonds. The Owner shall provide the required property insurance noted in section B.2.3 of Agreement Exhibit B. 12. The outdoor showers and the water line serving those showers shown on sheet 2-C401 is not included. No model was specified for these showers, preventing bidders from pricing them accurately. Furthermore, the water shown on the civil sheet was not connected to an active water service on the plumbing sheets. 13. Access to the construction area is through the parking lot of the adjacent property, the "Ivy." This access is assumed to be granted without additional restrictions or costs. No re -paving of the parking lot or reconstruction of the sidewalk at the edge of the parking lot is included. Gravel and steel plates will be placed over the existing sidewalk as shown on the logistics plan included in section 00 31 13. 14. Neither additional nor reworked gas piping necessary to relocate the gas meter in Unit J is included. NIPSCO is assumed to relocate the face of the meter on the existing gas riser. EARLY RELEASE 2: EXHIBIT 7 List of Allowances and Contingencies Allowances The following allowances are included in the Early Release Work. These allowances serve two purposes. First, these allowances provide funding sources for work in bid packages that are being rebid. Second, these allowances fund potential work that may be needed to complete the project, but which is either not defined in the project documents or not defined in sufficient detail in the project documents to accurately estimate the value. The Early Release Work shall be adjusted, either with additions or deductions, by Change Order, by the difference between the actual cost of the work allocated to these allowances and the allowance value noted below. Upon mutual agreement between the Construction Manager and Owner, these allowances may be used for purposes other than the proposed uses noted below.
