Some of the work packages, particularly the MEP packages, came in well above the expected budget. The City is working with our consultants and CMc to do some rescoping around the MEP packages to simplify them and make them more attractive to bidders so that they can be re-bid to bring the project within budget. These packages will be combined with the Phase 3 bid which should also create bidding efficiencies. The City would like to approve the list of the bid packages therein that came in within the expected budget to guarantee the pricing for them as well as provide the contractor with important portions that they can move forward on to ensure the project schedule that we need. This Early Release Work amendment, through the AIA G735 contract, will give the contractor the opportunity to begin work and shop drawings on critical path items like steel and roofing. Following this Early Release Work, the other amendments for Phase 2 and Phase 3 will come to the Board for approval in the future. These three portions will be considered as one Guaranteed Maximum Price for the full project. Please let me know if you have any questions. Thank you. The intent of the Early Release Work is to allow the structure and shell of the new Upper Decks to proceed while the remaining work needed to complete the scope shown on the specifications (Exhibit 3) and drawings (Exhibit 4) is redesigned and rebidded. 3.The work described in the following Bid Packages in section 01 12 00 Subcontracts Summary is included in the Early Release Work: •BP1-Demolition •BP2-Concrete •BP5-Masonry •BP6-Structural Steel •BP8-General Trades •BP9-Roofing •BP10-Doors, Frames, & Hdw. •BP11-Aluminum and Glazing •BP12-Walls, Ceilings, & Paint •BP13A-Carpet & Res. The portion of these costs allocated to this Early Release Work are not enough to support the Early Release Work if it were an independent project. For example, only 40% of the estimated Construction Manager Staffing Costs for the entire Upper Decks project are included in this Early Release Work. The other 60% will be included in the final GMP, developed and approved in the late fall of 2024. Therefore, the Construction Manager Staffing costs included in this Early Release will only cover 40% of the duration of the Upper Decks portion of the project. 6.No testing for, or demolition and removal of, Hazardous Materials is included, regardless of notes regarding or allusions to the presence of Hazardous Materials in the Contract Documents. A Hazardous Material is any substance or material identified now or in the future as hazardous under any federal, state or local law or regulation, or any other substance or material including mold, fungi, or bacteria which may be considered hazardous or otherwise subject to statutory or regulatory requirement governing handling, disposal or clean-up. The Construction Manager shall not be obligated to commence or continue work until any Hazardous Material discovered at the project Worksite has been removed, rendered or determined to be harmless by the Owner as certified by an independent testing laboratory and approved by the appropriate government agency. 7.Costs or fees assessed by utility companies related to the project or required to complete the work are not included in the Early Release Work. These costs or fees include, but are not limited to, tap fees, impact fees, line installation charges, meter charges, inspection fees, connection charges, etc. 8.Neither removal nor re-installation of existing furnishings and equipment are included in the Early Release Work. These existing furnishings and equipment include, but are not limited to, signage and artwork, banners, food and souvenir vendor carts, storage shelves and cribs, tables, desks, chairs, projectors, televisions, computers, phones, and other technology devices. 9.Commissioning of systems is not included in the Early Release Work. Start-up requirements noted in the specifications are included. 10.No existing structure work is included at the new cooler in Pantry B-214. The food service equipment plans note a floor depression in this area, but neither the demolition nor structural plans show how this depression is to be created. Either structural work or a cooler floor panel with ramp needs to be added to the Early Release Work to provide a functional cooler. 11.Where existing finishes are noted to be removed, only one layer of a finished is assumed to exist on top of the existing substrate. Removal of multiple layers of flooring, ceilings, or coatings is not included in the Early Release Work. These shop primers are intended to only provide temporary and provisional protection against corrosion. The intermediate and top coats specified in section 099113 will be applied directly to the shop primer. Different primers or shop surface preparation methods, such as those recommended by the paint manufacturer or those needed to achieve a different level of paint system performance than that provided by a standard shop primer, are not included in the Early Release Work. 13.New landscaping or restoration of existing landscaping is not included in the Early Release Work. The grass and tree lawn spaces on the south and west sides of the existing stadium will be stripped of existing grass and trees to complete this project. New topsoil, grass, trees, mulch, and other landscaping are not included in the Early Release Work. 14.Unsuitable soil removal and replacement is not included in the Early Release Work. This price assumes that all natural soils found at subgrade elevations shown or derived from the requirements of the Early Release Work documents provide the required bearing strength for the new construction those soils will support. 15.Relocation of any existing utilities or other subsurface plumbing or electrical lines not specifically noted on the Early Release Work documents is not included in the Early Release Work. Where the plans note to verify the location of existing utilities, the existing location is assumed to not conflict with the new work. 16.Building permit fees are included in the Early Release Work as an allowance. This allowance amount is more than sufficient to cover the general building permit based on the square footage of the added building area at the City of South Bend’s published permit fee schedule for New Construction and Additions. However, this allowance amount is not sufficient to cover a building permit fee based on the estimated cost for the entire Upper Deck estimated cost at the permit fee schedule for Remodels. 17.Builder’s Risk or equivalent Property Insurance is not included in the Early Release Work. This changes Agreement Exhibit B – Insurance and Bonds. The Owner shall provide the required property insurance noted in section B.2.3 of Agreement Exhibit B. These allowances serve two purposes. First, these allowances provide funding sources for work in bid packages that are being rebid. Second, these allowances fund potential work that may be needed to complete the project, but which is either not defined in the project documents or not defined in sufficient detail in the project documents to accurately estimate the value. The Early Release Work shall be adjusted, either with additions or deductions, by Change Order, by the difference between the actual cost of the work allocated to these allowances and the allowance value noted below. Upon mutual agreement between the Construction Manager and Owner, these allowances may be used for purposes other than the proposed uses noted below. Amount Title Proposed Allowance Use $100,000 MEP Demolition Demolish mechanical/HVAC, electrical, and plumbing system necessary to erect the new Upper Deck Structure. This includes removal of speakers, lights, other electrical device hung from the existing roof structure that is to be demolished as well as removal of exhaust fans and ductwork on the concessions roofs that conflict with the new Upper Deck Structure. $15,000 Misc. Excavation Demolish the section of the field concrete retaining walls and adjacent site concrete as needed to install the new foul ball netting poles. Auger the holes for the new foul ball netting poles. Backfill the area after the new concrete is poured. Remove concrete, excavate, and backfill for the new elevator pit in Unit C. $15,000 Building Permit Obtain the general building permit. $20,000 Pepsi Club Remobilization Remobilize the demolition and steel erection cranes and crews, as well any other subcontractor’s crews in this GMP to perform the Pepsi Club demolition, structure, and shell in the 2025-26 offseason.
