GAMMON Approved and signed by me I r g Clerk ORDINANCE NO. -13 `f -�� AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBE PROPERTY: Legal Description A PART OF THE ALLEY THAT IS KNOWN AS RASMUSSEN COURT OF THE ORIGINAL PLAT OF THE TOWN (NOW CITY) OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA, MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHEAST CORNER OF LOT 36 OF SAID PLAT, THENCE EAST A DISTANCE OF 14.0 FEET ALONG THE PROLONGATION EXTENSION OF THE NORTH LINE OF SAID LOT 36 TO THE NORTHWEST CORNER OF LOT 25, THENCE SOUTH A DISTANCE OF 146.45 FEET ALONG THE EAST LINE OF SAID ALLEY, THENCE NORTHWEST A DISTANCE OF 19.8 FEET TO THE SOUTHEAST CORNER OF LOT 35, THENCE NORTH A DISTANCE OF 132.45 FEET ALONG THE EAST LINE OF SAID ALLEY TO THE POINT OF BEGINNING. SAID TRACT CONTAINS 1952 SQUARE FEET (0.045 ACRES). STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36- 7 -3 -12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above decribed public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right -of -way, unless such rights are released by the individual utilities. SECTION III. The following property may be injuriously or beneficially affected by such vacating: Lots 25, 26, 35 and 36 of the Original Plat of the Town (now city) of South Bend, St. Joseph County, Indiana. SECTION IV. The purpose of the vacation of the real property is to: For development of the adjacent property and construction of a parking facility. (Note: Existing service drive is to be modified to connect with Main Street). SECTION V. This ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor. PARENT, Mayor COUNTY -CITY BUILDING SOUTH BEND, INDIANA 46601 June 5, 1984 Members of the Common Council Council Chambers County -City Building, 4th Floor South Bend, Indiana 46601 RE: ALLEY VACATION - NORTH /SOUTH ALLEY BOUNDED BY WASHINGTON, MAIN, JEFFERSON AND MICHIGAN STREETS Dear Members of the Council: 219/284 -9412 In accordance with Ordinance No. 6971 -81, a favorable recommendation is being submitted to the Common Council concerning the Petition of the South Bend Redevelopment Commission to vacate the north /south alley in the block bounded by Washington Street, Main Street, Jefferson Street and Michigan Street in the City of South Bend, Indiana. For your information, a public hearing was held on Monday, June 4, 1984, by the Board of Public Works concerning the proposed vacation. No one was present to speak either for or against the Petition and no written objections were filed with the Board. A copy of the excerpts of the minutes of the public hearing is attached for your information. Based on the comments received from the Engineering Department,.Area Plan Commission and Community Development Department, the Board of Public Works recommends vacation of the above referred to alley subject to the dedication of additional right -of -way for an east -west access between Main Street and the north /south alley in question and subject to any and all utility easements.
