Project Background In conjunction with Long Term Control Plan and Consent Decree objectives as well as the hydraulic analysis from the 2013 Wastewater Treatment Plant Facilities Plan, the scope of work for this Amendment addresses Primary Clarifier and Secondary Treatment hydraulic improvements to convey 100 MGD wet weather flows through Secondary Treatment. Item 1: Primary Clarifier Effluent Channel Improvements This work includes the expansion of the effluent channel Parshall flumes and removes an existing, non-functional flow meter that has created a restriction in the Primary effluent piping. Item 2: Upsizing Secondary Clarifier Influent Pipe to Final Clarifier 6 & Final Clarifier 7 This work includes the replacement of a 66-inch diameter pipe with an 84-inch diameter pipe as well as structural improvements to junction chambers to carry flow from the Final Clarifier Influent Channel at the Aeration Gallery to Final Clarifier 6 and Final Clarifier 7. Project Number: 30029091 AMENDMENT No. 2 119-069 WWTP Secondary and Disinfection Improvements Amendment No. 2 Schedule A-1 Scope of Amended Services and Related Matters ENGINEERING SERVICES BY ARCADIS WWTP Hydraulic Improvements. The City of South Bend desires to continue its efforts to rehabilitate, modify and expand the WWTP to work towards achieving the CSO Long-Term Control Plan requirement, which requires an increase in the peak wet weather capacity from 77 MGD to 100 MGD. The South Bend WWTP is a Class IV activated sludge treatment facility required to provide preliminary treatment, primary and secondary treatment, phosphorous removal, and disinfection throughout all seasons. The NPDES permit lists a rated average flow of 48 MGD and a rated peak flow of 77 MGD. The plant’s current average flow is approximately 36 MGD and it can treat a peak flow up to 77 MGD. Liquid treatment processes include screening, grit removal, raw sewage pumping, primary treatment, activated sludge, final clarifiers, and chlorination / dechlorination. Sludge treatment processes include gravity thickening of primary sludge, dissolved air floatation thickening of waste activated sludge, two- stage anaerobic digestion, and belt filter press dewatering. Class B biosolids are reused by land application on farmland. As part of Arcadis’ prior planning projects, a hydraulic model was created for the plant and used to model different flow conditions through each process at the plant to achieve the plant’s future 100 MGD peak flow requirement as part of the CSO Long-Term Control Plan. The hydraulic model was calibrated using recorded plant flows and water surface elevations around the plant. Limiting hydraulic elements, also called bottlenecks, were identified and analyzed further under peak flow and other hydraulic conditions. The City has addressed all bottlenecks except two major areas require hydraulic improvements at the WWTP to achieve the future 100 MGD flow: (1) Primary Effluent and (2) Final Clarifier Nos. 6 and 7 Influent, as further described below. In addition, there are abandoned structures within these areas that may be demolished. Primary Effluent Hydraulic Improvements. The preliminary and primary treatment process consists of the headworks facility (screening, grit removal), raw sewage pumping and the primary clarifiers. After the plant flow leaves the headworks, the raw sewage pumps (located in the Compressor Building) pump flow into the primary influent channel which discharges into eight primary clarifiers. The flow from each individual primary clarifier goes into a common primary effluent conduit and the common primary effluent conduit is a hydraulic bottleneck. The primary clarifier effluent conduit restricts flow leaving the primary clarifiers such that at flows equal to or greater than approximately 65 MGD, the primary clarifier effluent flumes are submerged. At 100 MGD flow, the model predicts that this bottleneck results in no freeboard in the primary clarifiers. Modifying the effluent conduit and primary clarifier effluent Parshall flumes would alleviate this bottleneck. The abandoned in place 48-inch primary effluent meter has also been identified as a hydraulic bottleneck in the primary effluent piping. The following is proposed to alleviate the primary effluent bottleneck. A new open channel located parallel to the existing primary effluent conduit along Primary Clarifier Nos. 1 through 4 only, north of the Primary Scum Building, and utilizing the abandoned east-west bypass channel located above the primary effluent conduit is recommended. The new channel and the existing conduit will flow into the existing east-west conduit and into the re-utilized abandoned bypass channel. Flow from the bypass channel will flow into the primary effluent structure, similar to the existing primary effluent conduit, by removing the bypass channel gates and demolishing a portion of the primary effluent structure wall. With all primary clarifiers in service (with a return sludge flow of 72 MGD and all other tanks in service), these improvements will un- submerge the weirs up to 80 MGD and the flumes up to 100 MGD and provide approximately 12-inches of freeboard in the primary clarifiers up to 100 MGD. The abandoned in place 48-inch primary effluent meter and 48”x72” reducers will be replaced with 72-inch pipe. Final Clarifier Nos. 6 and 7 Influent Hydraulic Improvements. The Final Clarifier Nos. 6 and 7 influent pipe was identified as another plant hydraulic bottleneck. The 60-inch pipe located between the south end of the Final Clarifier Influent Channel and Junction Box NT1 that feeds Final Clarifier Nos. 6 and 7 is the source of the hydraulic bottleneck under peak flow conditions. At the current peak capacity of 77 MGD and at the FEMA 100-year flood elevation, the 60- inch pipe has inadequate flow capacity and can cause flow overtopping upstream within the plant. This pipe segment has been modeled to show inadequate capacity at the future peak flow of 100 MGD under normal river conditions. Replacing the existing 60-inch pipe with a larger size pipe would alleviate this hydraulic bottleneck. As part of the prior planning, upsizing the existing 60-inch pipe in the segment indicated above to 84-inch pipe is recommended. However, another alternative for consideration is instead to provide a new channel from the south end of the Final Clarifier Influent Channel to Junction Box NT1 or potentially to Junction Box NT. This would require channel mixing. The benefits include STANDARD AGREEMENT FOR PROFESSIONAL SERVICES Page 3 of 7 Between City of South Bend and ARCADIS U.S., Inc. Project Number: 30029091 AMENDMENT No. 2 119-069 WWTP Secondary and Disinfection Improvements Amendment No. 2 less dewatering during construction and an open channel for visual inspection. The pipe and channel alternatives for this segment will be evaluated at a high-level. Miscellaneous Demolition Near Hydraulic Improvements. An abandoned concrete pad east of the primary clarifiers and north of the Primary Scum Building will be demolished. The existing Parshall flumes will be evaluated during preliminary design if modification of the flumes is cost effective when the primary effluent hydraulic improvements are constructed. Arcadis will prepare design drawings and specifications as a supplement to the Final Clarifier Nos. 1-3 Improvements project, which is being delivered through a Guaranteed Savings Contract between the City and Bowen Engineering. The City will coordinate with Bowen Engineering to provide associated construction cost estimates for this project. Arcadis will also perform construction administration services. The City will perform construction inspection. A SharePoint site will be established for use during design. The scope of engineering services shall include the following: 1. Project Management. Provide project management including scope, budget and schedule control; project coordination; maintenance of records; project setup, invoicing, and close-out. 2. Kick-off and Design Review Meetings. Meet with the City to kick-off the project including a site visit to perform initial above-ground field investigations. Meet in-person with the City monthly to share progress, resolve outstanding items, perform additional field needs, and review deliverables and design progress for 60% and final designs. In addition to these in-person meetings, up to four conference calls are included. 3. Survey. A survey may be required during design for key spot elevations. Any survey will be provided via subcontract services. A $5,000 allowance, currently not included in the fee pricing, shall be added if survey is needed. 4. Basis of Design. Conduct a preliminary design including the following tasks. a. During the kick-off meeting, inspect the abandoned primary effluent channel from the surface to determine structural rehabilitation needs of the channel for future use. b. Confirm hydraulics to determine extent of hydraulic improvements. c. Confirm structural needs including rehabilitation for all areas. d. Obtain manufacturers’ cut sheets including materials of construction, cost quotes, delivery schedules, and dimensions from vendors for piping and equipment. e. Develop preliminary requirements for construction phasing and for coordination with Owner’s operations including allowable pipe/tank shutdowns and scheduling. f. Perform a constructability review of the design at this time. g. Develop preliminary engineer’s opinion of probable construction costs. h. Prepare preliminary drawings and major equipment specifications. i. Summarize the above tasks in a Basis of Design Meeting. 5. Construction Drawings. Prepare detailed drawings to supplement the Final Clarifier Nos. 1-3 Improvements drawings to show the general scope, extent and character of the work to be furnished and performed by Contractor. The plans will show civil piping configuration and layout, structural components and detail. Record drawings will be recreated in AutoCAD for use as the base sheets. 6. Specifications. Prepare specifications to supplement the Final Clarifier Nos. 1-3 Improvements project manual. The technical specifications will be prepared in conformance with the fifty-division format of the Construction Specifications Institute. 7. Industrial Treatment Evaluation. Arcadis evaluated digestion alternatives for providing treatment to a potential industrial user’s discharge that was proposing to discharge high loads of BOD to the South Bend WWTP. Alternative evaluations included: (1) evaluating the treatment capacity of the existing processes at the South Bend WWTP to treat higher BOD loads and (2) sizing and providing a high-level construction cost estimates of a remote digester facility to treat proposed BOD loads from a new industrial discharger. 8. Construction Schedule. Prepare construction schedule establishing advertisement dates, bid opening, notice-to-proceed, and critical milestone dates for each design deliverable. 9. Guaranteed Maximum Price Assistance. Assist the City in reviewing the guaranteed maximum price. Upon successful completion of the design phase, the following construction services apply. Project Number: 30029091 AMENDMENT No. 2 119-069 WWTP Secondary and Disinfection Improvements Amendment No. 2 10. General Administration of Construction Contract. Consult with Owner and act as Owner’s representative as provided in the Construction Contract. The extent and limitations of the duties, responsibilities, and authority of Engineer as assigned in the Construction Contract shall not be modified, except as Engineer may otherwise agree in writing. All of Owner’s instructions to Contractor will be issued through Engineer, which shall have authority to act on behalf of Owner in dealings with Contractor to the extent provided in this Agreement and the Construction Contract except as otherwise provided in writing. 11. Pre-Construction Conference. Participate in a Pre-Construction Conference prior to commencement of Work at the Site. The conference will be attended by Engineer. 12. Schedules. Receive, review, and determine the acceptability of schedules that Contractor is required to submit to Engineer, including the Progress Schedule, Schedule of Submittals, and Schedule of Values. 13. Visits to Site and Observation of Construction. In connection with observations of Contractor’s Work while it is in progress: • Make visits to the Site at intervals appropriate to the various stages of construction, as Engineer deems necessary, to observe as an experienced and qualified design professional the progress of Contractor’s executed Work. Such visits and observations by Engineer are not intended to be exhaustive or to extend to every aspect of Contractor’s Work in progress or to involve detailed inspections of Contractor’s Work in progress beyond the responsibilities specifically assigned to Engineer in this Agreement and the Contract Documents, but rather are to be limited to spot checking, selective sampling, and similar methods of general observation of the Work based on Engineer’s exercise of professional judgment, as assisted by the Owner’s Resident Project Representative. Based on information obtained during such visits and observations, Engineer will determine in general if the Work is proceeding in accordance with the Contract Documents, and Engineer shall keep Owner informed of the progress of the Work. Engineer will visit the Site on the same day of each construction progress meeting. The scope of these engineering services is based on up to 10 months of construction progress meetings. • The purpose of Engineer’s visits to the Site will be to enable Engineer to better carry out the duties and responsibilities assigned to and undertaken by Engineer during the Construction Phase, and, in addition, by the exercise of Engineer’s efforts as an experienced and qualified design professional, to provide for Owner a greater degree of confidence that the completed Work will conform in general to the Contract Documents and that Contractor has implemented and maintained the integrity of the design concept of the completed Project as a functioning whole as indicated in the Contract Documents. Engineer shall not, during such visits or as a result of such observations of Contractor’s Work in progress, supervise, direct, or have control over Contractor’s Work, nor shall Engineer have authority over or responsibility for the means, methods, techniques, sequences, or procedures of construction selected or used by Contractor, for security or safety at the Site, for safety precautions and programs incident to Contractor’s Work, nor for any failure of Contractor to comply with Laws and Regulations applicable to Contractor’s furnishing and performing the Work. Accordingly, Engineer neither guarantees the performance of any Contractor nor assumes responsibility for any Contractor’s failure to furnish or perform the Work in accordance with the Contract Documents. 14. Defective Work. Reject Work if, on the basis of Engineer’s observations, Engineer believes that such Work (a) is defective under the standards set forth in the Contract Documents, (b) will not produce a completed Project that conforms to the Contract Documents, or (c) will imperil the integrity of the design concept of the completed Project as a functioning whole as indicated by the Contract Documents. 15. Clarifications and Interpretations; Field Orders. Issue necessary clarifications and interpretations of the Contract Documents as appropriate to the orderly completion of Contractor’s work. Such clarifications and interpretations will be consistent with the intent of and reasonably inferable from the Contract Documents. Subject to any limitations in the Contract Documents, Engineer may issue field orders authorizing minor variations in the Work from the requirements of the Contract Documents. Coordinate a tracking log for clarifications and interpretations as part of the electronic data information system developed by Engineer. 16. Change Orders and Work Change Directives. Recommend change orders and work change directives to Owner, as appropriate, and prepare change orders and work change directives as required. 17. Shop Drawings and Samples. Review and approve or take other appropriate action in respect to Shop Drawings and Samples and other data which Contractor is required to submit, but only for conformance with the information given in the Contract Documents and compatibility with the design concept of the completed Project as a functioning whole as indicated by the Contract Documents. Such reviews and approvals or other action will not extend to means, methods, techniques, sequences, or procedures of construction or to safety precautions and programs incident thereto. Engineer shall meet any Contractor’s submittal schedule that Engineer has accepted. Substitutes and “or-equal” Requests. Review the Contractor’s requests for product substitutions and “or equal”; Engineer will separately track the time and expense required for such reviews and invoice the Client for such reviews as Additional Services. 19. Inspections and Tests. The Owner’s Resident Project Representative will require such special inspections or tests of Contractor’s work as deemed reasonably necessary, and receive and review all certificates of inspections, tests, and approvals required by Laws and Regulations or the Contract Documents. Any review by Engineer of such certificates will be for the purpose of determining that the results certified indicate compliance with the Contract Documents and will not constitute an independent evaluation that the content or procedures of such inspections, tests, or approvals comply with the requirements of the Contract Documents. Engineer shall be entitled to rely on the results of such tests. 20. Change Proposals and Claims. (a) Review and respond to Change Proposals. Review each duly submitted Change Proposal from Contractor and, within 30 days after receipt of the Contractor’s supporting data, either deny the Change Proposal in whole, approve it in whole, or deny it in part and approve it in part. Such actions shall be in writing, with a copy provided to Owner and Contractor. If the Change Proposal does not involve the design (as set forth in the Drawings, Specifications, or otherwise), the acceptability of the Work, or other engineering or technical matters, then Engineer will notify the parties that the Engineer will not resolve the Change Proposal. (b) Provide information or data to Owner regarding engineering or technical matters pertaining to Claims. 21. Contractor’s Completion Documents. Receive, review, and transmit to Owner maintenance and operating instructions, schedules, guarantees, bonds, certificates or other evidence of insurance required by the Contract Documents, certificates of inspection, tests and approvals, Shop Drawings, Samples and other data approved, and transmit the annotated record documents which are to be assembled by Contractor in accordance with the Contract Documents to obtain final payment. 22. Substantial Completion. Promptly after notice from Contractor that Contractor considers the entire Work ready for its intended use, in company with Owner and Contractor, visit the Project to determine if the Work is substantially complete. If after considering any objections of Owner, Engineer considers the Work substantially complete, Engineer shall deliver a certificate of Substantial Completion to Owner and Contractor. 22. Record Drawings. Prepare Record Drawings showing appropriate record information based on Project annotated record documents received from Contractor and furnishing such Record Drawings to Owner. A hard copy (full size drawings) and electronic copy (in AutoCAD and pdf file format) will be submitted to the Owner. AutoCAD version shall be based on the Owner’s standards. 23. Final Notice of Acceptability of the Work. Conduct a final visit to the Project to determine if the completed Work of Contractor is acceptable so that Engineer may recommend, in writing, final payment to Contractor. Accompanying the recommendation for final payment, Engineer shall also provide a notice in the form attached hereto as Exhibit E (the “Notice of Acceptability of Work”) that the Work is acceptable to the best of Engineer’s knowledge, information, and belief and based on the extent of the services provided by Engineer under this Agreement. The scope of these engineering services is based on the final visit conducted during the regular progress meeting. DELIVERABLES This project includes the following deliverables. 1. Preliminary (60%) Design. This submittal includes documents that communicate the results of the preliminary design and establishes the scope of the construction work.  Preliminary drawings showing layouts  Preliminary construction phasing  Technical specifications  Preliminary construction schedule 2. Final Design Submittal. Design services shall be completed in sufficient time for the City to get a GMP from the guaranteed savings provider and within three months from notice-to-proceed. This assumes the City will provide comments on design deliverables within two weeks. It is anticipated construction will be completed within a 10-month period.
