ASAP towing, a higher standard of service.
Not all vehicles need just a "tow" and not all vehicles can be towed the same way. Recovery from
buildings and off road requires special training and equipment. Electric vehicles require special
handling and storing. ASAP's drivers are trained and certified in light, medium and heavy-duty towing.
Technology is rapidly changing; ASAP Towing is changing with it.
ASAP Towing is pleased to submit this proposal for services to support The South Bend City Police
Department in achieving its goals for improving efficiency, customer service, and satisfaction by
providing recovery, removal, towing, and storage services. ASAP is committed to improving the
customer experience through convenience, professional interactions, and timely work. ASAP Towing
has reviewed the bid requirements outlined in the RFP and is prepared to comply, as outlined, in the
following proposal for services.

EXECUTIVE SUMMARY
The Objective
The City of South Bend Police Department is in need of two properly licensed towing companies
to provide twenty-four hours a day, seven days a week service for the recovery, removal, towing, and
storage impoundment of certain motor vehicles within the City of South Bend. Additionally, the city
has deemed the need for a secure storage facility within five miles of the City of South Bend, and that
the towing entities named will provide all billing services for vehicles removed and/or stored.
The Goals
The City of South Bend Police Department is in need of two properly licensed towing companies to
provide twenty-four hour a day, seven days a week service for the recovery, removal, towing, and
storage impoundment of certain motor vehicles within the city.
The goals are:
• Two properly licensed towing companies to provide twenty-four hours a day, seven days
a week recovery, removal and storage services.
• Two companies that shall maintain and have exclusive control of three recovery vehicles
that are DOT registered.
• Storage facilities that are within five miles of South Bend City limits, that are both secure
and operate a minimum of 6 days per week.
• Proper billing, storing, release of vehicles, and recording of charges for vehicle owners
and services provided.
• Fair and just cost for vehicle owners and indemnity of the City of South Bend for any
costs associated with the outlines of this proposal.
The Solution
ASAP Towing (hereinafter referred to as "ASAP/The Company' is fully licensed by the State of Indiana
and the City of South Bend to own, operate, and provide recovery, removal, towing and storage
services for the City of South Bend and the surrounding area. The company owns and operates
twenty-one (21) vehicles, twenty-four hours a day, seven days a week, that are capable of passenger
vehicle
and light truck removals, as well as campers, semis and trailers. The company provides three (3) fully
secured storage lots within the City of South Bend, none over 4.5 miles from the police station. ASAP
Towing comes to you with a combined inside storage capacity of 595 vehicles and outdoor storage
capacity for 7,352 vehicles.
Our company will also provide properly trained and certified equipment operators that are subject to
preemployment background checks, pre -employment drug testing and random drug testing during
employment with the company.
We will provide:
• One properly licensed towing company to provide twenty-four hour a day, seven days a week
recovery, removal, towing and storage services.
• A minimum of twelve (12) recovery vehicles that are DOT registered and licensed with the State
of Indiana.
• Our secure storage facilities are located within the city limits.
• Hours of operation that comply with timeframes outlined in the RFP.
• Proper billing, storing, release of vehicles, and recording of charges for vehicle owners and
services provided.
• Fair and just cost for vehicle owners and indemnity of the City of South Bend for any costs
associated with the outlines of this proposal.

ASAP Towing has a rolling land line at the base station office (1906 S. Olive Street) with a
dedicated phone number only given to the City of South Bend/St. Joseph County dispatch
center and communicates with each of the drivers via company cell phones. During evening
hours when the office is not manned, calls are dispatched by the office answering service as
well as a dedicated cell phone manned twenty-four hours a day by the current driver on call.
Calls to the main land line office phone are forwarded to the answering service and calls are
then dispatched to the drivers via company cell phones.
ASAP Towing holds indemnity and liability insurance under U.S. Truck and Trailer Service, Inc.,
the parent company, of ASAP Towing. Liability insurance and property damage covers up to
$1,000,000.00 with umbrella coverage up to $2,000,000.00 including On -Hook Coverage and is
held by Trumbull Insurance Company - certificate #877331622, policy #37UENOL2209.

Equipment (25 points)
Per proposal requirements, ASAP, owns, maintains, and has exclusive use and control of the
vehicles listed below. All vehicles have the capacity to tow passenger, light truck, campers, and
a variety of trailers, have a one -ton capacity, and rear dual wheels. Per state regulations, each
company vehicle prominently displays the name, logo, phone number and DOT number on both
sides of the vehicle so it can be easily identified. Vehicle markings are in accordance with
Indiana Department of Motor Carrier Services Division 49 CFR 390.21.

* LCG Bed - Low Center of Gravity bed is 6" lower than industry standard rollback beds which allows us
to haul taller loads while staying within legal height as well as keeping the weight closer to the ground
for safer transport. This low -profile bed also gives us an <11 degree loading angle which allows us to
load vehicles with extreme low ground clearance without damaging the bumper, valance, and exhaust.
** Right Approach and Extreme Angle Bed - This bed is ultra specialized for the loading of vehicles with
extremely low ground clearance and exotic vehicles. The release handle allows the rear hinged deck
section to be lowered to a 6° load angle. A cable guide is inserted in the deck to keep the cable low while
winching the vehicle onto the rear deck. After the vehicle's front wheels are on the carrier, the deck can
be leveled out and the cable guide removed allowing the vehicle to overcome the second clearance
problem with the forward section of the deck. With the front wheels on the front section of the deck
the process can be repeated to eliminate clearance problems such as extreme low front and rear
bumpers as well as low exhausts or extended rear overhang.
a) Vehicle Equipment — the following is included in each company vehicle — list includes but is
not limited to:
i. A minimum of four LED flashing emergency lighting.
ii. Debris removal equipment, consisting of: Two oversized containers, a broom,
shovel, fluid absorbent (oil -dry), safety chains, straps, and emergency beacons.
iii. Company employees are provided with reflective uniforms, vests/jackets that
meet OSHA/ANSI-3 requirements. All employees are required to wear reflective
clothing when on scene or during the transport of removal vehicles. Uniforms
display company and driver name for easy identification to officers and owners
of vehicles.
ASAP Towing as well as all employees of the company agree to and shall be available for inspection
should the City make the request and subject to random inspections to ensure quality performance.
ASAP Towing currently operates daily maintenance, cleaning, and safety checks of all vehicles and the
storage facility. It is the responsibility of all employees to comply with safety and cleaning checks.
ASAP agrees to continue these standards to ensure the safety of both its employees and customers.
ASAP agrees to report to the City, in writing, any changes, additions or deletions from the company's
tow truck fleet used under this contract.

Storage Facilities (20 points)
• ASAP Towing owns and operates two commercial properties and leases a third property. To
better serve our customers our main lot is located within city limits, on the local South Bend
City Transpo bus line and two (2) miles from the South Bend Police Department. Our second
location offers indoor and outdoor storage. Our third location is an overflow lot for vehicles
that are not on a police hold and over thirty days old. This location is also on the local South
Bend City Transpo bus line and four and one half (4.5) miles from the South Bend Police
Department.

vehicles, and outdoor storage for 200 vehicles.
0 1311 S. Olive Street — houses indoor storge for 555 vehicles and outdoor storage
for up to 4,152 vehicles.
0 55303 Mayflower Road — houses indoor storage for 20 vehicles and outdoor
storage capacity for 3,000 vehicles.
• ASAP Towing provides twenty-four hour indoor and outdoor monitoring and surveillance of all
three locations using the following systems:
o Lot and indoor surveillance are monitored via ADT — benefits include
■ 24-hour DVR recording
■ 16 Channel Digital Video Recorder
■ Remote access and smart viewing via Smartphone or computer
■ 16 TVL line Cameras with recording technology and night vision capacity
o Additional twenty -four-hour security— provided by ADT
o Additional security measures include:
■ The outdoor lot and premises at 1906 S. Olive Street are surrounded by six-foot
security fencing with wire. Lot gate is electronic and can only be opened by
authorized employees.
■ The outdoor lot and premises at 1311 S. Olive Street are surrounded by 8-foot
security fencing with wire. Lot gate can only be opened by authorized
employees.

The outdoor lot and premises at 55303 Mayflower Road are surrounded by
eight -foot security fencing with wire. Lot gates can only be opened by
authorized employees.
All owners of stored vehicles are to provide proof of identification and
ownership and escorted to the vehicle by an employee. An employee maintains
their presence the entire time the owner is in the storage lot.
• All locations also provide storage for Electric Vehicles and Hybrid Vehicles.
■ EV's and Hybrid Vehicles are not stored inside a structure or within fifty (50) feet
of any structure, vehicle or combustibles. ASAP has 3 concrete bays that remain
ventilated and periodically checked for leaking fluids, sparks, smoke, flames,
gurgling, or bubbling sounds from the battery that would indicate potential for a
fire or explosion.

Release/Payment Operations (20 Points)
• Per proposal requirements, ASAP hours for payment and release of vehicles include the
following times:
a. gam — 5pm Monday through Friday
b. 8am —12pm Saturday
c. Sundays, holidays and after-hours pick-up can be made by appointment and an
additional fee of $75.00
Hours of operation, as well as, after hours contact information signs are clearly posted on entry
doors of both locations.
• Procedures for payment and release of impounded vehicles is as follows:
Upon the owner obtaining a release form from the police station and presenting it to ASAP, we will ask
for a valid photo id. (Driver's license, passport, or state issued id), we will compare the paperwork to

the release form and registration and/or title. We will make copies for our files of the release form,
photo id and registration and/or title. The invoice will then be presented for payment and the
signature of the owner. Forms of payment for a vehicle requiring a police release will be cash and/or
credit/debit card. No personal checks will be accepted. After payment is received the owner will be
provided a receipt and asked to wait at the gate and an employee will bring the vehicle outside of the
gate for the owner. ASAP Towing shall comply with Section 20-29 of the South Bend Municipal Code
for abandoned vehicles.
BID PROPOSAL GENERAL SPECIFICATIONS
Pricing for Services (10 points)
Initial tow of a vehicle including cleanup, hookup and transport:
Impounded vehicles not involved in an accident $ 145.00
Impounded vehicles involved in an accident $ 165.00
Non -impounded vehicles due to accident $ 165.00
A second tow of the vehicle arising out of the same accident or impound, even if not on the
same date as a result of the actions of the owner or driver:
2nd Tow (from Tech Bay to storage lot) $ 50.00
2. If no ignition key has been presented to the driver by the owner, driver or officer at the
time of the tow, a key fee will be applied:

A storage charge per calendar day at the storage yard at the rate of $30.00 per day,
outside storage, for every calendar day. This charge will also be made for Sundays and
national holidays even if the yard is not open.

4. Administrative fee:
a. $ 50.00 if the vehicle is unclaimed for less than fourteen (14) days after impound.
b. $120.00 if the vehicle is unclaimed on the fifteenth (15) day or more after impound.
5. If the owner requests that the vehicle be picked up at a time outside of its posted
business hours, legal holidays excepted, a special pickup fee of $ 75.00 will apply.
6. The office shall have authority to authorize in writing additional charges when
warranted in exceptional circumstances.
7. The vehicle owner and Tow Company are free to negotiate charges for additional
services requested by the owner.
8. Additional fees will apply as follows:

1.0 Services and Licensing
ASAP Towing is licensed by the City of South Bend, to operate the business of vehicle removal and
storage — License #VHR2024-03 see attachment 28
ASAP carries all required city and state documentations, certifications and licensures required:

In accordance with the request for proposal, ASAP agrees to the following:
a. The company agrees not to move or attach any vehicle until instructed to do so by the
investigating officer. All company employees will complete training on policies and
procedures outlined with the recovery, removal, towing, and storage procedures for the
City.
b. All company employees will cooperate with the investigating officer and comply with
requests made in conjunction with the removal of unsafe and/or illegally parked vehicles
from the street, and in storing or impounding such vehicles.
c. The company agrees to provide clean-up and removal of all debris from collision calls,
including the removal of hazardous materials and vehicle fluids. (See equipment list for
materials used)
d. The company will follow vehicle release protocols outlined in the RFP and stated by the City
of South Bend Police Department.
Employees will comply with the investigating officer by signing and gathering proper
signatures, on scene, for stored vehicle report.
No vehicles will be disposed of, relinquished, or released without proof of ownership,
customer identification, and South Bend City stored automobile release form.

As outlined in subset d — no vehicle will be released, or items relinquished without proof of
identity, South Bend City stored automobile release form, and payment for services
rendered. ASAP Towing will bill vehicle owners for services provided — No services will be
billed to any city entity.
ASAP Towing agrees to notify the City within five (5) business days, in writing, of any owner
complaints of missing items or negligent damage to a vehicle authorized by the City to tow.
The company will abide by South Bend City Municipal Code — Chapter 20, Sec. 20-13 (C) and
Sec. 20-15 (C) which outlines the release of responsibility for The City, its agents, servants or
employees shall not be responsible or liable in any manner for the damage incurred in the
towing, storage, possession or disposition of such vehicle.
g. The company agrees to submit a criminal history and set of fingerprints for each employee
within five (5) business days of award of this contract and any new employee engaged
during the term of the contract.

* LCG Bed - Low Center of Gravity bed is 6" lower than industry standard rollback beds which allows us
to haul taller loads while staying within legal height as well as keeping the weight closer to the ground
for safer transport. This low -profile bed also gives us an <11 degree loading angle which allows us to
load vehicles with extreme low ground clearance without damaging the bumper, valance, and exhaust.
** Right Approach and Extreme Angle Bed - This bed is ultra specialized for the loading of vehicles
with extremely low ground clearance and exotic vehicles. The release handle allows the rear hinged
deck section to be lowered to a 6' load angle. A cable guide is inserted in the deck to keep the cable
low while winching the vehicle onto the rear deck. After the vehicle's front wheels are on the carrier,
the deck can be leveled out and the cable guide removed allowing the vehicle to overcome the second
clearance problem with the forward section of the deck. With the front wheels on the front section of
the deck the process can be repeated to eliminate clearance problems such as extreme low front and
rear bumpers as well as low exhausts or extended rear overhang.
Vehicle Equipment — the following is included in each company vehicle — list includes but is not
limited to:
■ A minimum of four LED flashing emergency lighting.
■ Debris removal equipment, consisting of: Two oversized containers, a broom,
shovel, fluid absorbent (oil -dry), safety chains, straps, and emergency beacons.
■ Company employees are provided with reflective uniforms, vests/jackets that
meet OSHA/ANSI-3 requirements. All employees are required to wear reflective
clothing when on scene and during the transport of removal vehicles.
■ Forward and rear facing dash cameras.
■ GPS tracking devices for more accurate dispatching and estimated times of arrival.

3.0 Response Times
Per the proposal request, ASAP Towing understands the importance of timely service in emergency
situations.
■ The company agrees to give priority to all city removal requests and has
dedicated, as outlined, in equipment provisions three trucks for city removal
services.
■ The company will respond to all city removal requests within the thirty -minute
time frame outlined in the proposal.
4.0 Clean-up
• ASAP Towing agrees to clean up any debris, spill or hazards from accident scenes and removal
services to ensure the area is safe for continued use of the roadway at the tow site.
• The company adheres to federal guidelines for clean-up and disposal of all hazardous materials.
• All ASAP Towing service trucks include the following equipment to further ensure safety:
o Debris removal equipment, consisting of: Two oversized containers, a broom, shovel, fluid
absorbent (oil -dry), safety chains, straps, and emergency beacons.
5.0 Storage Yard
ASAP Towing owns and operates two commercial properties and leases a third facility. To
better serve our customers two locations are located within city limits, on the local South Bend
City Transpo bus line and two (2) miles from the South Bend Police Department. Our third
location is an overflow lot for vehicles that are not on a police hold and over thirty days old.
This location is also on the local South Bend City Transpo bus line and four and one half (4.5)
miles from the South Bend Police Department.

5.0 Storage Yard (continued)
• 1906 S. Olive Street — houses the main office, indoor storage facilities for 20 vehicles, and
outdoor storage for 200 vehicles.
• 1311 S. Olive Street — houses indoor storage for 555 vehicles and outdoor storage for 4,152.
• 55303 Mayflower Road — houses indoor storage for 20 vehicles and outdoor storage of up to
3,000 vehicles. This location is also an overflow lot for vehicles not on a police hold and any
vehicles beyond thirty (30) days old.
• ASAP Towing provides twenty-four hour indoor and outdoor monitoring and video surveillance
of all three storage facilities.
6.0 Communication
ASAP Towing understands the importance of good communication and agrees to the RFP
communication outline and guidelines. The 911 Service Center will be provided with three (3) phone
numbers as a fail-safe to ensure that ASAP Towing can always be reached. Under the guidelines of the
RFP, the company agrees should three attempts be made to contact ASAP Towing without success, the
city has the right to contact another towing company. To avoid this type of error ASAP works with a
rolling land line, cell phone communications, as well as a back-up answering service in case of
emergencies that could interrupt communications between itself, the city of South Bend Police
Department, customers, and tow vehicle drivers.
• Continuous communication is held between the dispatch office and drivers via a rolling land line
at the base office (1906 S. Olive Street) and communicates with each driver via company cell
phone.
• All equipment has GPS tracking software for more accurate dispatching and eta times.
• To ensure all phone calls are answered, police dispatchers are provided with a separate
unpublished land line phone number, our main land line phone number and a cellular phone
number.
• During the evening hours when the office is not manned, calls are dispatched by the office
answering service. Calls to the unpublished land line phone number are forwarded to the
answering service and calls are then dispatched to the drivers via company cell phones.
• In case of emergency, if main office phones lines or the unpublished land line phones are down,
the company has set up an automatic forward and calls will be answered and dispatched via the
company answering service.

7.0 Hours of Operation and Release of Stored Vehicles
• Per proposal requirements, ASAP hours for payment and release of vehicles include the
following times:
d. 9am — 5pm Monday through Friday
e. 8am —12pm Saturday
f. Sundays, holidays and after-hours pick-up can be made by appointment and an
additional fee of $ 75.00
• Hours of operation, as well as, after hours contact information signs are clearly posted on entry
doors of both locations.
• Procedures for payment and release of impounded vehicles is as follows:
Upon the owner obtaining a release form from the police station and presenting it to ASAP, we will ask
for a valid photo id. (Driver's license, passport, or state issued id) we will compare the paperwork to
the release form and registration and/or title. We will make copies for our files of the release form,
photo id and registration and/or title. The invoice will then be presented for payment and signature of
the owner. Forms of payment for a vehicle requiring a police release will be cash and/or credit/debit
card. No personal checks will be accepted. After payment is received the owner will be provided a
detailed receipt and asked to wait at the gate and an employee will bring the vehicle outside of the
gate for the owner.
8.0 Agreement to Inspection
ASAP Towing as well as all employees of the company agree to and shall be available for inspection
should the City make the request, and subject to random inspections to ensure quality performance.
9.0 Assignment of Work
ASAP Towing as well as all employees of the company agree not to assign its rights, under this contract,
to any other person or entity without prior written notice and consent from the City of South Bend.
The company and all its employees understand that any such assignment could constitute a breach of
contract.

10.0 Record Maintenance
The company shall always maintain separate and accurate records in connection with the removal and
storage services it provides the City and shall make all records available to the City upon request.
Records to be maintained shall include the following:
a. Time, date, location of tow and officer authorizing the tow.
b. Make, model, vehicle license registration, and VIN number of towed vehicles.
c. Itemized billing of basic tow charges, special charges, storage charges, and any special
vehicle repair/care charges, i.e. window wrap, key charge, etc.
d. Signed release form by person claiming the vehicle.
e. If applicable, a complaint form, signed by the vehicle owner reporting any complaints
regarding charges, negligent vehicle damage, lost or stolen items from the vehicle or any
other related problems.
• Customer complaint forms will be posted in the office in a clearly marked space.
• All customer complaints will be mailed to the South Bend Police Department within five
(5) days of the filed complaint.
Asap Towing reserves the right to act under City Municipal Code, Chapter 20, Sec. 20-13
(C) and Sec. 20-15 (C) The City, its agents, servants or employees, shall not be
responsible or liable in any manner for the damage incurred in towing, storage,
possession or disposition of such vehicle.
11.0 Risk
ASAP Towing holds indemnity and liability insurance under the U.S. Truck & Trailer Service, Inc., the
parent company, of ASAP Towing. Liability and property damage insurance covers up to $1,000,000.00
and is held by Trumbull Insurance Company— certificate #877331622, policy #37UENOL2209.
ASAP assumes all risk in the event of damage, theft, fire, or otherwise, of the vehicles or any other
property towed, impounded, or stored by the company, its employees, or agents.
The company shall look solely and exclusively to the owner of the vehicle towed, impounded, or stored
for payment of services rendered and will hold no claims against the City of South Bend for costs or
nonpayment.

12.0 Indemnity
ASAP shall indemnify and hold harmless, the City, its officers, employees, including any agency
department, or commission of the City for any and all suits or actions brought against the City on
account of any loss, injury or damage sustained or claimed to have been sustained by anyone in
connection with or arising out of the performance of this contract by ASAP Towing or any of its agents,
employees, or independent contractors.
13.0 Insurance and Liability Coverage
ASAP Towing holds indemnity and liability insurance under the U.S. Truck & Trailer Service, Inc.,
the parent company, of ASAP Towing. Liability insurance covers up to $1,000.000.00 and is held
by Trumbull Insurance Company — certificate #877331622, policy #37UENOL2209.

14.0 Maintenance of Vehicles
ASAP Towing agrees to handle all removals authorized by the city with the upmost respect. All
personal property and components within the vehicle shall be kept intact. Vehicles will be returned to
the owners in substantially the same conditions as they existed before being towed.
15.0 Terms and Termination
ASAP Towing agrees to the term and termination outlines. The company agrees to work with the City
of South Bend Police Department for the period of three (3) years and that one (1) year term
thereafter, upon the mutual written agreement of the City and company.
ASAP understands and will abide by the RFP outlines for the termination of the contract, on the part of
the company, to address the City in writing and provide notice of one hundred twenty (120) days so
provisions may be made on the part of the City to replace ASAP Towing.

17.0 Invalid Tow or Special Circumstances
• ASAP Towing agrees in the case of an invalid tow, similar instance, or special circumstance
where the City elects to pay for the towing and storage of a vehicle, the Towing Companies will
bill the City and not require prepayment by the vehicle owner before releasing the vehicle.
ASAP Towing accepts that the maximum chargeable fee will be the current contracted initial
tow fee and 5 days of storage.

The undersigned Contractor, being duly sworn upon his/her/its oath, affirms under the penalties of perjury that:
1. Contractor has not, nor has any other member, representative, or agent of the firm,
company, corporation or partnership represented by him, entered into any combination, collusion
or agreement with any person relative to the price to be bid by anyone at such letting nor to
prevent any person from bidding nor to induce anyone to refrain from bidding, and that this bid
is made without reference to any other bid and without any agreement, understanding or
combination with any other person in reference to such bidding. Contractor further says that no
person or persons, firms, or corporation has, have or will receive directly or indirectly, any
rebate, fee, gift, commission or thing of value on account of such sale; and
2. Contractor certifies by submission of this proposal that neither contractor nor any of its
principals are presently debarred, suspended, proposed for debarment, declared ineligible, or
voluntarily excluded from participation in this transaction by any Federal department or agency;
and
3. Contractor has not, nor has any successor to, nor an affiliate of, Contractor, engaged in
investment activities in Iran.
a. For purposes of this Certification, "Iran" means the government of Iran and any agency or
instrumentality of Iran, or as otherwise defined at Ind. Code § 5-22-16.5-5, as amended from
time -to -time.
b. As provided by Ind. Code § 5-22-16.5-8, as amended from time -to -time, a Contractor is
engaged in investment activities in Iran if either:
i. Contractor, its successor or its affiliate, provides goods or services of twenty million
dollars ($20,000,000) or more in value in the energy sector of Iran; or
ii. Contractor, its successor or its affiliate, is a financial institution that extends twenty
million dollars ($20,000,000) or more in credit to another person for forty-five (45)
days or more, if that person will (i) use the credit to provides goods and services in

the energy sector in Iran; and (ii) at the time the financial institution extends credit, is
a person identified on list published by the Indiana Department of Administration.
4. Contractor does not knowingly employ or contract with an unauthorized alien, nor retain
any employee or contract with a person that the Contractor subsequently learns is an
unauthorized alien. Contractor agrees that he/she/it shall enroll in and verify the work eligibility
status of all of Contractor's newly hired employees through the E-Verify Program as defined by
I.C. 22-5-1.7-3. Contractor's documentation of enrollment and participation in the E-Verify
Program is included and attached as part of this bid/quote; and
5. Contractor shall require his/her/its subcontractors performing work under this public
contract to certify that the subcontractors do not knowingly employ or contract with an
unauthorized alien, nor retain any employee or contract with a person that the subcontractor
subsequently learns is an unauthorized alien, and that the subcontractor has enrolled in and is
participating in the E-Verify Program. The Contractor agrees to maintain this certification
throughout the term of the contract with the City of South Bend, and understands that the City
may terminate the contract for default if the Contractor fails to cure a breach of this provision no
later than thirty (30) days after being notified by the City.
6. Persons, partnerships, corporations, associations, or joint venturers awarded a contract by
the City of South Bend through its agencies, boards, or commissions shall not discriminate
against any employee or applicant for employment in the performance of a City contract with
respect to hire, tenure, terms, conditions, or privileges of employment, or any matter directly or
indirectly related to employment because of race, sex, religion, color, national origin, ancestry,
age, gender expression, gender identity, sexual orientation or disability that does not affect that
person's ability to perform the work.
In awarding contracts for the purchase of work, labor, services, supplies, equipment, materials,
or any combination of the foregoing including, but not limited to, public works contracts
awarded under public bidding laws or other contracts in which public bids are not required by
law, the City, its agencies, boards, or commissions may consider the Contractor's good faith
efforts to obtain participation by those Contractors certified by the State of Indiana as a Minority
Business ("MBE") or as a Women's Business Enterprise ("WBE") as a factor in determining
the lowest, responsible, responsive bidder.
In no event shall persons or entities seeking the award of a City contract be required to award a
subcontract to an MBE/WBE; however, it may not unlawfully discriminate against said
WBE/MBE. A finding of a discriminatory practice by the City's MBE/WBE Utilization Board
shall prohibit that person or entity from being awarded a City contract for a period of one (1)
year from the date of such determination, and such determination may also be grounds for
terminating the contact for which the discriminatory practice or noncompliance pertains.
7. The undersigned contractor agrees that the following nondiscrimination commitment
shall be made a part of any contract which it may henceforth enter into with the City of South
Bend, Indiana or any of its agencies, boards or commissions.

Contractor agrees not to discriminate against or intimidate any employee or applicant for
employment in the performance of this contract with privileges of employment, or any matter
directly or indirectly related to employment, because of race, religion, color, sex, gender
expression, gender identity, sexual orientation, handicap, national origin or ancestry. Breach of
this provision may be regarded as material breach of contract.
I, the undersigned bidder or agent as contractor on a public works project, understand my
statutory obligations to the use of steel products or foundry products made in the United States
(I.C. 5-16-8-1). I hereby certify that I and all subcontractors employed by me for this project will
use steel products or foundry products made in the United States on this project if awarded. I
understand I have an affirmative duty to notify the City in my bid that my proposal does not
include the use of steel products or foundry products made in the United States. I understand it is
my sole obligation and responsibility to provide a justification to the City, subject to review and
approval, why the cost of United States made steel or foundry products is unreasonable. Prior to
award and upon submission of bid which does not use steel products or foundry products made
in the United States, the City, through its director of public works, shall make a determination if
the price of United States made steel or foundry is unreasonable. I understand that violations
hereunder may result in forfeiture of contractual payments.
