of the adjacent Char King Restaurant. Said conveyance is also subject to
the said City's agreement not to permit the construction of any structure
or structures on said parcel which structures would in any manner or de-
gree obstruct the: view of the future Civic Center or the view of the
Jefferson Street dam from the proposed Char KingRestaurant. Said con-
veyance is further subject to the agreement by the said City to maintain
the seawall bordering said parcel in such a manner that no substantial
erosion will occur to either the said parcel herein conveyed or to the
parcel upon which the Char King Restaurant will be located.
These agreements by the City of South Bend are enforceable by either Char'
King, Inc. or Lloyd S. Taylor, or the St. Joseph Bank and Trust Company
of South Bend.
