CHICAGO SOUTH SHORE AND SOUTH BEND RAILROAD, a corporation of the State of
Indiana, whose post office address is Michigan City, Indiana, 46360, hereinafter
called Grantor, and THE CIVIL CITY OF SOUTH BEND, a municipal corporation of the
State of Indiana, whose post office address is 227 West Jefferson Boulevard,
South Bend, Indiana 46601, hereinafter called Grantee, witnesseth:
THAT, for and in consideration of payment of the sum of ONE DOLLAR (1.00),
which is, the full monetary consideration for this conveyance, the receipt whereof
is hereby acknowledged, Grantor does hereby remise, release and forever quitclaim
unto Grantee, Grantee's successors and assigns, all of the right, title, interest,
estate, claim and demand of the Grantor in and to that land situated in the City
of South Bend, County of St. Joseph, State of Indiana, in the NW 1/4 of Section 11,
Township 37 North, Range 2E, more particularly described as follows:

A lot or parcel of ground Thirty-five (35) feet in width north and
south, taken off of and from the entire length of the south side of Lot Number
Eighteen (18) in Sarah J. Stovers' Subdivision of the south part of Bank Out
Lot Number Eighty-one (81), as shown on the Second plat of Out Lots of the Town,
now the City of South Bend, platted by the State Bank of Indiana, in St. Joseph
County, Indiana. BEING described in deed in St. Joseph County Land Records in
Deed Book 139, Page 49.

of Bank Out Lot 81, which lies north and east of a line drawn as follows:
Beginning on a point on the north lime of said Lot Seventeen, which point is
seventeen (17) feet west of the northeast corner of said Lot Seventeen; thence
continuing on said line to a point on the east line of said Lot Seventeen
which point is ten (10) feet south of the said northeast corner.
Also, a part of Lot Number One (1) in Arnold & Pagin's Subdivision
of Bank Outlots 80 and 81; being more particularly described as follows: A
triangular place of land off of and from the northeast corner of said Lot One,
which triangular piece lies north and east of a straight line drawn from a
point on the north line of said Lot One; which point is twenty-two (22) feet
five (5) inches distant west of the northeast corner of said lot and drawn to
a point on the east line of said Lot One, which point is twelve (12) feet
seven (7) inches distant south of northeast corner, in St. Joseph County,

described in a Deed recorded in Deed Record 118 at page 323 in the Recorder's
Office of St. Joseph County, Indiana, which lies south and west of a line
drawn from a point on the west line of said lands, which point is twenty-four
(24) feet two (2) inches north and distant from the southwest corner of said
lands, drawing a straight line from said point southeast to a point on the

So much of said Lot 26 in Arnold and Pagin's Subdivision of Bank
Out Lot 80 and 81, which lies south and west of a line drawn from a point on
the west line of said lot, which point is 13 feet 2 inches distant north of the
southwest corner of said lot drawn to a point which is 23 feet distant east of
the southwest corner of the south line of said lot. BEING described in deed
in St, Joseph County Land Records in Deed Book 150, Page 221.

Street at a point 496.89 feet north of the north line of Washington Avenue,
thence north twenty-four and two -tenths (24.2) feet along the east line of
said alley, thence 'northwesterly to a point on the west line of lsL alley
west of Studebaker Street sixty-seven & 8/10 (67.8) feet north of southeast -
corner of Lot 17 Stover's Sub., thence south twenty-four and two -tenths (24.2)
feet along west line of said alley, thence south easterly to the place of
beginning. BEING described in deed in St. Joseph County Land Records in
Deed Book 31, Page 48, Vacation Resolution No. 1767.

of Drawing dated June 17, 1974, on file in, the records of the City Board of
Public Works for the Orange - Colfax Street connection.
TO HAVE AND TO HOLD the said described lots and parcels to said
Civil City of South Bend, its successors and assigns, in fee; SUBJECT, however,
to any facilities located on, over, under or across the lands described above,
and all agreements, easements and rights granted or reserved therefor,
whether the instruments granting or reserving the same be recorded or unrecorded.
AND the said Grantor hereby covenants that it will execute such
other and further assurances of the same as may be required.
In witness whereof, the Chicago South Shore and South Bend Railroad,
Grantor, and the Civil City of South Bend, pursuant to due corporate authority,
have caused their names to be signed hereto by their officers hereunto duly
authorized and their corporate seals, duly attested, to be hereunto affixed;
