Release and Quit -Claim to THE CITY OF SOUTH BEND, a municipal
corporation
Of St. Joseph County in the State of Indiana
for and in consideration of a gift and grant
the receipt whereof is hereby acknowledged, the following Real Estate in St. Joseph County
in the State of Indiana, to wit:
Lot Numbered One Hundred Fifty-eight (158) as shown
on the recorded Plat of Myer's & Funk's Third Plat
of Chippewa Heights Addition to the City of South Bend,
Indiana.
Subject to all taxes, restrictions and easements of record,
if any exist, applicable zoning ordinances and to the ease-
ment granted to the City of South Bend for street purposes
over a portion of said realty.
Said grant is made to the City of South Bend for the pur-
poses of completing its drainage of the particular area
and the completion of sewers, drains and other facilities
on said real estate to be placed there by the City of
South Bend in order that the surrounding area may be
relieved of flooding and water conditions, and the said
Grantor shall not be assessed by the City of South Bend
for such drainage, sewers or other improvements made on
said real estate for the purposes of draining, estab-
lishing sewers, water or other utilities through said
real estate.
