PURCHASE AGREEMENT
THIS AGREEMENT, entered into this _/LU_ day of 4&9 , 1
1988, by and between Neighborhood Housing Services, Inc., ah
Indiana not -for -profit corporation, hereinafter referred to as the
"Buyer", and the Civil City of South Bend, a municipal corporation
of the State of Indiana, hereinafter referred to as the "City".
WITNESSETH:
WHEREAS, the Board of Public Works is empowered to dispose
of city property;
WHEREAS, the Board of Public Works has received an offer
to purchase the property described herein from the Buyer, and also
received verification that the Buyer is an Indiana not -for -profit
corporation organized for educational, literary, scientific,
religious, or charitable purposes that is exempt from federal
income taxation under Section 501 of the Internal Revenue Code;
WHEREAS, I.C. 36-1-11-1(b)(7) establishes that procedures
for the disposal of real property owned by the City of South Bend
do not apply to the sale or lease of property by a unit to an
Indiana not -for -profit corporation organized for educational,
literary, scientific, religious, or charitable purposes that is
exempt from federal income taxation under Section 501 of the
Internal Revenue Code;
WHEREAS, pursuant to I.C. 36-1-11-1(b)(7), the Board of
Public works is empowered to sell said real property to such a
Buyer who submits an offer for said real property; and
WHEREAS, the offer of the Buyer in the amount of One
Dollar and 00/100 ($1.00), was accepted by the City for said
property.
NOW, THEREFORE, it is agreed by and between the parties
hereto, and for and in consideration of the premises and the mutual
covenants herein contained, as follows;
1. The City agrees to sell and Buyer agrees to buy:
Lots Numbered (1) one, (2) two, (11) eleven, North (1/2)
one-half of (13) thirteen; (14) fourteen, (15) fifteen,
(16) sixteen, (17) seventeen, (18) eighteen, (19)
nineteen, (20) twenty; and the entire "VACATED ALLEY"
north of the abutting above said lots 16-17-18 and 19; all
as shown on the recorded plat of Hull's subdivision of
Large Lot or Block Numbered 11 (eleven) in Samuel L.

4. At the time of closing and after a submission of a
receipt for the total purchase price has been submitted by the
Controller to the Board of Public Works, the Board shall cause a
Quit -Claim Deed to be prepared, which deed shall be signed by the
