Dear Mr. Adamo:
The Board of Public Works, at its meeting held December 18, 1995, approved your request
to purchase the vacant lots on Kenmore Street.
Enclosed are three (3) copies of a Purchase Agreement for the vacant lots on Kenmore
Street. I would appreciate your signing all three (3) copies of the Agreement and returning them
to this office at your earliest convenience, Also, please sign the enclosed Disclosure of Sales
Information form where indicated and return this form with the Agreements A completely executed
COPY Of the Purchase Agreement will be forwarded to you after approval by the Board of Public
Works.
At this tune, please submit a check in the amount of $_25 Q_Q made payable to the City of
South Bend. For your information, this amount consists of the $1.00 which you offered for the
properties, plus $19.00 to record the Quit -Claim Deed with the St. Joseph County Recorder's
Office plus a $5.00 fee for the St. Joseph County Auditor to file the Disclosure of Sales Information
Form, I will forward to you the Quit -Claim Deed after it is recorded with the Recorder's Office.

PURCHASE AGREEMENT
THIS AGREEMENT, entered into this ti�Rll a— of ,
199_L, by and between Anthony, Adamo, ;hereinafter refe`' re� the
"Buyer,° and the Civil City of South Bend,; a municipal corporation
of the State of Indiana, hereinafter referred to as"the "City."
WITNESSETH:
WHEREAS, I.C. 36-1-11 establishes the procedures for the sale
and rental of real properties owned by the City of South Bend; and
WHEREAS, the Board of Public Works (hereinafter referred to as
the "Board") is empowered to carry out the provisions of said
statute; :and
WHEREAS, the Board has determined that:
1. The highest and best use of certain real properties owned
by the City is by sale to an abutting landowner,;
2. The cost to the public of maintaining said real
properties owned by the City equals or exceeds the established fair
market value of said real properties
3. It is economically unjustifiable to sell real properties
owned by the City in accordance with the procedures set forth in
I.C. 36-1-11-4.
WHEREAS, the Board has determined that the assessed value of
said real properties is less than TWO THOUSAND DOLLARS ($2,000.00); f
and
WHEREAS, the Board appointed a licensed independent appraiser �
who appraised the particular real properties; and L
WHEREAS, based upon the appraisal submitted, the Board has
established an offering price for the said properties, and
published notice of its intention to sell said properties at said
price; and
WHEREAS, pursuant to I.C. 36-1-11-5, the 'Board is empowered to
negotiate and sell said real properties to the abutting landowner
who submits the highest offer for said real properties; and

WHEREAS, the offer of the Buyer in the amount of One Dollar
($1.00) was offered and accepted as the best offer for said
Properties.
NOW, THEREFORE, it is agreed by and between the parties
hereto, and for and in consideration of the promises and the mutual,
covenants herein contained, as follows:
1. The City agrees to sell and Buyer agrees to buy the
following properties located in St. Joseph County, Indiana:

for the sum of $1.00.

2. Buyer agrees to pay the Purchase price and recording fee
in full at the time Of closing.
3. Buyer agrees to pay all title and abstract costs involved
in said transaction which it shall desire or request.
4. The conveyance of the aforementioned real properties are
made so long as the lots are not used as a building site for
purposes of a new, single-family construction site.
5. At the time to closing and after a submission of a
receipt for the total purchase Price has been submitted by the
Controller to the Board of Public Works, the Board shall cause a
Quit -Claim deed to be prepared, which deed shall be signed by the
Mayor and attested to by the City Clerk with the Seal of the City
affixed, which shall then be recorded with the St. Joseph County
Recorder's office.

RESOLUTION-- NO. 1 - 1996
WHEREAS, the Board of Public Works of the City of South Bend, Indiana, has compiled
a current detailed inventory of all real property owned by the City of South Bend; and
WHEREAS, the Board of Public Works has reviewed said inventory of real property and it
finds that a certain parcel of real estate now owned by the City of South Bend is not necessary to the
public use and is not set aside by State and City laws for public purposes; and
WHEREAS, the Board of Public Works finds that the property described below has an
assessed valuation of less than $2,000.00, that the cost of maintaining said parcel equals or exceeds
the estimated fair market value of the parcel, and that the highest and best use of the parcel is sale
to an abutting landowner.
WHEREAS, the Board of Public Works now wishes to take the necessary action to make it
possible for the Board, in the future, to sell said parcel of real estate pursuant to State statutes.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works ofthe City of South
Bend, Indiana:
1. That the parcel of real estate owned by the City contained in the following list is
not necessary to the public use, is not set aside by State or City laws for public
purposes, that the cost of maintaining said parcel equals or exceeds the estimated fair
market value of said parcel and the highest and best use of said parcel is sale to an

This is to advise you that the Board of Public Works, at its meeting held December 18, 1995,
accepted your bid of $ 1. 00 for the purchase of the above referred to City -owned properties.
The City Attorney's office will prepare the appropriate Purchase Agreement for this property
and I will forward the Agreement to you for your signature as soon as I receive it. After the Board
approves and signs the Purchase Agreement, I will send you a completely executed copy for your
files.
You may then submit a check to the Board, made payable to the City of South Bend, in the
amount of $15.00 which is $1.00 for the property plus $14.00 to cover the fees required of the
Auditor's Office and the Recorder's Office for the recording of the Quit Claim Deed for this
property.
