THE UNIVERSITY OF NOTRE DAME DU LAC., an Indiana corpo-
ration, does hereby grant, bargain, sell and convey to the
CIVIL CITY OF SOUTH BEND, real estate located in St. Joseph

agrees:
1. That it will remove, at its expense, the existing
fence of Grantor on the land herein conveyed and will install,
at its expense, a new !fence along the South line of Grantor's
golf course that adjoins the land herein conveyed, which fence
shall be of equal quality and height to, the existing fence that
is being removed.

2. That it will plant and place, at its expense,
twelve (12) trees (maple, oak or ash) with a diameter of
not less than six inches (611) measured one foot above the
ground, or fifteen (15) trees (maple, oak or ash) with a
diameter of not less than four inches (4"') measured one foot
above the ground, on the property of the Grantor at such loca-
tions as Grantor may designate, which trees are to be planted
in the Spring of 1974, weather permitting, but in no event
later than the Fall of 1974.
3. That it will perform the following work at its
expense:
(a) Replace the existing drainage structure;
denoted as Structure "A" on plan sheet A-1 of the
plans.
(b) Replace the existing 6" drainage pipe which
connects Structure "A" with the existing structure
located at Sta. 15+95, LT 59.5; shown on Sheet 5 on
the plans.
(c) Construct drainage swales to the lines and
grades shown on Page A-1 of the plans (the plans
referred to are for Project R&S-52, Angela and
michigan) .
IN WITNESS WHEREOF, the Grantor has executed this
instrument by its Executive Vice President and its seal
