$41,500; with a total cost of $230,000: eligible for 80% reimbursement from INDOT with a
20% local match of $8,300.

Dear Ms. Stanton:
The Troyer Group (TTG) hereby presents amendment #1 to the City of South Bend for the Safe Routes to School
project near the Muessel Primary and Holy Cross Schools neighborhood.
We understand that this project is replacement of sidewalks and handicap accessible ramps within the
neighborhood. The primary focus being on the primary routes to and from the schools. The sidewalks that will be
replaced will be with 5-foot-wide sidewalks from back of existing sidewalks towards the existing curb line.
Additional crosswalk striping and signage may be included.
The current sidewalks and ADA ramps are not in compliance with current standards.
The project is needed to provide a safe route for students walking to and from Muessel Primary and Holy Cross
Schools.
The preliminary cost estimate of $1,625,000 for Construction has been reduced to $1,315,938 per Macog’s direction.
The project’s letting has been moved into FY-2025.

The project scope has been set at the Preliminary Field Check. The additional scoped areas include additional curb
ramps, sidewalks, curb and gutters and, storm water structures. The Project Development Process and Review
Submittals will be prepared in accordance with IDM 14-2.03 Road Plans, Partial 3R Project.
Field Survey:
Additional topographic survey will be performed in the additional areas as discussed during the Preliminary
Field Check.
Environmental Document:
Section 106 Documentation pursuant to Minor Projects Programmatic Agreement (MPPA) Section 1. The
project will remain a CE-1, if project elements affect the level, they will be removed from the project unless
authorized by the city of South Bend.
Construction Storm Water General Permit:
It is anticipated that ~1.86 acres of disturbance are needed for the reconstruction of the sidewalks and curb
ramps. Due to the disturbance exceeding one acre a Construction Storm Water General Permit will be
required.
We understand that the project will be a partial 3R project in accordance with IDM 40 and will follow the
Resurfacing, Non-Freeway Project Development Process. Based on our experience with projects of similar size and
scope and our discussions with your office the following milestones will be included in the scope of work.

The attached man-hour justification (Exhibit A) provides more definition for the amended scope of services as a
result of the Preliminary Field Check. Work, including by not limited to, improvements to facilities outside the
scope of design services as defined by the projects Engineering Assessment, environmental documentation beyond
the assumed level, etc. is considered supplemental and will be performed on the negotiated hourly rates as
referenced in the Billing Rate Table in Exhibit A.
Additional services maybe requested for additional Stage 3, Final Tracings, Bid Phase and Office of Construction
Administration Services if these phases exceed the agreed to services via time and material versus lump sum fees.
These fees shall be requested in advance of the corresponding services exceeding the lump sum amounts with the
provided justification herein.

Supplemental Survey Request #1
Project Description
Provide additional topographic survey as requested by the design engineer at various locations
throughout the project area. The limits of the additional topographic survey are shown on the attached
Exhibit 1.
Scope of Work
SJCA will furnish a plat or map of survey in accordance with the following:
Research including the last deed of record for adjoining owners, old road plans, right-of-way grants, section
corner information, tax cards, subdivision plats, auditor’s maps, benchmark information, regulated drain
information, utility maps, recorded surveys, etc.
Locate all centerline monuments, section corners or property corners as-needed to determine the centerline
alignment and existing right-of-way.
Use GPS and conventional radial survey methods to locate all section corners, property and centerline
monumentation. Horizontal datum shall be the Indiana Geospatial Coordinate System for the subject
project’s County from GPS observations using INDOT’s Continuously Operating Reference System (InCORS).
Run a level circuit to establish project vertical data. Vertical datum shall be NAVD88 from GPS observations
using INDOT’s Continuously Operating Reference System (InCORS). Project benchmarks shall be set at ¼ mile
intervals (minimum of 3) with descriptions and elevations shown in the field book.
Topographic Route survey from the back of curb to the right of way line for the areas shown in red and yellow
in the attached Exhibit 1, which exhibit was provided by Troyer Group via email on 5/12/23. Additionally full
topo survey of the intersection of Vasser Ave. and Wilbur St. for a distance of 50 feet beyond the apparent
existing right of way along each intersecting street.
Submittal of a design ticket through Indiana811 to obtain name, address and contact information for each
utility company with facilities within the survey limits.
Download the data and complete CAD drawings of planimetric features as well as topographic features
including the creation of a digital terrain model and contours.
Determination of right-of-way lines and adjacent boundaries based on deeds, monuments, plats, surveys and
best field evidence available.
Set and reference control points for use by the contractor during the construction phase of the project.
Preparation of a survey field book per current INDOT standards including a sketch of an elevation view of the
bridge.
Delivery of all files as currently required by the Indiana Design Manual. CAD files shall be delivered in
MicroStation .dgn format.

Project Schedule
SJCA will conduct its services in an expeditious manner subject to limitations such as weather, information
acquisition, communications, and other factors outside of SJCA’s control. Both parties recognize that the
schedule of services is subject to factors that may be unknown at the time of notice to proceed. If modifications,
changes, or adjustments to the schedule become necessary, such modifications shall be agreed upon by both
parties.
Fee Justification
A fee justification has been developed based on the scope of services outlined above. We propose a fee
increase of $15,500 (Lump Sum) for the scope of services as expressly described herein. This will increase the
topographic survey phase of the project from $39,700 to $55,300.

SCOPE OF SERVICES

The City of South Bend proposes to proceed with the Muessel Elementary School-Holy Cross Safe Routes
to School (SRTS) Project (Des. No. 1900477). Troyer Group will enter into a subconsultant agreement
with SJCA Inc., who will complete the National Environmental Policy Act (NEPA) documentation,
Archaeology, and documentation in compliance with Section 106 of the National Historic Preservation
Act (NHPA), and all related federal, state, and local laws in accordance with the most current INDOT
regulations.

Project Location:
The proposed undertaking is located along various streets in the neighborhood surrounding Muessell
Elementary School, generally bounded by Wilber Street, Vassar Ave, Sherman Ave, and Lincoln Way. The
project will improve sidewalks, curbs, crosswalks, and ramps.

form.
Project Description:
Based on information received by the client, the purpose of the project is to improve the pedestrian
network surrounding Muessel Elementary School. Work involves sidewalk reconstruction, updating curb
ramps to ADA compliance, and installing a curb bump out at the intersection of Vassar Ave. and Wilber
St. Right-of-way acquisition over 0.5 acre and tree removal are not anticipated.
SJCA has a previous contract with Troyer Group that covers the Topographic Survey and MPPA Section 2
form. Therefore, these fees will only include a MPPA Section 1 form since the MPPA Section 2 form is
previously covered under contract.
Scope of Work/Concerns:
Because this project may require completion of the full Section 106 process, this scope of
services includes a CE document up to a Level 2 with a Section 106 finding of “No Adverse
Effect” based on preliminary review of the project areas by SJCA IDNR Qualified Professionals.

Based on preliminary project information, less than 0.5 acre of right-of-way (ROW) is
anticipated; therefore, public involvement activities and environmental justice analyses are not

included in this scope of services. Should public engagement be determined to be in the best
interest of the community, those services would be in addition to this scope of services.
A full Red Flag Investigation (RFI) may be required. There are hazardous materials sites along
Lincoln Way that will require additional investigation for the RFI. Any recommendations
regarding contamination will be forwarded to Troyer Group to incorporate into the design and
project schedule.
Muessel Grove Park and the Coal Line Trail, which are resources protected by Section 4(f) of the
US Department of Transportation Act, are located within/adjacent to the proposed pedestrian
improvements. This scope of services includes coordination with INDOT and the resource
owners for concurrence of temporary occupancy or exception use of the resources. Based on
preliminary project information, trails and/or sidewalks connecting to these resources will be
improved and may require closures and/or detours for users during construction.
Historical/Archaeological
Section 106 consultation, as required by the National Historic Preservation Act (NHPA) of 1966, will
be completed prior to submittal of the CE document for approval. It is anticipated that the project
will follow the procedures as outlined in the INDOT Cultural Resources Office (CRO) Manual.
SJCA will prepare an MPPA Section 1 & 2 form and submit it to INDOT CRO.
Due to the project scope, archaeological studies are not anticipated. Background research will
be completed using Indiana State Historic Architectural and Archaeological Research Database
(SHAARD) and SHAARD GIS records to complete the archaeological assessment for the proposed
project.
Tasks Not Covered under This Proposal:
Any changes in scope or impacts to resources not observed during preliminary desktop review that
would require additional documentation.
Notice of entry mailings.
A CE Level 3 or higher environmental document.
Any endangered/threatened species surveys or special studies, including guano genetic testing, or
agency coordination above the standard early coordination per INDOT guidelines. This includes
Section 7 coordination and/or Biological Opinions.
Additional inspection of structures in the event the initial inspection is over 2 years old.
Any special studies or testing, such as noise, air, or Karst studies.
Any onsite meeting with regulatory agencies.
Public involvement activities, including but not limited to public meetings and public notice
advertisements.
An environmental justice analysis.
A Waters of the US Report.
Any Section 4(f) documentation and coordination above a temporary occupancy or exception use,
including but not limited to a de minimis use finding.
Preparation of any local or waterway permits, a permit determination, or mitigation plans. It is
assumed that all permit-related activities will be completed by others.
Any documentation relating to Full Section 106 review or any other special study requested by

Anticipated Project Schedule:
After the client gives the Notice to Proceed along with the approved project schedule, SJCA Inc. will
complete the scope of work, dependent upon receiving the appropriate project information and
seasonal weather conditions. NEPA and Section 106 work will begin as soon as a solid preliminary scope
and basic project description is developed for the red flag investigation.
Sunset Provision
If this contract is not fully executed within six months of the date that the Scope of Services and Fees
have been submitted to the client, then the fees and scope are subject to change. This may be due to a
change in local, state, or federal guidance which would render the scope and fees outdated and would
require updates.
If, upon consultation with all local, state, and federal agencies regarding the project, additional studies
are requested or the project scope/area changes, then additional fees will be required to meet the
additional scope of services.
The fees for this project will be hourly (time & expense; not to exceed). Totals for the project are listed
in the table below (rounded to the nearest one hundred dollars). The task and hourly breakdown for
each service is attached.
