Convey and warrant to CIVIL CITY OF SOUTH BEND, INDIANA
Of St. Joseph County in the State of Indiana
for and in consideration of One Dollar and other valuable consideration
the receipt whereof is hereby acknowledged, the following Real Estate in St. Joseph County
in the State of Indiana, to wit:
A part of Lot Numbered Three Hundred Seventy -One (371) as shown on the
recorded plat of Vassar Park Addition to the City of South Bend, recorded
in Plat Book 10, page 87, more particularly described as follows:
Beginning at the most easterly corner of lot 371 Vassar Park;
thence North 42 degrees 27 minutes 30 seconds West along the
northeasterly side of said lot 371 a distance of 10.04 feet;
thence South 48 degrees 16 minutes 45 seconds West a distance
of 30.32 feet to point on the arc of a curve on the southeast-
erly side of said lot 371; thence northeasterly to the right
on said arc a distance of 30.04 feet and whose long chord bears
North 66 degrees 33 minutes 50 seconds a distance of 30.04 feet
to place of beginning containing 152 square feet in area.

AFFIDAVIT
J. CLIFFORD POTTS, being first duly sworn upon his oath, alleges and says:
1. That he is presently a practicing attorney in St. Joseph County, Indiana and
has continuously practiced law in said County for forty-three (43) consecutive years
Last past.
2. That he is personally acquainted with Alma Kaiser, presently single and of
adult age and further, that he was acquainted with Gilbert S. Kaiser, who died a resident
of St, Joseph County, Indiana on May 9th, 1949.
3. That he knows of his own personal knowledge that Gilbert S. Kaiser and Alma
Kaiser lived together continuously as husband and wife until the time that Gilbert S.
Kaiser departed this life.
4. That at the time of the death of Gilbert S. Kaiser no estate was opened in that
all of his property was owned jointly with the said Alma Kaiser and that there were no
Federal Estate Taxes and/or Indiana Inheritance Taxes due or owing,
5. Affiant further states that he is making this Affidavit for the purpose of clarifying
title to certain real estate which was owned jointly by Gilbert S. Kaiser and Alma Kaiser;
a portion of said real estate being deeded to the Civil City of South Bend, Indiana pursuant
to a Warranty Deed executed on the 14th day of May, 1969 in St. Joseph County, Indiana.
6. That he knows of his own personal knowledge that Alma Kaiser and Alma L. Kaiser
are one in the same person.
