INDIANA FILE[) ff-O',/� R,SCfCrR,'D ,APR j] 3 *s?M DEDICATION OF UTILITY EASEMENT '8'00'1S PIA01f A-tv KNOW ALL MEN BY THESE PRESENTS: At& I m, 675 6 1' That the undersigned, South Bend Community School Buil ding lding Corporation, for the sum of One ($1,00) dollar and other con- sideration, including but not limited to the acceptance hereof by the City of South Bend, Indiana, does hereby grant and convey to the City of South Bend, its Water Works Department, assigns, lessees and,contractors, an easement for the purpose of con- structing and maintaining an underground water main, together with the right to repair, replace and renew said water main, reserving, however, the right to the Grantor to construct or permit the construction of other utilities over, along and through said easement so long as the same do not interfere with said water main, and which utility easement shall be through the property of the undersigned of which the undersigned is lawfully seized and which utility easement is more particularly described as follows: A part of the North Half of the Northwest Quarter of Section 31, Township 37 North, Range 3 East St. Joseph County, Indiana, and further described as follows: Commencing at the Northeast corner of the Northwest Quarter of said Section 31, and running Southerly along the East line of said NoTthwest Quarter a distance of 35.00 feet to the Point of Beginning; thence continuing along the East line of said Northwest Quarter a distance of 20.00 feet; thence running Westerly along a line parallel to the North Line of said Northwest quarter a distance of 540.00 feet, said line being 55.00 feet South of the North line of said Quarter Section measured along a line parallel to the East line of said quarter Section; thence Northerly a distance of 20.00 feet along a line which is parallel to and 540.00 feet Westerly from the East line of said quarter Section; thence Easterly along a line parallel to the North line of said Quarter Section to the Point of Beginning, said line being 35.00 feet Southerly from the North line of said Quarter Section measured parallel to the East line of said Quarter Section being approximately 6 inches South of the most Southerly Fly edge of an existing sidewalk. This parcel of land is intended to provide a 20-foot wide Water Utility Easement; said Easement is subject to the legal rights of public highways and to a prior 15-foot wide Easement for Water Works purposes immediately West of the East line of said Quarter Section. In Witness Whereof, the undersigned has caused this dedica to be signed by its duly authorized officers, this24thday of March 1 1966.
