THIS INDENTURE WITNESS THAT: BERNATH & FERGUS, INC., an Indiana corporation,
(hereinafter called "Grantor"), in consideration of One Dollar ($1.00) and other
good and valuable consideration, the receipt of which consideration is hereby
acknowledged, hereby conveys and warrants to THE CITY OF SOUTH BEND, N
(hereinafter called ""Grantee"), the following described Deal Estate Jc��eph.I
County in the State of Indiana, to wit:
Lot Numbered Six (6) as shown on the recorded Plat
of Mary D. Witherill's Subdivision of a part of
Bank Out Lot Numbered Thirty-two (32) of the First

This conveyance is made subject to all unpaid taxes and all subseque t taxes;
subject to existing highways, easements, rights -of -way, and restrictions of
record, if any.
Mortage in the original amount of $8700.00 from Bernath & Fergus, Inc., an
Indiana corporation, to The National Bank and 'Trust Company of South Bend,
dated March 31, 1964 and recorded April 2, 1964 in Mortgage Record 846, pages
474-476, both inclusive, in the Office of the Recorder of St. Joseph County,
Indiana, which the Grantee assumes and agrees to pay.
The undersigned persons executing this deed on behalf of the Grantor represent
and certify that they are the duly elected officers of Grantor and have been
fully empowered by proper resolution of the Board of Directors of Grantor to
execute and deliver this deed; that Grantor has full corporate capacity to
convey the real estate hereby conveyed and that all necessary action for the
making of such conveyance has been taken and done.
IN WITNESS WREREOF, Grantor has caused this deed to be executed in its name
and on its ;behalf by its duly authorized officers, and the affixing thereto
of its corporate seal.
