HomeMy WebLinkAbout#378- Deed; Rainbow Drive, cul de sacSS E V 7 17111- q KNOW ALL MEN BY THESE PRESENTS: That the undersigned, OXFORD DEVELOPMENT CORP., an Indiana corporation of Indianapolis, Marion County, Indiana, formerly known as Riverside Manor, Inc. , does hereby grant and convey to the public a right-of-way for a public cuff -de -sac, reserving, however, the right to the Grantor or the City of South Bend, Indiana, their assigns, lessees and contractors to grade, level, fill, drain, pave, build, maintain, re- pair, and rebuild said cul-de-sac together with such bridges, culverts, ramps, cuts, sidewalks and curbs, as may be necessary, and to construct, maintain, install, repair, replace and renew the water, sewer, and other utility facilities located therein or thereunder; to install drainage structures for flood control and for sanitary and storm sewers; to use said cul-rde- sac for general street purposes with the right to remove trees, bushes, undergrowth and other obstructions over, along and through the property of the undersigned interfering with said cul-de-sac, over the land of which the undersigned is lawfully seized, which cul-de-sac is shown on the attached sketch marked "EXHIBIT A", and more particularly described as follows: A tract of land located in part of the Southwest Quarter eight (38) North, Range Two (2) East, and in part of the Southeast Quarter (1/4) of Section Twenty-two (22), Town- ship Thirty-eight (38) North, Range Two (2) East, German Township, St. Joseph County, Indiana, lying partly within within the Second Section of Riverside Manor, a recorded subdivision in the City of South Bend, Indiana, more particularly described as follows: 5 imi 4j", DON Beginning at the North extremity of the West line of Rain- bow Drive, as shown on the recorded plat of Riverside Manor, Second Section, to the City of South Bend, Indiana, said point of beginning being also the Northeast comer of Lot Two Hundred Thirty-three (233) in said Riverside Manor, Second Section, thence Northeasterly along a line having a bearing of North Twenty-one Degrees, Fifty Minutes, Forty Seconds (210 501 4011) East, a distance of Nine and Fifty-five Hundredths (9 W 55) feet to a point of intersection with a curve which forms a cul-de-sac, said cul-de-sac having a radius of Forty-two and No Hundredths (42.00) feet and its center located Forty-two and No Hundredths (42.00) feet distant from said point of intersection, measured along a line with a bearing of North Fifty-eight Degrees, Twenty-two Minutes, Twenty-seven Seconds (580 22' 27"') East, thence around the cul-de-sac starting to the left and running to the right, an arc distance of Two Hundred Ten and Thirty-four Hundredths (210.34) feet to a point Fifty and No Hundredths (50.00) feet Southeasterly from the point of beginning of the cul-de-sac, thence Southwesterly along a line with a bearing of South Twenty-one Degrees, Fifty Minutes and Forty Seconds (210 50' 40") West, a distance of Nine and Fifty-five Hundredths (9.55) feet to a point of curve, said point of curve being on the East line of Rainbow Drive at its point of intersection with the North line projected Southeasterly of Lot Two Hundred Thirty-three (233) in Riverside Manor, Second Section, thence Northwesterly along the North line projected of said Lot Two Hundred Thirty-three (233), said line having a bearing of North Sixty-eight Degrees, Nine Minutes, Twenty Seconds (680 09' 20") West, a distance of Fifty and No Hundredths- (50.00) feet to the point of be- ginning, containing Eleven Hundredths (0.11) acres, more or less.
