GRANT OF EASEMENT
THIS INDENTURE WITNESSETH: That W. C. GAMMONS and
ALICE E. GAMMONS, husband and wife, of St. Joseph County, Indiana,
grant, bargain, sell, convey and warrant to the MUNICIPAL CITY OF
SOUTH BEND, INDIANA, for and in consideration of One Dollar ($1. 00)
and other good and valuable consideration, the receipt whereof is hereby
acknowledged, a right of way and easement with the right, privilege and
authority to said Municipal City of South Bend, Indiana, to construct,
operate and maintain a sanitary and storm sewer and water line in, on,
along, under and through the following described real estate in St. Joseph
County, Indiana, to -wit;
Part of the Southwest Quarter (1/4) of the Southwest Quarter
(1/4) of Section Thirty (30), Township Thirty-seven (37) North,
Range Three (3) East, described as beginning at the Southwest
corner of said Section Thirty (30), running thence North Six
Hundred Fifty-three (653) feet, thence East Eight Hundred Eight
and Forty-one Hundredths (808. 41) feet, thence South Six Hundred
Fifty-three (653) feet, thence West,Eight Hundred Eight and Forty-
one Hundredths (808, 41) feet to the place of beginning, containing
Twelve and Twelve Hundredths (12. 12) acres. Subject to legal
highways.
The center line of said easement shall be located as follows:
Beginning at a point Six Hundred Fifty-three (653) feet North and
Three Hundred and Three Tenths (300. 3) feet East of the South-
west corner of Section Thirty (30), Township Thirty-seven (37)
North, Range Three (3) East, thence Southwesterly a distance
of One Hundred Forty-four (144) feet, more or less,to a point
Five Hundred Twenty (520) feet North and Two Hundred Forty-
five (245) feet East of said Southwest corner of said Section
Thirty (30), thence Southeasterly a distance of Five Hundred
Ninety-five and Four Tenths (595. 4) feet, more or less,to a
point on the South line of said 'Section Thirty (30), which is
Five Hundred Thirty-five (535) feet East of said Southwest
corner of said Section Thirty (30), Township Thirty-seven (37)
North, Range Three (3) East.
It is understood and agreed by and between the parties hereto that the
right of way easement shall be Thirty (30) feet wide for a period
of one (1) year from the date hereof for construction purposes.
The grantors hereby limit their grant of said easement along the
center line above described to a width of thirty (30) feet for a
period of one (1) year from the date hereof, and upon completion
of construction said Thirty (30) feet wide area shall be restored
grade by the grantee.

is further understood and agreed by and between the parties

be Fifteen (15) feet wide from and after one (1) year from the
date hereof and that the grantors herein specifically limit their
grant of an easement over the real estate above described along
the center line above described to a width of fifteen (15) feet.
It is further understood and agreed by and between the parties
hereto that it is a part of the consideration hereof and the
grantee accepts the grant herein made upon condition that the
owner or owners of all or any part of the Twelve and Twelve
Hundredths (12. 12) acre tract of land first hereinabove des -
scribed over which the above described right of way easement
is hereby granted shall be permitted to make necessary
connections to use the sewers and water lines to be constructed
and maintained by the grantee paying therefor at the customary
cost at the time of the connection and at the customary rates
for service charged residents of the City of South Bend, Indiana.
IN WITNESS WHEREOF, the said W. C. Gammons and Alice
E. Gammons, have hereunto set their hands and seals this 16th day of
December, 1963.
