GRANT OF EASEMEN
THIS INDENTURE WITNESSETH: That, SO ,III S D - B TIST CH RCH INC.
OF SOUTH BEND, INDIANA, St. Joseph County, Indiana, and HOME MISSION BOARD
Or THE SOUTHERN BAPTIST CONVENTION CORPORATION grant, bargain, sell, convey
and warrant to the MUNICIPAL CITY OF SOUTH BEND, INDIANA, for and in
consideration of one ($1.00) Dollar and other good and valuable consideration,
the receipt whereof is hereby acknowledged, a right of way and easement with
the right, privilege and authority -to said Municipal City of South Bend,
Indiana, -to construct, operate and maintain a sanitary and. storm sewer and
water line in, on, alongunder and through -the following described. real
estate in St. Joseph County, Indiana, to -wit:
Commencing at a point on the South line of Jackson Road,
which point is 2026.93 feet due West and LJO feet South
of the Northeast corner of the Northwest of Section 31,
Township 37 North, 111ange 3 East; thence in a straight
line in a Southerly and Easterly direction to a atake
which is 193q feet due West and. 495 feet due South of
said Northeast corner of the Northwest 34 of said Section
31, of said Township 37 North, Range 3 East; thence in a
due VIcsterly direction to the Miami Street road; thence
along -the Easterly line of 'the Miami Street Road in a
Northerly direction a distance of L155 feet to the Southerly
line of -the Jackson Road, thence in an Easterly direction
along the Southerly line of the Jackson Road to the place
of beginning. (Miami Road has a width of 80 feet and
Jackson Road has a width of 80 feet as now established).
A temporary easement consisting of the East 30 feet of
the tract herainbefore described; the centerline of said
easement commencing at a point on the South line of
Jackson Road, which point is 2041.93 feet due West and
qO feet South of the Northeast corner of the Nortlivest
-14 of Section 31, Tow ship 37 North, Range 3 East; thence
in a straight line in a Southeasterly direction to a
point that is 1949 feet due West and 4951 due South of
said Northeast corner of the Northwest iii of said Section
31.
Temporary easement 30' wide for construction.
Permanent easement 15' wide for maintenance.

It is understood and, agreed by and between the parties
hereto that the right of way easement shall be Thirty
(30) feet wide for a period of Two (2) years from the
date hereof for constructd.on purposes. The,grantors
hereby limit their grant to said easement along the
canter line above described, to a, width of Thirty (30)
feet for a period of Two (2) years from the date hereof,
and up
on oompletion of construct:(on said Thirty (30)
feet wide area shell be restored to grade by the grantee.
It is further understood and. agreed by and between -the
parties hereto that the right of way and easem-1: dba
described shall be Fifteen (15) feet wide from and after
Two (2) years from the date hereof and that -the grantors
herein specifically limit -their grant of easement over
-the real estate above described along the center line
above described to a width of Fifteen (15) feet.
It is further understood and agreed by and between the
parties hereto that it is a part of the consideration
hereof and the grantee accepts the grant herein made upon
condition -that the owner or owners of all or any part of
+ -tract of land first hereinabove described

hereby granted, shall be permitted to make necessary
connections to use the sewers and water lines to be
constructed and maintained by -the grantee paying therefor
at the, customary cost at the time of the connection and at
