DEED OF EASEMENT TO THE CITY OF SOUTH BEND, INDIANA

THIS INDENTURE WITNESSETH, that STUDEBAKER CORPORATION
a Michigan corporation, hereby grants to THE CITY OF SOUTH BEND,
INDIAVA, a Municipal corporation, its successors and assigns,
forever, for and in consideration of the sum of One Dollar ($1.00)
and other good and valuable consideration, receipt whereof is
hereby acknowledged, a right-of-way and easement, with the right,
privilege and authority to said Grantee, its successors and
assigns, lessees and tenants, to construct, erect, install,
operate and maintain in a closed trench or ditch, below ground
level, a line or pipe for the purpose of transmitting storm
water and sanitary sewerage in, through, or under the following
described real estate situated in St. Joseph County, State of
Indiana:
A part of the N.E. 1/4 of Section 14, Twp. 37
N., R. 2 E., more particularly described as
follows:
Beginning at a point 629.88 ft. N. and
645.87 ft. W. of the Southwest corner of Tract
No. 4 of the Studebaker Corporation Replat as
recorded in Plat Book 11, Page 184, in the Office
of the Recorder of St. Joseph County, Indiana,
said corner being also the intersection of the
North line of the Michigan Central Railroad
Right- f-Way and the East line of Kendall
Street. thence N. 890 46' 56" W. along the

line of Cotter Street a distance of 21.96
ft. to a point; thence N. 240 08' 31" W. a
distance of 210.63 ft. to the East line of
Prairie Avenue; thence N. 280 14' 42" East along
said East line of Prairie Avenue a distance of
25.25 ft. to a 3oint; thence S. 240 O�8' 31" E.
a distance of 235.10 ft. to the said North,line
of Cotter Street and the point of beginning;
containing 0.102 Acres. (All bearings assumed).
together with the right to said Grantee, its successors, assigns,
lessees and tenants, to place a South Bend storm and sanitary

sewer main in this easement, and the perpetual right of ingress
�,l and egress to, through and over the above described real estate,
for doing anything necessary, useful or convenient for the
enjoyment of the easement herein granted, and the privilege of
removing, at any time, any or all of said improvements erected
on, over or under said real estate. (This easement is non-
exclusive; no Indiana Gross Income Tax accrues or becomes due
and owing by reason of this Grant).

Before me, the undersigned, a Notary Public, in and
for said County and State, personally appeared B. A. Burlingame
and S. B. Feuer, known to me to be respectively, President and
Secretary of Studebaker Corporation, who stated under oath that
their execution of the foregoing Deed of Easement was done by
virtue of authority vested in them by action of the Board of
Directors of said corporation, and further stated under oath

that no Gross Income Tax is due to the State of Indiana as a
result of this conveyance, and who, on behalf of said' Studebaker
Corporation, acknowledged the execution of the foregoing Deed
of Easement.
IN WITNESS WLMREOF, I have hereunto subscribed my
name and affixed my official seal, this 15th day of April, 1964.
