HomeMy WebLinkAbout#324 - Deed; Corby Street, north of morris park country clubDEDICATION The undersigned hereby dedicate to the City of South Bend, Indiana, for street and utility purposes, the following described real estate in the City of South Bend, St. Joseph County, State of Indiana, to -wit: Parcel 1. Beginning on the North line of the South West Quarter M Of Section Five (5), Township Thirty-seven (37) North, Range Three (3) East, at a point Three Hundred Sixteen (316) feet East of the West line of said Section; thence East to the center of said Section No. Five (5); thence South Twenty-five (25) feet; thence West to a point Twenty-five (25) feet South of the place of beginning; thence North Twenty-five (25) feet to the place of beginning"I" Parcel 2. A strip of land Twenty-five (25) feet in width, North and South, taken off of 71 and from the North end of the following described tract of land, viz: A tract of land containing Thirteen (13) acres taken off of and from the entire length of the West side of the South East Quarter (4-) of 771 Section Five (5), Township Thirty-seven (37) North, Range Three (3) East. This dedication is contingent upon the said City of South Bend paying for the cost of all improvements placed K= M.> 7 C3 A upon said real estate without assessment against the under- signed, and is further contingent upon the said City moving the present fence on said real estate a distance of Twelve I Yl (12) feet to the South. Affiant further certifies that on the I /, Z:K day of July, 1960, the Board of Directors of said Woodland, Inc., at a regularly constituted meeting of said Board at which a quorum was present, unanimously adopted the following res6lution: WHEREAS, the city of South Bend has determined to widen and improve Corby Street along the entire North line of the Morris Park Country Club golf course by condemnation proceedings or otherwise; and WHEREAS, said City has agreed to bear the entire cost of such improvement and has agreed, at its own expense, to move the present fence, along the North line of said golf course, a distance of Twelve (12) feet to the South; provided,however, woodland, Inc. and Morris Park Country Club will join in dedicating to the City of South Bend for street and utility purposes, a strip of land Twenty-five (25) feet in width, North and South, taken off of and from the entire length of the North side of the property now owned by Woodland, Inc. in the South one-half k2) of section Five (5), Township Thirty-seven (37) North, Range: Three (3) East; NOW, THEREFORE, be it resolved, that said strip of land be and hereby is dedicated to the City of South Bend for street and utility purposes, contin- gent upon said City paying for the cost of all improvements placed upon said real estate and upon the said City, at its own expense, moving the pre- sent fence on said real estate a distance of Twelve (12) feet to the South. BE IT FURTHER RESOLVED, that the President and Secretary of this corporation execute all documents, or other instruments necessary and proper to give effect to said dedication.
