SECTION II PLAN AND EQUIPMENT QUESTIONNAIRE 1. Attach an explanation of your plan or layout for performing proposed work. (Examples could include a narrative of when you could begin work, complete the project, number of workers, etc. and any other information which you believe would enable the City of South Bend to consider your bid.) 2. Attach a listing of the names and addresses of all subcontractors (i.e. persons or firms outside your own firm who have performed part of the work) that you have used on public works projects during the past five (5) years along with a brief description of the work done by each subcontractor. 3. If you intend to sublet any portion of the work, attach the name and address of each subcontractor, equipment to be used by the subcontractor, and whether you will require a bond. However, if you are unable to currently provide a listing, please understand a listing must be provided prior to contract approval. Until the completion of the proposed project, you are under a continuing obligation to immediately notify the City of South Bend in the event that you subsequently determine that you will use a subcontractor on the proposed project. 4. Attach a listing of equipment you have available to use for the proposed project. Have you entered into contracts or received offers for all materials which substantiate the prices used in preparing your proposal? If not, attach an explanation for the rationale used which would corroborate the prices listed. SECTION III CONTRACTOR'S FINANCIAL STATEMENT Attachment of bidder's financial statement is mandatory. Any bid submitted without said financial statement as required by statute shall thereby be rendered invalid. The financial statement provided hereunder to the City of South Bend awarding the contract must be specific enough in detail so that said City of South Bend can make a proper determination of the bidder's capability for completing the project if awarded. Persons, firms, partnerships, corporations, associations, or joint venturers awarded a contract by the City of South Bend through its agencies, boards, or commissions shall not discriminate against any employee or applicant for employment in the performance of a City contract with respect to hire, tenure, terms, conditions, or privileges of contract or employment, or any matter directly or indirectly related to contracting or employment because of race, sex, religion, color, national origin, ancestry, gender expression, gender identity, sexual orientation, or due to age or disability that does not affect that person's ability to perform the work. In awarding contracts for the purchase of work, labor, services, supplies, equipment, materials, or any combination of the foregoing including, but not limited to, public works contracts awarded under public bidding laws or other contracts in which public bids are not required by law, the City, its agencies, boards, or commissions will consider the Contractor's good faith efforts to obtain participation by those subcontractors certified by the State of Indiana as a Minority Business ("MBE") or as a Women's Business Enterprise ("WBE") as a factor in determining the lowest, responsible, responsive bidder. Contractors seeking the award of a City contract cannot be required to award a subcontract to an MWBE; however, they may not unlawfully discriminate against said MBE/WBE. On goal -eligible contracts, Contractors are required to either meet both MBE and WBE utilization goals or demonstrate that the Contractor has made good faith efforts to obtain participation from MBE and WBE subcontractors. A finding of noncompliance or a discriminatory practice shall prohibit that Contractor from being awarded a City contract for a period of one (1) year from the date of such determination, and such determination may also be grounds for terminating the contact to which the discriminatory practice or noncompliance pertains. 7. The policies recognize the problems created by drug and alcohol abuse and the need to develop prevention and treatment programs. Alpine Demolition and the signatory unions have a commitment to protect people and property, and to provide a safe working environment. the purpose of the following program is to establish and maintain a drug free, alcohol free, safe, healthy work environment for all of its employees. Definitions A. Company Premises - The term "Company Premises" as used in this policy includes all property, facilities, land, buildings, structures, automobiles, trucks and other vehicles owned, leased or used by the company. Construction job sites for which the company has responsibility are included. B. Prohibited Items & Substances - Prohibited substances include illegal drugs (including controlled substances, look alike drugs and designer drugs), alcoholic beverages, and drug paraphernalia in the possession of, or being used by, an employee on the job. C. Employee - Individuals, who perform work for (Company name), including, but not limited to, management, supervision, engineering, craft workers and clerical personnel. D. Accident - Any event resulting in injury to a person or property to which an employee or contractor/contractor's employee, contributed as direct or indirect cause. E. Incident - An event which has all the attributes of an accident, except that no harm was caused to person or property. F. Reasonable Cause - Reasonable cause shall be defined as tardiness, excessive absenteeism, and erratic behavior such as noticeable imbalance, incoherence, and disorientation. Confidentiality A. All parties to this policy and program have only the interests of employees in mind, therefore, encourage any employee with a substance abuse problem to come forward and voluntarily accept our assistance in dealing with the illness. An employee assistance program will provide guidance and direction for you during your recovery period. If you volunteer for help, the company will make every reasonable effort to return you to work upon your recovery. The company will also take action to assure that your illness is handled in a confidential manner. B. All actions taken under this policy and program will be confidential and disclosed only to those with a "need to know". C. When a test is required, the specimen will be identified by a code number, and not by name, to insure confidentiality of the donor. Each specimen container will be properly labeled and made tamper -proof. The donor must witness this procedure. D. Unless an initial positive result is confirmed as positive, it shall be deemed negative and reported by the laboratory as such. E. The handling and transportation of each specimen will be properly documented through the strict chain of custody procedures. Rules — Disciplinary Actions — Grievance Procedures A. Rules — all employees must report to work in a physical condition that will enable them to perform their jobs in a safe and efficient manner. Employees shall not: 1- Use, possess, dispense or receive substances on or at the job site; or 2- Report to work with any measurable amount of prohibited substances in their system. B. Discipline — when the company has reasonable cause to believe an employee is under the influence of a prohibited substance, for reasons of safety, the employee may be suspended until test results are available. If no test results are received after three (3) working days, the employee, if available, shall be returned to work with back pay. If the test results prove negative, the employee shall be reinstated with back pay. In all other cases: 1- Applicants testing positive for drug use will not be hired. 2- Employees who have not voluntarily come forward, and who test positive for drug use, will be terminated. 3- Employees who refuse to cooperate with testing procedures will be terminated. 4- Employees found in possession of drugs or drug paraphernalia will be terminated. 5- Employees found selling or distributing drugs will be terminated. 6- Employees found under the influence of alcohol while on duty, or while operating a company vehicle, will be subject to termination. C. Prescription Drugs — employees using a prescribed medication which may impair performance of job duties, either mental or motor functions, must immediately inform their supervisor of such prescription drug use. For the safety of all employees, the company will consult with you and your physician to determine if a re -assignment of duties is necessary. The company will attempt to accommodate your needs by making an appropriate re -assignment. However, if a re -assignment is not possible, you will be placed on temporary medical leave until released as fit for duty by the prescribing physician. D. Grievance — all aspects of this policy and program shall be subject to the grievance procedure of the applicable collective bargaining agreements. Drug/Alcohol Testing A. The parties to this policy and program agree that under certain circumstances, the company will find it necessary to conduct drug and alcohol testing. While "random" testing is not necessary for the proper operation of this policy and program, it may be necessary to require testing under the following conditions: 1- A pre -employment drug and alcohol test maybe administered to all applicants for employment 2- A test may be administered in the event a supervisor has a reasonable cause to believe that the employee has reported to work under the influence, or is or has been under the influence while on the job; or has violated this drug policy. During the process of establishing reasonable cause for testing, the employee has the right to request his on -site representative to be present; 3- Testing may be required if an employee is involved in a workplace accident/incident or if there is a workplace injury; 4- Testing maybe required as part of a follow-up to counseling or rehabilitation for substance abuse, for up to a one (1) year period; 5- Employees may also be tested on a voluntary basis. B. Each employee will be required to sign a consent and chain of custody form, assuring proper documentation and accuracy. If an employee refuses to sign a consent form authorizing the test, ongoing employment by the company will be terminated. C. Drug testing will be conducted by an independent accredited laboratory (National Institute on Drug Abuse and/or College of American Pathology), and may consist of either blood or urine tests, or both, as required. Blood tests will be utilized for post -accident investigations only. D. The company will bear the cost of all testing procedures. Rehabilitation and Employee Assistance Program A. Employees are encouraged to seek help for a drug or alcohol problem before it deteriorates into a disciplinary matter. If an employee voluntarily notifies supervision that he or she may have a substance abuse problem, the company will assist in locating a suitable employee assistance program for treatment, and will counsel the employee regarding medical benefits available under the company or union health & welfare/insurance program. B. If treatment necessitates time away from work, the company shall provide for the employee an unpaid leave of absence for purposes of participation in an agreed upon treatment program. An employee who successfully completes a rehabilitation program shall be reinstated to his/her former employment status, if work for which he/she is qualified exists. C. Employees returning to work after successfully completing the rehabilitation program will be subject to drug tests without prior notice for a period of up to one (1) year. A positive test will then result in disciplinary action as previously outlined in this policy and program. 13 SUBSTANCE / ALCOHOL ABUSE [NON -UNION] Purpose and Scope A. The purpose of this procedure is to institute and maintain a program for achieving the objective of a drug -free work force and to provide a workplace that is free from the illegal manufacture, distribution, dispensation, possession, sale, and/or use of illegal drugs. B. The program has been developed in compliance with existing federal regulations and in a manner which ensures accurate and reliable test results, thereby eliminating the possibility of any "false positives". It also contains procedures designed to recognize and respect the dignity and privacy of all of our employees. More importantly, we recognize that our employees are our most valuable resource and we want to assist any employee who feels that he or she may have a problem with chemical dependency or alcoholism. C. This policy covers all applicants, rehires, and current employees (including temporary employees). This policy is non-discriminatory and applies equally to all employees. Definitions A. Illegal Drug means drugs and controlled substances, the possession or use of which is unlawful, pursuant to the laws of any country and Federal, State, and local laws and regulations in the United States. Note: Drugs and controlled substances that are not legally obtainable, or that are legally obtainable but have not been legally obtained, are considered to be illegal drugs. Examples include amphetamines, barbiturates, benzodiazepine, cannabinoids, cocaine, methadone, methaqualone, opiates, phencyclidine, and propoxyphene. B. Controlled Substance Abuse includes prescribed drugs not being used for prescribed purposes or in a prescribed manner. Requirements A. The use, possession, sale, or distribution of alcohol on Company premises, or in Company - supplied vehicles, whether during working hours or non -working hours is prohibited. 1- If alcohol is served at social activities sponsored by Alpine Demolition and/or clients/vendors, preparations must include steps to encourage safe and responsible use among those who choose to use alcohol. a. Alcohol may be used only with prior approval at sanctioned company functions and while entertaining customers. Employees are expected to show appropriate restraint. Employees who show signs of intoxication will be asked to leave, and protective transportation arranged. B. The use, possession, sale, or distribution of illegal drug(s) on Company premises, or in Company -supplied vehicles, whether during working hours or non -working hours is prohibited. C. Storing any illegal drug(s) in a locker, desk, automobile, or other repository on Alpine Demolition premises is prohibited. D. Being under the influence of an illegal drug, controlled substance, or alcohol on Alpine Demolition premises, or while engaged in Alpine Demolition business, or in Alpine Demolition -supplied vehicles, or during working hours is prohibited. E. Testing positive for illegal drugs or controlled substances without a legal basis for use. F. Switching or adulterating any urine sample submitted for testing or submitting a false sample for testing. G. Refusing consent to testing or refusing to submit a urine sample for testing when required by an Alpine Demolition representative or by representatives of any Alpine Demolition customer, vendor, or supplier. H. Being indicted or convicted under any criminal drug statute for a violation occurring in the workplace or outside the workplace. I. Failing to notify Alpine Demolition of any incident or conviction under any criminal drug statute within 5 days of the event. J. Failing to comply with rules and regulations promulgated under any testing programs maintained by Alpine Demolition pursuant to such rules and regulations. Authorized Use of Prescribed Medicine A. An employee undergoing prescribed medical treatment with any drug or controlled substance that may impair his or her physical or mental ability should report this treatment to Alpine Demolition Human Resources Department, which will determine whether Alpine Demolition should temporarily change the employee's job assignment during the period of treatment. Testing A. Alpine Demolition has established a testing program for illegal drugs and controlled substances for all employees and will, in its sole discretion, determine (and may at any time change) the requirements extent, and frequency of employee testing. B. All samples collected under this program will be Analyzed by a SAMHSA certified laboratory, and shall include an initial Enzyme Multiplied Immunoassay Screening Test (EMIT) and, when necessary, confirmed by a Gas Chromatography/Mass Spectrometry (GC/MS) Confirmation Test. Said testing must screen, as a minimum, for the following substances and below the following levels to result in a negative test. C. Alpine Demolition , prior to taking any action, will give all employees who test positive the opportunity to explain in writing the test results. 1- Failure of any employee to establish adequately a legal basis for the use of any drug or controlled substance with respect to which the employee tests positive shall constitute a violation of this policy. An MRO (Medical Review Officer) maybe used to verify "positive" results at the discretion of the company. D. Alpine Demolition will establish and maintain any and all additional testing programs and requirements that may be necessary or appropriate to comply with applicable rules and regulations of all Government agencies. Testing Options A. Probable Suspicion/Reasonable Cause Testing 1- Alpine Demolition will require a drug and/or alcohol test for an employee when there is "probable suspicion" that the employee cannot safely perform his or herjob and could potentially be under the influence of a prohibited drug and/or alcohol in violation of this policy. 2- The employee will be asked/required to sign the consent form. Any employee who refuses to sign the consent form or to provide a urine and/or breath sample will be considered as admitting guilt, insubordinate, and will be disciplined as a "positive" result, subject to appropriate disciplinary measures up to and including discharge. 3- If possible, the probable suspicion circumstance; should be witnessed by at least two (2) trained supervisors or company representatives. 4- If the supervisors and/or company officials determine that Probable Suspicion/Reasonable Cause exists, the employee will be tested for alcohol and/or drugs; a. The employee will not be allowed to drive and will be escorted to the clinic by a supervisor or company official to provide a urine sample for drug testing and/or breath sample for alcohol testing. b. After appropriate samples are provided, arrangements will be made with a spouse, family member or other individual to transport the employee to his/her home. In the event no such individual is available, a taxicab will be called to take the employee home, at the employee's expense. C. The employee will be reimbursed for the cost of the taxicab if the results of his/her tests are both negative. d. If the employee refuses to cooperate at any time and attempts to operate his/her own vehicle, the Company will take appropriate efforts to discourage him/her from doing so, up to and including contacting local enforcement officials. 5- Pending the company's receipt of the results of the employee's drug and/or alcohol tests, the employee will be suspended without pay. If the test results are negative, the employee will be reinstated with no loss of seniority and in appropriate instances will be awarded full back pay. B. Post -Incident (Accident) Testing 1- Drug testing to evaluate the root cause of a workplace incident that harmed or could have harmed employees. 2- Any employee wholly and/or partially involved in a reportable incident and there's a reasonable basis for believing that drug use by the reporting employee could have contributed to the injury or illness. will be required to provide a urine sample and/or breath sample for testing. a. Non-compliance with these terms will be considered an admission of guilt and disciplined as a "positive" test result. 3- Any employee failing or refusing to provide a drug/alcohol sample or who has a verified positive or adulterated test result after being involved in an incident will be subject to appropriate disciplinary measures, up to and including discharge. Consequences for Violation of the Drug -Free Policy A. Violation of this policy may result in severe disciplinary action, including termination, at Alpine Demolition's sole discretion. B. Alpine Demolition will promptly terminate any employee who tests positive for illegal drugs or controlled substances, unless the employee establishes a legal basis for the illegal drug or controlled substances, if the employee has tested positive for illegal drugs or controlled substances without establishing a legal basis for such use on a previous occasion. Alpine Demolition will promptly terminate any employee who tests positive for illegal drugs or controlled substances, unless the employee establishes a legal basis for the illegal drug or controlled substances, if the employee has been referred at Alpine Demolition request for treatment or counseling on a previous occasion. Use the hydraulic grapple to grab a section of the brick walls and bring it to the ground. o Continue to bring the building to the ground in a manner that reduces the stored energy from existing material on the ground, from being released. o Load out debris in semi trailers. o All debris will be sprayed with a fire hose throughout the process to reduce dust. o Trucks to be loaded within work area for removal of material off site per contract specifications. o Trucks will be lined with plastic and covered prior to transport offsite. o Once all above ground debris has been removed offsite, use the bucket attachment to peel up the concrete slab and foundations. o Break concrete into manageable pieces for transport. o Repeat the steps above for the transport requirements. o Affected streets to be swept clean. o An asbestos supervisor will be onsite throughout the demolition process.
