Company, an Indiana corporation, releases and quit claims to
M1,1nicipal City of South Bend, Indiana, for and in consideration
of One Dollar ($1.00) and other valuable considerations the receipt
,,,71iereof is hereby acknowledged the following described real
estate in St. Joseph Coai-it-,y-, .1n the State ol' Indiana, to viit:
Xp�,.)ro:,imately One (1) acre of land, being all of
t,?Ie North West corner of 'the East fraction, (lying
East of the St. Joseph River) of the South East
(,,w.arter of Section number twelve (12) in Township
th1.rty-seven (37) North of Range two (2) East, lying
west of St. Louis Street, in A. Coqu-illard's 2nd
Addition to the City of So,,ith Bend, and East and
North of the waters edge of said St. Joseph River,
and being the same land heretofore conveyed to South
Bend Manufacturing Company by the warranty deed
recorded in Deed Record 50 at T)a--e 244 of the
records in the office of the Recorder of St. Joseph
Col.inty,, Indiana.
There is excepted from this conveyance and
reserved to the Grantor, its si-iccessors and assigns
the r1n,ht, orivilcge and easement to raise and impound
the waters of the St. Joseph River where it adjoins
the above described real estate to sijch height as
it will be raised at any and all times and -i),nder any
and all conditions by reason of the South Bend Dam
now located across said St. Joseph River in said City
of South Bend and by reason of such flood or head
gates on or near said dam as are deemed necessary
or convenient b-y Grantor, i-ts successors and assigns,
or by reason of any change, repair, alteration,
imnrovement- construction or reconstruction of said,
dam and said gates and to cover with water such parts
of the above described real estate as may be over-
flowed by reason of said dam and gates, and the right
by means of said dam and sa-id gates to cause the water
of said river to set back over the above described
real estate and to percolate through the same.
IN WITNESS T^1HEREOF, the said South Bend 14an-,ifacturing
Company has hereunto set its signatLire by its duly authorized
