I am enclosing herewith Release of Conditions
Contained in Deed, which was signed by James Oliver II. , Gertrude
Oliver Cunningham, Joseph D. Oliver, Jr. and Susan Catherine
Oliver. Said release was recorded on the 2nd day of July, 1943
in Book No. 361, pages 9 to 11.
I cannot guarantee that I have obtained on said
.release of conditions all of the heirs at law or legatees or
devisees of Tames Oliver. As I remember, Tames Oliver died
leaving surviving him his son, Joseph D. Oliver, and a daughter
whose name was Tosephine Ford. The signers of the subject instru-
ment are the children of Joseph D. Oliver. Josephine Ford and her
husband never had any children. James Oliver died leaving a will
wherein were created various trusts. This is true also of Jose-
phine Ford and her husband, as well as Toseph D. Oliver, Jr.
Under the wills of Josephine Ford and her husband everything
apparently passed back to the four co-signers of the subject
instrument.
There is a further problem of whether or not
the reversionary interest passed under the various wills, or
whether it passed under the laws of descent. If the interest
passed under the wills, I am inclined to believe that we have
all parties who have an interest therein. If the interest
passed under the laws of descent, it is entirely possible that
we do not have all the parties who have an interest in said
reversionary right.
Certainly the major problem has been solved, namely,
that of securing, the signatures of the four principal owners of
said interest so as to avoid the necessity of going out and pro-
curing the signatures of their children if we should wait until
after the death of the four signers. Though I have not looked
into the matter carefully, it might be possible for us to file
a quiet title suit as against all of the other unknown heirs,
