`,.'his indenture, made this 30thday of October, 1945, between the 'Pe-
D Board of Missiona and Charities of Wayne County, Ohioj hereinafter called
1----.- 7 grantor and the City of South Bend, Saint -Tosepb County, Indiana, hereinafter
.led the grantee, witnesseth:
Whereas$ said grantor is seized in fae simple of the following describ

Sub --division to the Oity of South Bend,
And, vhereaa, said grantor is desirous of constructing a sewer and installing a
water line in, on and along a strip of land fifteen (15) feet in width off of a
from the entire east side of the above described real estate, and whereas, the
grantee, after said sewer has been constructed, is Willing to repair, and
said sewer®
Now, therefore, in consideration of the said City of South Bend's prom-
ises to repair and maintain said sewer after the construction thereof, said
grantor hereby gives and grants unto said grantee forever, the right to enter
upon said fifteen (15) feet of land to repair and maintain said sewer forever,
Lr and, said grantor does hereby for itself, its Mccessors and assigns, release
and relieve the said grantee from any and all damages that may be done to the
property of the owners, occupants and tenants of said grantor upon the said
I fifteen (15) feet off of and fxom the entire east end of said tract of land.
IN TUUMESS 'UHLZEOF, the grantor has hereunto set its hand and afaxed
its seal this 20th day of October, 1948.
