Enclosed herewith please find two copies of the Agreement trans-
ferring control of the land owned by the City of South Bend on the
South side of Pinhook Lagoon to the Park Department for their
maintenance. Would you please have this agreement taken up be-
fore the City Council Monday evening.

AGREEMZNT
THIS AGREEMENT made and entered into this_)J#aay of August,
1954, by and between the BOARD OiF PUBLIC woJtJ<S OF THE CITY OF SOUTH
BEND, hereinafter referred to as the Party of the First Part, and the BOARD
OF PARK COMMMSIONERS OF Ti,.-IE CITY OF SOUTH BEND, hereinai-ter
WITNE SSETH:
WHEREAS, the City of South Bend is the owner of a parcel of
land in the Southwest Quarter of Section Twenty-six (26). Township Thirty-six
(36) North, Range Two (2) East, and being more particularly described as
follows:
h strip of land cornmencing at the Southwest corner of the in-
tersection of Riverside Drive anrl Pinhook Drive in the City of
South Bend; thence in a lNeaterly direction along the South
Une' of Pinhook Dri-c to the Vlest line of Section 26, Township
36North, Range 2 East; thence North along said "Viest section
lixie to the naeander line of the Soath bank of Pinhook Lagoon;
thence, Easterly -along said meandei- line of the South bank of
Pinhook I-agoonto the West line of Riverside :orive, thetace
Southerly to the place of beginning.
WkMREAS, the Party of the First Part to desirous of transferring
its jurisdiction and control of said above described real estate to the Party of
the Second Part, and
WHEREAS, the Party of the Second Part is willing and desirous of
controlling and maintaining said above described real estate.
NO'V,f, THEREFORE, in consideration of the mutual promises of the
parties hereinafter set forth it Is agreed as follows:
1. That the Party of the First Part does hereby transfer all of
its right, title and interest in said above described real estate to the Party of
the Second Part absolutely, and the Party of the I'Jrst P art does hereby agree
to xnaintain nevertheless the street 1,mown as Pinhook Drive,
2. The Party of the Second Part hereby agrees to accept
