THIS INDENTURE WfTNESSETIT: That the Terre Haute and Logans-
port Railway Company, a corporation organized and existing under the
railroad laws of the State of Indiana, in consideration of the
grant to it by the City of South Bend of the right to cross certain
streets in that City, as set forth in a set of resolutions adopted
by the Common Council.thereof, September Ilth, 1899, and for
the purpose of carrying out the provisions of the Fifth Section
of said set of resolutions, hereby conveys and warrants to the
City of South Bend, a municipal corporation under the laws of
the State of Indiana, the following; real estate situate in the
county of St. Joseph, in the State of Indiana, to -wit: A strip
of land thirty (30) feet wide bounded as follows: Beginning at
a point thirty (30) feet due east of the northeast corner of
lot numbered one (1) in the recorded plat of South Lawn, which
point is one hundred and fifty-six and three-quarters (156 3/4)
feet east of the west line of Section 13, Township 37 North, Range
2 East, and is on the east line of South LaFayette Street, as
shown on said plat of South Lawn, and running thence east thirty
(30) feet; thence south six hundred (600) feet to the south
line of the grantort,s land, thence west thirty (30) feet to the
east line of South LaFayette Street, as shown on said plat of
South Lawn; thence north on said east line of South LaFayette
street to the place of bee:Lnn1ng_
The strip of land above described is hereby conveyed for
the purpose of widening said South LaFayette Street to a width
of sixty (60) feet and is to be held and used by the grantee
herein as part and parcel of said South Lallayette Street,and for
no other purpose whatever,
Also a strip of land bounded as follows: Beginning at a
point sixty (60) feet east from the northeast corner of lot
numbered one (1) in the recorded plat, of South Lawn, and running
thence north sixty (60) feet; thence west one hundred and eighty-
six and three-quarters (186 3/4) feet to the west line of Sec-
tion 13, Township 37 North, Range 2 East, being; also the west
line of the grantor's land.) thence south thirty (30) feet to
the north line of Elmira Street, as shown on said plat of South
Lawn; thence east one hundred and fifty-six and three-quarters,
(156 3/4) feet; thence south thirty (30) feet; thence east
thirty (30) feet to the place of beginning.
The strip of land last above described is hereby conveyed
for the purpose of openint up Elmira Street to the width of Sixty
(60) feet from the west line of Franklin Street east to a point
sixty (6o) feet east of the present west line of South LaFayette
Street, and is to be held and used by the grantee herein as part
and parcel of said Elmira Street and for no other purpose whatever.

way Company has caused the foregoing deed to be executed by its
proper officers and its corporate seal to be hereunto affixed
