In accordance with all the terms of Chapter 17 of the City of South Bend’s Municipal Code, and with any
applicable provisions of federal or state law and regulations, permission is hereby granted to:
Messer, LLC.

for the contribution of wastewater into the City of South Bend Publicly Owned Treatment Works.
This permit is granted in accordance with the application filed on 26 December 2023.
Effective on: 26 March, 2024
Expires on the: 25 March, 2029
Any violation of the terms and conditions of this permit shall be deemed a violation of the City of South
Bend Municipal Code and will subject the permittee to the sanctions set out in section 17-11 through 17-
13 of the Municipal Code.
The permittee shall file an application for a renewal permit, a minimum of 90 days prior to the expiration
date.

RE: Renewal of Industrial Wastewater Discharge Permit
Dear Board Members:
The Division of Environmental Services recommends approving the renewal of the Industrial Discharge Permit for
Messer LLC at the February 27, 2024, Board of Public Works Meeting.
Messer LLC processes crude carbon dioxide from a neighboring industry to produce food quality carbon dioxide. Messer
LLC requirements were reviewed for necessary changes to ensure the industrial permit remains legally substantiated.
After review of requirements and historical data, no pollutant limitations were adjusted. There have been no significant
changes to the permit.

Facility Description
Messer, LLC. processes crude carbon dioxide from a neighboring industry to produce food quality
carbon dioxide. The carbon dioxide comes from a feed gas line from the neighboring industry. The
carbon dioxide is filtered and sent to a separator that helps remove the moisture. Then the carbon
dioxide is chilled with ammonia and then sent to another separator that removes large water droplets
in solution. The carbon dioxide is then compressed from 2 pounds per square inch to 60 pounds per
square inch. The solution is then cooled with cooling water. A third separator removes moisture in
the carbon dioxide and then is compressed to 300 pounds per square inch. The carbon dioxide then
travels through a zinc oxide bed to remove the hydrogen sulfide that may be present. The carbon
dioxide is cooled through the water cooler and is sent back through the scrubber. The scrubber
removes the impurities in the carbon dioxide. The carbon dioxide is now at 320 pounds per square
inch coming from the scrubber.
PART I – EFFLUENT LIMITATION
A. Sample Port and Collection Location
1. Sample Site Outfall #900 is located outside at the southwest corner of the facility
inside the facilities fence in a controlled manhole. The sampler is set up next to the
manhole and is locked up. A 24 hour composite sample is collected in this manhole
of Messer's total discharge flow. Grab Samples are also collected in this manhole .
2. Any discharge of water or waste having a pH lower than 6.0 S.U. or a pH higher
than 11.0 S.U. is prohibited. In addition, the permittee’s wastewater discharge shall
not exceed the following effluent limitations:

3. Discharge Screening Level Limitations have been established to evaluate the need for a
limitation for pollutants that are not listed in the Effluent Limitation section of the permit.
If a permittee has no limit for a particular pollutant, but observes, through monitoring
and analysis, a concentration of that pollutant greater than the listed Discharge Screening
Level concentration found in the table below, the permittee shall notify the Control
Authority. This notification shall be made in writing within five days of observing the
pollutant concentration.

2. Discharge description:
Discharge is total facility flow (Condensation, Scrubber, Cooling Tower Blow down and
Sanitary).
From December 2022 to November 2023
Average Daily Flow: 37,941 gallons
Maximum Daily Flow: 67,918 gallons
3. Sample Site Description

4. Wastewater Treatment
The pH of the water from the scrubber to the decarbonator is about 5.5- 5.6. The water is
then pulled down through the media in the decarbonator as carbon dioxide is pushed up and
the pH of the water is increased to 7.2-7.4. The water is then sent to the mixing tank where
caustic is added to bring the final pH to 7.5. The effluent which consists of Cooling Tower
Blow Down and Srcubber water is then sent through their oil/water separator that is located
in the facilties maintenance garage and then mingles with their sanitary and finally is sent
to the City of South Bend Sewer System.
Wastewater treatment consists of a de-carbonator (which removes Carbon Dioxide) and
pH neutralization. There is also an oil/water separator in the vehicle maintenance
building.
5. Classification
Messer LLC is classified as a Significant Industrial User (SIU) as defined in the South
Bend Municipal Code.
6. Calculation of Limits
Limits are applied from the South Bend Municipal Code directly to Messer LLC facility
effluent.
7. Monitoring Frequency
Monitoring frequencies are based on South Bend’s US EPA approved industrial
pretreatment program monitoring plan. Messer LLC is classified as a B industrial user
due to their waste flow of greater than 50,000 gpd and less than 100,000 gpd.
8. Operator Certification
Industrial Operator Requirement: A-SO Industrial operator certification requirements are
based on the criteria listed in Indiana Administrative Code, Title 327, 5-22-5.
Determination of Messer’s industrial operator certification requirements is due to the use
of de-carbonator to remove CO2 from the effluent to minimize the use of sodium hydroxide
to applied with the effluent for pH neutralization.
