Dear Mr. Grabijas:
At its February 27, 2024 meeting, the Board of Public Works approved the above
referenced amendment for design services for traffic calming and connectivity to Rum Village
at Walker Field Park, Project No. 123-058 in the amount of $212,500 with a new adjusted total
of $304,000.
Enclosed please find the original of the amendment for your signature. Please sign and
return the original amendment to lhensleyksouthbendin.gov. Please retain a copy for your
records.

for Professional Services dated September 12, 2023.
AMENDMENT TO OWNER -ENGINEER AGREEMENT
Amendment No. 1
1. Background Data:
a. Effective Date of Owner -Engineer Agreement: February 27th, 2024
b. Owner: Board of Public Works. Citv of South Bend
C. Engineer: HWC Engineering, Inc.
d. Project: Walker Field Restroom Connectivity
2. Description of Modifications:
a. Engineer shall perform or furnish the following Additional Services:
1) Construction Documents
a) HWC will develop final construction documents for the project based on the
approved 30% Schematic Design plans. This work will include the following
tasks:
b) Final design and detailing of the streetscape and trail components.
c) Development of plan sheets, detail sheets, and supplementary information.
Progress plans will be provided to the CLIENT in digital PDF format for review
according to the following completion milestones.
d) 60% complete plans to include preliminary plan sheet development of the cover
sheet, site plan with details, grading plan, landscape plan, site amenity details,
park pedestrian wayfinding signage and vehicular wayfinding, erosion control
plan, plan and profile for street and site grading plan for the hillside trail work.
e) 90% complete plans to include draft final plans and details, draft contract
documents, and draft technical specifications.
f) Final landscape plan will include trees, shrubs, groundcover, grass and seed
location, quantity, species type, and installation details.
g) Final site amenities details will include site furniture (bike racks, trash
receptacles, and benches), pedestrian hardscape areas, steps and retaining walls,
and handrails.
h) 100% plans to include all materials in final form ready for bid advertisement.
i) HWC will prepare one (1) project manual consisting of instructions to bidders,
contract documents and technical specifications.
j) HWC will provide opinions of probable construction cost at all completion
milestones.
k) HWC will prepare the Construction Stormwater Regional General Permit for
review and approval.

1) 14WC will facilitate the following CLIENT meetings as outlined below:
m) Design Meeting No. 1: 60% Plan Review (in -person)
n) Design Meeting No.2: 90% Plan Review (in -person)
o) Design Meeting No.3: 100% Plan Review/Bid Prep (virtual call)
2) Utility Coordination
a) HWC will provide utility coordination services for the proposed site
improvements with public utility services
3) Bidding
a) HWC will provide the following services to assist the CLIENT with one (1)
project letting and award:
b) Prepare and submit one (1) notice to bidders for CLIENT publication.
c) Distribute plans and specifications to bidders.
d) Respond to bidder questions during the bid phase.
e) Issue addenda to clarify or modify the bidding documents.
f) Attend and facilitate one (1) pre -bid conference.
g) Review submitted bids for conformance to project documents. Submit a
summary of this review to the CLIENT.
h) Prepare a tabulation of bids received.
i) Assist the CLIENT in evaluating bids or proposals and in assembling and
awarding contracts for the project.
4) Construction Administration
a) HWC will provide construction administration services as follows:
b) Facilitate and one (1) pre -construction conference.
c) Review shop drawings and submittals.
d) Review requests for change orders.
e) Review requests for information from the contractor.
f) Attend up to (4) construction progress meetings/site visits.
g) Attend (1) landscape review meeting and (1) warranty walk to review the
landscape material in the spring season following installation.
h) Attend one (1) pre -final project walk through.
i) Develop a punch list based on outstanding issues identified at the project walk
through.
j) Review contractor's applications for payment.
5) Notations, Exceptions, and Assumptions
a) Lighting design and electrical engineering are excluded from the scope of work.
b) Design and engineering for the resurfacing of Rum Village Park Road is
excluded.
c) The renovation of Walker Field Pavilion will be done by others. Only sidewalk
connection to the facility will be included in this scope of work.
d) Geotechnical work is excluded, but if deemed necessary can be provided for an
additional fee.
e) Irrigation design and detailing is not included.

d. For the Additional Services or the modifications to services set forth above,
Owner shall pay Engineer the following additional or modified compensation:
• Construction Documents - $168,500.00
• Utility Coordination - $7,000.00
Bidding - $8,500.00
Construction Administration - $28,500.00
e. The schedule for rendering services is modified as follows:
• Anticipated Notice to Proceed — February 1, 2024
• 60% Plan Production/Review Meeting — March 2024
• 90% Plan production/Review Meeting — April 2024
• 100% Plan Submittal/Bidding — May 2024
• Bid Award/Construction Begins — June 2024
• Substantial Completion — December 1, 2024
• Final Completion — January 1, 2025
5. Agreement Summary (Reference only)
a. Original Agreement amount: $91,500.00
b. Net change for prior amendments: $0
c. This amendment amount: $212,500.00

Owner and Engineer hereby agree to modify the above -referenced Agreement as set forth in this
Amendment. All provisions of the Agreement not modified by this or previous Amendments remain in
