REGULAR MEETING April 10,2023 REPORT FROM SUB-COMMITTEE ON MINUTES City Clerk Dawn Jones indicated the Sub-Committee on meeting minutes have reviewed the minutes for the following dates of March 13, 2023, and are correct. Councilmember Eli Wax requested some changes and per City Clerk, Dawn Jones, minutes were corrected. President Sharon McBride asked for a copy of the updates, and Clerk Dawn indicated that those would be available to her. Councilmember Eli Wax made the motion to approve the meeting minutes. BILL NO. 03-23 PUBLIC HEARING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF THE SOUTH BEND, INDIANA, ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF REGULAR MEETING April 10, 2023 SOUTH BEND, INDIANA, CERTAIN LAND LOCATED IN GERMAN TOWNSHIP, CONTIGUOUS THEREWITH; COUNCILMANIC DISTRICT NO. 1, FOR THE SOUTHEAST CORNER OF NIMTZ PARKWAY AND OLIVE ROAD, SOUTH BEND, INDIANA Councilmember Lori Hamann stated that Bill No. 03-23 was heard in the board of Zoning and Annexation meeting this afternoon and comes to the committee of the whole with a favorable recommendation. Petitioner, Michael Divita, Principal Planner with the city of South Bend, located on the 14th floor of this building. This is an annexation for two parcels on the Southeast corner of Olive Road and Nimtz Parkway, it's an island and'zoned S one(1) upon annexation. It would be used as a parking area and landscaping for Resurrection Lutheran Academy. Petitioner John Schrader, 6840 Nimtz Parkway, South Bend, IN 46628 for Resurrection Lutheran Academy,has plans for expanded parking, and part of this space is in the county and part in the city. John wants the annexation for it to not be an island for the county, but for the city. Councilmember Lori Hamann made a motion to send Bill No. 03-23 to the full council with a favorable recommendation. Councilmember Karen White seconded the motion. Angela Smith, Zoning Administrator, with offices located on the 14th floor of this building. Property at 439 Dundee Street, the petitioner Redline Properties, LLC wants to allow for a duplex. There are two (2) front doors, and it is a single-family home. This is a special exception to make it duplex. This comes from The Board of Zoning Appeals with a favorable recommendation. Petitioner, DeCarlo Redding, with Redline Property, 328 South Eddy Street South Bend IN 46601. He wants to update and revitalize the property. Council Vice President Sheila Niezgodski asked of the correct address 1143 E. Ireland Rd, as that is the BMV. Petitioner stated they use a virtual address which is currently Staples. Council Vice President asked the petitioner, DeCarlo Redding if he will be managing the properties, or will he fix them up and flip them? He stated that he will manage the properties. Michigan St. Petitioner needs a special exception for this property for group residence. It was built as a large single-family home and has multiple units. When there are more than two (2) unrelated individuals there, or families, a duplex exception can be used. This is along a commercial corridor, it will prevent a vacant building from existing, and is zoned for multi-family. This comes from the Board of Zoning Appeals with a favorable recommendation. Petitioner, Clara Ross, 726 Cushing Street South Bend IN 46616. She is the founder of Homes for Tracy, IMC. She wants to transform this into a transitional facility. Women will have to pay to live there, work on credit, and life skills. They will learn to be self-sufficient. This is the fiscal plan for the one point two (1.2)-acre annexation requested by the property owner of two (2)parcels at the Southeast corner of Nimtz Parkway and Olive Rd. This will give way to expanding the parking lot and landscaping for the Resurrection Lutheran Academy area where water and sewer are available along Nimtz Parkway and Olive Road. The developer wants to build ninety(90) REGULAR MEETING April 10, 2023 new apartments on the top floors with public access on the seventh (7th) floor of the building for meetings, a bar and lounge, along with an outdoor deck. They are investing fourteen point seven ($14.7) million, and this will create nine (9)new full-time positions. Current taxes are$42,000 and will be estimated at over$346,600 over the length of eight(8)years. The first(1st) year of the new abatement will accrue $72,674 in taxes. Over the eight(8)years, this project will bring in over one point three ($1.3)million dollars. Council President Sharon McBride opened the floor to Councilmembers for any questions or comments. Councilmember Rachel Tomas Morgan stated that this resolution came to the Committee of Community Investment with a favorable recommendation. Erik Glavich, director of Growth and Opportunity on the 14th floor of this building. This is a declaratory resolution for a single-family residential property tax abatement for two vacant lots that are owned by Cross Community Inc, a nonprofit organization. This group supports initiatives supporting the Bend's West Side Neighborhoods. Cross Community will build two brand new homes with an investment of$440,000. They will sell these homes to those who complete a home buyers'program. The abatement will then be transferred to the new homeowners after they purchase the new homes. There is a one hundred dollar($100) current estimated tax for each house, during the five(5) year abatement, the total estimated taxes are $10,650 and the taxes paid will be $1,650. Tina Patton, Cross Community Representative, 707 Sherman Drive, South Bend IN 46616, stated this organization has been around since 2016. The city provides gap financing, and it is a homeowner's program that teaches people how to manage their finances, credit repair and has a partnership with multiple banks. Once they complete the program these banks will give the mortgages for the homes. They have purchased multiple lots and will redevelop the community. They want to make sure that homeowners can have a legacy for themselves. Council President Sharon McBride opened the floor to Councilmembers for any questions or comments. There is a response from Aaron Perri regarding the update, however, per President Sharon McBride, she will confirm the update with an email. NEW BUSINESS There is no new business. REGULAR MEETING April 10, 2023 PRIVILEGE OF THE FLOOR Sue Kesim, 4022 Kennedy Drive, South Bend IN 46614. She would like to know from the council who can read a financial report, an annual report. She had asked about the debt number given from the mayor's report was $207 million, but on the Indiana Gateway site, the amount was $220 million. She asked the council, and no one got back to her. She would like to know why there is a discrepancy. President Sharon McBride stated that she will appoint Vice President Sheila Niezgodski to get updated information, as she is on the finance committee. Ms. Kesim also asked for a list of the abatements, as she completed a FOIA, and she hasn't seen the listing yet, and should be listed. She also wants to see if giving zero ($0) for ten(10) years was legal. President McBride stated that she will consult with the council attorney, Bob Palmer, regarding these matters. John Pinter, 1224 Runnymede, South Bend IN 46617 Director for the United Religious Community, at 501 N. Main, South Bend IN 46601. They are hosting a group from the Central Asia and Mongolia Caucuses, and Afghanistan Delegation, and introduced them to the council. Henry L Davis Sr, 215 N. Sheridan St, South Bend IN 46619. Posed a question about affordable housing definition. President Sharon McBride explained that affordable housing is considered affordable when rent or mortgage plus utilities is no more than 30% of a household gross income. Henry L Davis, Sr., stated the term has been flipped on poor people, and poor people think they can afford it when they hear affordable housing. Someone making$12-$15, or $30,000 cannot afford a house. The second question was is there money to build the dream Center. Out of sixty($60)million, only two ($2)million was left. Per President McBride, money form the ARP fund were appropriated and voted on out of the original ARP funds for the Dream Center. Councilmember Lori Hamann stated that she has a statement from Aaron Perry per her email. The email was read.
