Clerk Biana L. Tirado states that the subcommittee has inspected the January 2, 2024 Organizational Meeting minutes and recommended that the minutes be approved. Councilmember Troy Warner states the motion to accept the report from the subcommittee for the January 2, 2024 minutes. Councilmember Canneth Lee seconded the motion. RESOLVE INTO THE COMMITTEE OF THE WH 1 REGULAR MEETING January 8, 2024 Councilmember Rachel Tomas Morgan motioned to resolve into the committee of the whole, which was seconded by Councilmember Dr. Oliver Davis and carried by a vote of eight (8) ayes. PUBLIC HEARINGS BILL NO. 83-23 PUBLIC HEARING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING THE. ZONING ORDINANCE FOR PROPERTY LOCATED AT 603, 607, 611, 615, 617, 619, AND 621 WEST MARION STREET, COUNCILMANIC DISTRICT NO. 1 IN THE CITY OF SOUTH BEND, INDIANA Clerk Bianca L. Tirado read the bill to the council for its second reading. After the second reading, Councilmember Lee requested the committee report. Councilmember Dr. Davis, chair of the Zoning and Annexation committee, stated that Bill No. 83- 23 came before the Zoning and Annexation Committee this afternoon, January 8 h, 2024, and comes with a favorable recommendation. Councilmember Lee requests that the petitioner(s) state their name and address and share key points before the council. Skip Morrell, Zoning Specialist, 141h floor of the County -City Building presented Bill No. 83-23, the bill states the petition is to rezone the properties of 603, 607, 611, 615, 617 and 621 Marion Street from NC Neighborhood Center to U3 Urban Neighborhood. The down zoning from NC to U3 is to allow those cottage courts and a variety of building types permitted. As the property exists now is vacant lots owned by the Department of Redevelopment, the proposal is for fifteen (15) units to be built on the parcels, five (5) single family units and ten (10) in Cottage Court. The proposal blends between building developments north of the proposal. Joe Molnar, Property Development Manager, 141h floor of the County -City Building continues presentation for Bill No. 83-23, stating that the request for the proposal stems back to a request for proposal from the Redevelopment Commission to solicit vacant land owned by the city for development proposals. Developer, Allen Edwin applied for the project. The current agreement being developed would have eighty percent (80%) of the development be for workforce housing. Councilmember Lee responds with any questions from the council to the petitioner. Councilmember Lee asks the petitioners what the rough estimate of what household income would need to be for the development. Joe Molnar, Property Development Manager, 14th floor of the County -City Building states that he would need to verify with HUD but believes that the median income for Saint Joseph's County is $60,000. For workforce housing it would need to be affordable to eighty percent (80%) of that or families of four making $40,000, but it would also increase and decrease with the size of the household. Brian Farkas, Director of Workforce Housing with Allen Edwin, 2186 E. Centre Street Portage, MI 49002, adds that he believes that those numbers are correct with current HUD standards. Joe Molnar, Property Development Manager, 10 floor of the County -City Building adds that the HUD standard is thirty percent (30%) of your monthly take home. Councilmember Lee requested if there were any questions from the council to the petitioner. Councilmember Lee restates no further questions from Councilmembers and moves to Public Comment first to those physically present and then requesting Clerk Tirado if there is any public comment online. Councilmember Lee closes public hearing and entertained a motion regarding Bill No. 83-23 Council Member Dr. Oliver Davis motioned to send Bill No. 83-23 to the full council with a favorable recommendation, which was seconded by Councilmember Troy Warner and carried by a vote of eight (8) ayes. White — Aye Councilmember Rachel Tomas Morgan — Aye 86-23 PUBLIC HEARING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING A PETITION OF THE ADVISORY BOARD OF ZONING APPEALS FOR THE PROPERTY LOCATED AT 3001, 3011 AND 3015 WEST WESTERN, COUNCILMANIC DISTRICT NO. 2 IN THE CITY OF SOUTH BEND, INDIANA Clerk Bianca L. Tirado read the bill to the council for its second reading. After the second reading, Councilmember Lee requested the committee report. Councilmember Lee requests that the petitioner state their name and address and share key points before the council. Skip Morrell, Zoning Specialist, 14th floor of the County -City Building presented Bill No. 86-23 3001, 3011 and 3015 West Western Avenue, which requests to allow for a special exception to allow for vehicle service minor which allows for services like oil changes, alignments, cooling and electrical systems detailing. It does not include any dismantling and all repairs must be made within the fully enclosed building. Previously, the property was a window manufacturing business and then recently as a vehicle repair location until 2017. The building would need to be brought up to standards. The owner also requested slightly reduced setbacks for parking. Councilmember Lee asks if there are any other petitioners online wishing to give comment. Theodoros Arhontas, 2565 Portage Avenue, Las Vegas Nevada 89120 adds that the building is slowly improving and that they are gaining traction with tenants. Mentioned that he understands the work the city planners have done to improve the area and that he will make the outside fagade of the building better. Councilmember Lee responds with any questions to the petitioner from the council. Councilmember Dr. Davis asked Petitioner Arhontas on how he plans to maintain the property as an out-of-state owner and if he has a local contact for property maintenance. Theodoros Arhontas, 2565 Portage Avenue, Las Vegas, Nevada 89120 states that he has a local partner with a stake in the building. Councilmember Dr. Davis asked Petitioner Arhontas if the local partner is on the paperwork with the city. 3 REGULAR MEETING January 8, 2024 Theodoros Arhontas, 2565 Portage Avenue, Las Vegas, Nevada 89120 affirms that he is. Councilmember Dr. Davis asked Skip Morrell Zoning Specialist to detail the reduced setbacks. Skip Morrell, Zoning Specialist, 14th floor of the County -City Building, states that in the NC District there is frontage, the parking lot has to be at least five feet behind frontage, with this parcel being 40 feet wide, the setback has to be 12 feet back because there's no building frontage on the east side which means that the space can't be utilize fully. Councilmember Tomas Morgan inquires about the timeline for the improvements. Skip Morrell, Zoning Specialist, 10 floor of the County -City Building, mentions that this property was brought forward because of previous zoning violations, this is seeking to address those and the Petitioner is also thinking about using the Vibrant Places grant to keep improvements on track. Councilmember Warner, chair of the Community Investment Committee, stated that Resolution No. 24-01 came before the Committee this afternoon, January 8th, 2024, and comes with a favorable recommendation and approved unanimously. Clerk Tirado read the resolution. Vice -President Niezgodski requests that the petitioner state their name and address and share key points before the council. Erik Glavich, Director of Growth and Opportunity, 14th floor of the County -City Building presented this resolution. This resolution is to correct a Scrivener's Error made in Resolution No. 5031-23 made August 28, 2023, and in Resolution No. 5031-23 made June 26, 2023. In speaking with the Legal Department, the solution found was to present a substitute bill. The tax abatement was approved by Council in July; however, it incorrectly did not include all of the parcels that should have been included in the abatement. In August, to resolve the oversight Council considered and adopted a Scrivener's Error that added in those parcels. However, we realized after the fact that the bill number and resolution number that were assigned to the August bill were previously used and thus the bill has not been enacted. The presented resolution is the carbon copy of the resolution that went in front of the Council in August. REGULAR MEETING January 8, 2024 Councilmember Warner, chair of the Community Investment Committee, stated that Resolution No. 24-02 came before the Committee this afternoon, January 81h, 2024, and comes with a favorable recommendation and approved unanimously. Vice -President Niezgodski requests that the petitioner state their name and address and share key points before the council. Erik Glavich, Director of Growth and Opportunity, 14th floor of the County -City Building presented. In December, the Council approved a declaratory resolution for a nine (9)-year tax abatement for the Nexus Center. Pastor Buggs and Doctor Buggs invested time, resources, and money into developing a Community Center. The Nexus Center is on South Main Street near Chippewa Ave. The final phase encompasses about 20,000 square feet total, there are large open spaces in the back of the building in addition to exterior spaces that they will be rehabbing. They will be creating community spaces including a commercial kitchen and an exterior events space. The total private investment will be close to $2.4 million. Once the project is completed the Nexus Center will hire ten new full-time staff with an average wage of twenty dollars ($20) an hour. Dr. Chism Buggs also stated that they have put forth a lot of energy to get to this point in the project and that they are excited to offer new opportunities to the community. We recognize the issues plaguing our city and invested a large amount of their savings to make their home and city better. Councilmember Dr. Davis thanked the Buggs for investing in the South side of South Bend and expressed that it was an honor to vote on this bill. Councilmember White thanked Pastor and Dr. Buggs for their commitment and their ability to stay the course and looks forward to the services that will serve our citizens. Councilmember Lee expressed excitement in this resolution and went into the Nexus Center when it started and saw the vision that Pastor and Dr. Buggs saw. To have a place for mental health and nurse partnership as well as a culture center is exciting. Councilmember Bolden -Simpson thanked Pastor and Dr. Buggs for their service to the community and being models of active citizens. Vice -President Niezgodski expressed that the Nexus Center is wonderful and very welcomed in the 6th district and thanked Dr. and Pastor Buggs. NEW BUSINESS Councilmember Dr. Oliver Davis reminded the committee that they had an orientation this previous Friday and were told the new members were to get a contact list of Department heads. Vice -President Niezgodski will follow up. Councilmember Dr. Oliver Davis asked to be given the exact number -of Minority and Women Businesses. Over the last few years different numbers have been reported and wants clarity. Vice -President Niezgodski thanked Councilmember Dr. Davis will follow up stating that a committee report will be beneficial for everyone. PRIVILEGE OF THE FLOOR Donnie Foster, 132 Chapin Street, South Bend IN 46601, thanked the Council for their hard work. Expressed that the City needs to get people to be more involved. Came before the Council to invite the Council to the Kroc Center from 12 p.m. to 1:30 p.m. to talk about the options of ways in which the public becomes more active in local politics.
