Committee Chair Dr. Oliver Davis called to order the Zoning and Annexation meeting at 5:00
p.m. He gave a brief overview of the agenda and then proceeded to hand the meeting over to
the presenters.
Bill No. 83-23- 603, 607, 611, 617, 619 and 621 West Marion Street Rezoning
Skip Morrell, Zoning Specialist, 14th floor of the County-City Building presented Bill No. 83-23,
the bill states the petition is to rezone the properties of 603, 607, 611, 615, 617 and 621 Marion
Street from Proposed Neighborhood rezoning from NC Neighborhood Center to U3 Urban
Neighborhood. The down zoning from NC to U3 is to allow those cottage courts and a variety of
building types permitted. As the property exists now is vacant lots owned by the Department of

Redevelopment, the proposed is for fifteen (15) units to be built on the properties. The proposal
blends between building developments north of the lots.
Joe Molnar, Property Development Manager, 14th floor of the County-City Building continues
presentation for Bill No. 83-23, stating that the request for the proposal stems back to a request
for proposal from the Redevelopment Commission to solicit vacant land owned by the city for
development proposals to bring new residents to the neighborhoods and business. Developer,
Allen Edwin pledge to keep the residence affordable for workforce housing. Downzoning allows
the development to meet the character of the neighborhood and decrease the number of variances.
Brian Farkas, Director of Workforce Housing with Allen Edwin, 2186 E. Centre Street Portage,
MI 49002, adds that Allen Edwin works in Indiana, Michigan and Ohio. They are excited that the
entire project is staff-led and are excited to work with the City of South Bend.
Chair Dr. Davis thanked Mr. Morrell, Mr. Molnar and Mr. Farkas for the narrative concerning
Bill No. 83-23 and proceeded to open the floor to the Committee for questions and comments.
Chair Dr. Davis asked if the Petitioners could clarify the parking situation for the development.
Joe Molnar, Property Development Manager, 14th floor of the County-City Building
mentioned that there is alley access for street parking.
Brian Farkas, Director of Workforce Housing with Allen Edwin, 2186 E. Centre Street
Portage, MI, 49002 mentioned in the blueprint that there were 12 spots or more as well as
street parking.
Chair Dr. Davis opened the floor to members of the public for questions and comments.
No members of the public made comment.
Chair Dr. Davis entertained a motion send Bill No. 83-23 to full Council.
Committee member Karen L. White motioned to send Bill No. 83-23 to full Council with a
favorable recommendation. Committee member Sheila Niezgodski seconded the motion with a
roll call of number four(4) ayes.

Bill No. 86-23- Special Exception at 3001,3011 and 3015 West Western Avenue
Skip Morrell, Zoning Specialist, 14th floor of the County-City Building presented Bill No. 86-23
3001, 3011 and 3015 West Western Avenue, which requests to allow for a special exception to
allow for vehicle service minor which allows for services like oil changes, alignments, cooling
and electrical systems detailing. It does not include any dismantling and all repairs must be made

within the fully enclosed building.Previously,the property was a window manufacturing business
and then recently as a vehicle repair location until 2017. The building would need to be brought
up to standards. The owner requested slightly reduced setbacks for parking.
Theodoros Arhontas, 2565 Portage Avenue, Las Vegas, Nevada 89120 had technical difficulties
but affirmed Skip Morrell's presentation.
Chair Dr. Davis thanked Mr. Morrell for the narrative concerning Bill No. 86-23 and proceeded
to open the floor to the Committee for questions and comments.
Committee member Niezgodski asked about the window size and if vehicles would be worked
on outside of the interior of the property. As well as what the owner Petitioner Arhontas
commitment on improving the property.
Theodoros Arhontas, 2565 Portage Avenue, Las Vegas, Nevada 89120 plans to continue
renovations to the property. When it was bought five (5) years ago it was nearly abandoned. The
intention was to make the building feasible for businesses. It will take a little time to complete
façade improvements but can make it attractive. It was mentioned that the building is separated
between a warehouse and an old barbershop which they plan to update the façade to match the
zoning.
Committee member White asked about the number of automotive business types on West
Western Avenues,particularly on the west side of Western Avenue.
Tim Corcoran, Director of Planning and Community Resources, 14th Floor County-City
Building, mentions that he is cognizant of the Council's concerns and mentions that the office is
tracking zoning violations and is proactive.
Committee member Tomas Morgan asked for clarification on the variance on the transparency
on the front and the corner façade. Asking if the zoning board approved or denied.
Tim Corcoran, Director of Planning and Community Resources, 14th Floor County-City
variance was denied for the transparency.
Committee member Tomas Morgan asked if there was any requirements for landscaping or
buffering.
Skip Morrell, Zoning Specialist, 14th floor of the County-City Building confirms that there is a
variance for the parking from twelve (12) feet to five(5) feet, so the buffering required is
shrubbery three feet wide from each other.
Tim Corcoran, Director of Planning and Community Resources, 14th Floor County-City
clarified that the current lot is not paved that area will need a hard surface including draining
and landscaping. And they would be required to do so.

Committee member Tomas Morgan expressed concerns regarding the property type.
Encouraged the planning team to diversify developments with developers.
Chair Dr. Davis asked the Petitioner if they will be utilizing that area for parking.

and that they will pave it and put in the buffer zone with the landscaping according to the code
require.
Chair Dr. Davis asked if the Petitioner was planning on doing that if the code still required it.
Tim Corcoran, Director of Planning and Community Resources, 14th Floor County-City
clarified that he would be required to pave and create a buffer zone.
Chair Dr. Davis asked if parking for this project would be brought back to the Zoning and
Annexation Committee.

clarified that it would be a zoning violation that their office would handle.
Chair Dr. Davis opened the floor to members of the public for questions and comments.

Chair Dr. Davis entertained a motion to send Bill No. 86-23 to full Council.
Committee member Niezgodski motioned to send Bill No. 86-23 to full Council with a favorable
recommendation, knowing that the variances will be enforced brought by the South Bend
Planning Commission. Vice-Chair Gooden-Rodgers seconded the motion which carried with a
roll call of number four(4) ayes.
