ORDINANCE NO. ? g.S- 9-- 8 4 AN ORDINANCE FIXING THE ANNUAL PAY AND MONETARY FRINGE BENEFITS OF MEMBERS OF THE SOUTH BEND POLICE DEPARTMENT FOR THE CALENDAR YEAR OF 1985 AND 1986 STATEMENT OF PURPOSE AND INTENT: The South Bend Common Council has responsibility for fixing by ordinance the annual compensation of all members of the Police Department, pursuant to Indiana Code 36- 8- 3 -3(d). Under that authority, the Common Council's Wage Committee and the Wage Committee of the Fraternal Order of Police, Lodge No. 36, held discussions on several occasions concerning annual pay and monetary fringe benefits for sworn members of the South Bend Police Department for calendar years 1985 and 1986. As a result of those decisions, the Common Council adopts in this ordinance the agreement between the parties. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. (a) The South Bend Common Council recognizes the Wage Committee of the Fraternal Order of Police, Lodge No. 36, as the sole bargaining unit for the annual pay and monetary fringe benefits for sworn members of the South Bend Police Department excluding the Police Chief, Division Chiefs, and Captains. (b) The Police Chief, Division Chiefs and Captains of the South Bend Police Department are designated in this ordinance as "Officers." SECTION II. Annual pay for the Officers and other sworn members ot the outh Bend Police Department, by rank, for calendar years 1985 and 1986 shall be as follows, provided, however, that nothing herein shall exclude the applicability of Section III of this ordinance should events set forth therein occur: RANK 1985 1986 Police Chief 30,630.00 31,243.00 Division Chiefs 28,230.00 28,795.00 Captains 26,030.00 26,551.00 Lieutenants 22,630.00 23,052.00 Sergeants 21,630.00 22,052.00 Corporals 20,630.00 21,052.00 Patrolmen First Class 17,750.00 18,172.00 SECTION III. In the event that a Local Option Income Tax becomes effective and tax income from that Local Option Income Tax is received by the City of South Bend in its general fund in 1986, the annual pay for the Officers and other sworn members and recruits of the South Bend Police Department for the calendar year 1986 shall be as follows rather than as listed in Section II, above: RANK 1986 WITH LOCAL OPTION TAX Police Chief 32,162.00 Division Chiefs 29,642.00 Captains 27,332.00 Lieutenants 23,685.00 Sergeants 22,685.00 Corporals 21,685.00 Patrolmen First Class 18,805.00 Recruits 16,538.00 SECTION IV. Additional Pay (a) If a sworn member is subpoenaed to court or has to go to court or is required to appear at any given location to validate a complaint, warrant or recall, and if that sworn member is off duty, the sworn member shall be paid at the rate of time and one -half (1/2) their regularly scheduled pay during a work day, in an amount not less than four (4) hours if they are on their regularly scheduled day off at the time of the required appearance. (b) Any sworn member required to work overtime shall be paid at the rate of one and one half (1 1/2) time their normal rate of pay in an amount not less than one (1) hour for any overtime beyond their normal work day schedule. (c) Each sworn member shall be entitled to receive Sixty -Two Dollars ($62.00) for each of the holidays listed below, whether such holiday is worked or not. Pay for such holidays shall be received during the pay period in which the holiday occurs; however, no holiday shall be paid in advance of its occurrence. Paid holidays: New Year's Day Lincoln's Birthday Washington's Birthday Good Friday Easter Sunday Memorial Day 4th of July Labor Day Columbus Day Veteran's Day Thanksgiving Day Christmas Day (d) Night incentive and hazard pay shall be paid at the rate of Three Hundred Dollars ($300.00) per year. SECTION V. Other Monetary Fringe Benefits (b) Dependent Health Insurance. The annual contribution by the City for dependent health insurance on behalf of sworn members requesting such coverage shall be increased by Two Hundred Sixty Dollars and Thirty -Two cents ($260.32) per member above the amount paid during calendar year 1984. (c) Each sworn member working under the Overtime Foot Patrol Program shall be paid at the rate of Seven Dollars and Fifty cents ($7.50) per hour. SECTION VI. Applicable Terms (a) The first service year for a member of the Police Department commences upon the individual being sworn in before the Board of Safety as a member of that department. The second service year shall begin on the next succeeding first day of January and service years shall continue to increase until the member attains the maximum salary for the particular rank they may hold. (b) Advancement from the rank of Patrolman First Class to Corporal is dependent upon three (3) complete years of service plus a determination of satisfactory performance of duty and promotion by the Board of Safety. SECTION VII. Health Care Insurance Cost Reduction Program There shall be created a Board of Health Care Insurance Oversight, which will operate in an advisory capacity to and under the direction of the City Controller. This Board shall be composed of representatives of the Fraternal Order of Police, Lodge No. 36, and employees of the Department of Administration and Finance of the City of South Bend, together with other employees of the City of South Bend. It shall be the responsibility of the Board to review, under the direction of the City Controller, on a regular basis the activities of the City's Health Care Insurance Program. In addition, in an effort to control health care costs, the City's current health insurance package shall be modified to provide a program containing comprehensive major medical health insurance which would provide for first dollar deductibles of ten percent (10 %) of the cost of such major medical expenses, with maximum annual cost to the employee for such coverage of Five Hundred Dollars ($500.00). SECTION VIII. Sick Leave Cost Reduction Program The following Sick Leave Cost Reduction Program shall be effective on an experimental basis for calendar years 1985 and 1986 and shall apply to all sworn members of the department. This program shall be considered an experiment in encouraging the conservation of sick time and the costs thereof. Effective December 1, 1984, through and including December 1, 1986, sworn members shall be compensated for the conservation of sick time as follows: (a) One (1) day's pay for four (4) unused sick days. (b) Two (2) days' pay for nine (9) unused sick days. The rate of pay for compensation for conservation of sick time in the schedule listed above shall be the then - current rate of pay for the rank of Corporal. Payment shall be made to sworn members for sick time conservation on or before December 15th of each year. The Sick Leave Cost Reduction Program shall not affect the current sick leave policy authorized by the Board of Public Safety. SECTION IX.
