AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS
AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE
OF THE CITY OF SOUTH BEND, INDIANA (Chapter 21,
Municipal Code).
BE IT ORDAINED by the Common Council of the City
of South Bend, Indiana:
Section 1. Ordinance No. 4990 -68, as amended,
which ordinance is commonly known as the Zoning Ordinance
of the City of South Bend, Indiana, be and the same hereby
is Amended in order that the zoning classification of the
following described real estate in the City of South Bend,
St. Joseph County, State of Indiana:
Lot No.8 and Lot No.9, of Wenger and Kreighbaum's
First Addition to the City of South Bend as
recorded April 2, 1948, in Plat Book No.6,Page No.l,
be and the same is hereby established as "D" Light Industrial,
"F" Height and Area.
Section 2. This Ordinance shall be in full force
and effect from and after its passage by the Common Council,
approval by the Mayor and legal publication.

Re: A proposed ordinance and site development plan of Gerald Magers and
Dennis Kring to zone from "B" Residential, "B" Height and Area to "D"
Light Industrial, "F" Height and Area, property located at 501 /503 and
507 East Ohio Street, City of South Bend
Gentlemen:
The above referenced ordinance and site development plan of Gerald Magers and
Dennis Kring was legally advertised November 9 and November 10, 1984. The
Area Plan Commission gave it a public hearing on November 20, 1984 at which
time the following action was taken:
Upon a motion by Rene Vandewalle, being seconded by
Evelyn Clark and unanimously carried, the proposed
ordinance and site development plan of Gerald Magers
and Dennis Kring to zone from "B" Residential, "B"
Height and Area to "D" Light Industrial, "F" Height
and Area, property located at 501/503 and 507 East
Ohio Street, City of South Bend is sent to the Common
Council with a favorable recommendation subject to a
Final Site Development Plan
PLEASE NOTE that the Ordinance has been amended by the petitioner to include a
legal description different than that used for the Common Council's first
reading. The amended Ordinance was the Ordinance legally advertised and heard
by the Area Plan Commission.
The above recommendation is made subject to a final site plan.

Attached, for your consideration in the review of this matter, is a copy of

GERALD MAGERS AND DENNIS KRING #912 -84
501 /503 and 507 East Ohio St., South Bend
November 9, 1984
REQUESTED ACTION: The petitioner is requesting a zone change from
"B" Residential, "B" Height and Area to "D" Light
Industrial, "F" Height and Area to allow for the
expansion of the existing facilities.
EXISTING LAND USE: The property contains the Hydronic & Steam
Equipment facilities.
SURROUNDING LAND USE AND ZONING: Located to the north is a vacant lot zoned
"D" Light Industrial, to the east is a
vacant lot zoned "B" Residential, to the
south across Ohio Street is a vacant lot
zoned "B" Residential; and to the west
across Fellows Street is a single - family
home zoned "B" Residential.
ACCESS: Access to the site is from Fellows Street.
DRAINAGE: The drainage will be handled by three
drywells.
DATA: The total site to be rezoned is 13,068
square feet. Of that, the building will
occupy 3,575 square feet or 27% of the site;
the parking and drives will occupy 7,060
square feet or 54% of the site; and 2,433
square feet or 19% of the site will be open
space.
SITE PLAN:
The site plan is preliminary.
AGENCY COMMENTS: The City Engineer noted that the site
drainage is.adequate and that the drive
widths will need to be shown. The
Department of Redevelopment noted that in
its opinion, the proposed use would not be
an intrusion to the neighborhood.
