Concerns Voiced Over MOA by 6th District Council Member
This morning South Bend Common Council Vice-President Oliver J. Davis attended the 9:30 a.m.
Board of Public Works meeting. He voiced concerns regarding the proposed memorandum of
agreement (MOA) which the City proposed to entered into with the new owners of the former
ethanol plant.
Council Member Davis also noted that other Council Members voiced concerns at yesterday
afternoon's Public Works and Property Vacation Committee meeting, where Public Works
Director Eric Horvath updated the Council Members.
A copy of Council Member Davis's letter to the Board of Public Works is attached.

Dear Members of the Board of Public Works:

First District Greetings. As the Chair of the South Bend Common Council Public Work and Property Vacation
Henry Davis, Jr. Committee and as the Councilman, whose district is being affected by this matter, I am writing
Second District this letter to share my sincere concerns regarding the MOA agreement that is being proposed
between the City of South Bend and the two liquidators who bought the New Energy Corp.
Third District Valerie plant, Maynards Industries and Biditup Auctions Worldwide.
Fred Ferlic My concerns are the following:

David Varner 1. There seems to be no past evidence that any one of these companies has had success in
Fifth District securing an operator in any of their past dealings. If they have, please indicate when that
success has occurred in their past practice.

Sixth District 2. What are the incentives in the MOA for the liquidators to secure an operator for the plant?

At Large 3. The issue of paying$1000.00 a week for security or else the pumps would be turned off is a
concern that was raised by several Common Council members. Please explain this part of
Gavin Ferlic
At Large the agreement, especially in light that there is not incentive to for the liquidators to proceed
in a faster manner in securing an operator.
