Accept transfer of Blackthorn lots from the Redevelopment Authority
Most City owned lots in Blackthorn are in the name of the Redevelopment Authority
(Authority). Since all bonds for Blackthorn are now fully paid, and in a continuation of the
effort to transfer properties to the appropriate City agency, staff has begun the process to
transfer these lots from the Authority to the Commission.
When development opportunities occur, having the properties already transferred to the
Commission will allow for a quicker turn around when closing on the property.
On March 20, a resolution to transfer these lots was approved by the Authority, subject to
Commission approval of this Resolution. Once both bodies approve their respective
resolutions, deeds will be prepared to complete the transfer.
Staff requests approval of Resolution No. 3124, to allow the transfer of the Blackthorn lots
from the Authority to the Commission.

RESOLUTION NO. 3124
A RESOLUTION OF THE SOUTH BEND
REDEVELOPMENT COMMISSION
ACCEPTING THE TRANSFER OF REAL PROPERTY FROM
SOUTH BEND REDEVELOPMENT AUTHORITY
WHEREAS, the South Bend Redevelopment Authority (the "Authority ") is the owner of
certain property identified herein; and
WHEREAS, pursuant to I.C. 36- 1 -11 -8, the Authority, may transfer or exchange
property with another governmental entity upon terms and conditions agreed upon by the two (2)
entities as evidenced by the adoption of substantially identical resolutions of each entity; and
WHEREAS, the South Bend Redevelopment Commission (the "Commission'), the
governing body of the South Bend, Indiana, Department of Redevelopment (the "Department ")
and of the Redevelopment District of the City of South Bend, Indiana (the "Redevelopment
District'), exists and operates under the provisions of I.C. 36 -7 -14, as amended from time to time
(the "Act') and is a body corporate and politic; and
WHEREAS, the Department, by and through the Commission, has presented to the
Authority, a request for the transfer to the Commission of certain real property previously
acquired by the Authority and set forth in Exhibit "A" attached (collectively referred to as the
"Property "); and
WHEREAS, the Authority, desires to transfer the Property to the Commission for the
redevelopment purposes of the Commission; and
WHEREAS, the Authority has adopted a resolution consistent with the requirement of
Indiana § 36-1 -11 -8.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT COMMISSION AS FOLLOWS:
1. The transfer of the following described real property situated in St. Joseph County,
Indiana:
See Exhibit "A"
by the Authority to the Commission, without consideration, shall be, and hereby is, approved and
authorized.
2. The Director of Redevelopment for the City of South Bend shall cause the
recording of each quit claim deed conveying all the right, title and interest of the South Bend
Redevelopment Authority in and to the Property to the City of South Bend, for the use and
benefit of its Department of Redevelopment.
This Resolution shall be in full force and effect upon its adoption.
ADOPTED at a meeting of the South Bend Redevelopment Commission held on March
28, 2013, at 227 West Jefferson Boulevard, Room 1308, South Bend, Indiana 46601.
