ORDINANCE NO. 7_ygs_ gy AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 16, ARTICLE 2 OF THE MUNICIPAL CODE OF SOUTH BEND STATEMENT OF PURPOSE AND INTENT: In order to meet the rising costs for collection and disposal of garbage and trash by the City, the Common Council finds it necessary to increase the fees for such service. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend as follows: Section I. The fees established in Chapter 16 Article 4 Section 6 of the Municipal Code of South Bend shall be amended as follows: Sec. 16 -6. Garbage and trash collections: City fees, manner of collection; private party responsibility. (a) Every owner, occupant or lessee of any building, house or structure on grounds where garbage and trash accumulate shall provide for the collection and disposal of trash and garbage from his premises at least once a week. (b) The City shall not collect and dispose of garbage or trash from any residential unit unless said collection and disposal is requested by the owner, occupant, tenant or lessee of the residential unit, except as provided for in section 16 -56. (c) The City shall charge for the collection and disposal of garbage and trash according to the following schedule: (1) One- family dwelling with no limit on number of bags and bundles: dollars and fifty cents ($5.50) per month. (2) One- family dwelling where the head of the household has submitted to the Board of Public Works proof of age sixty -five ( 65) or over: Zw-o -dol- a-rz- and- three dollars and fifty cents ($3.50) per month. (3) Two - family dwelling with no limit on containers and bags: six dollars ($6.00) per month. (4) Three - family dwelling with no limit on number of containers and bags: eight dollars ($8.00) per month. (5) Four - family dwelling with no limit on number of (6) Pickup of appliances, furniture and other miscellaneous items : -ev-ee X0 -13a- s- -acrd- M-il muffr- -fig-r- -of re- -aid- tw-o- - d- o- l-la. -na- and- X if-Y- -c-e4 s -(-$-2--5-0-)- T tyt- - ad- d7i -t--( - -1- rieeez Appliances, furniture and other miscellaneous items will be picked up as a part of the regularly scheduled solid waste collection at no additional charge to the city solid waste customer, provided that no special equipment is required to make the pick -up. Pick -up of such items which, in the opinion of the manager of the Bureau of Solid Waste, require special equipment or special scheduling, or pick -up requested by individuals who are not city solid waste customers shall be subject to the following charges: Eight dollars and fifty cents .50 minimum for one piece and three dollars and fifty cents 3.50 for each additional piece. (d) Charges for City collection of garbage and trash shall be added to the residential unit's water meter charges and collected as are bills for water services. (e) It is the responsiblity of the owners, occupants or tenants of abutting property to keep all alleys used by any sanitation vehicles clean, orderly and passable at all times. Section II. Increased costs to provide service compounded by the length of time since our last rate increase necessitates a change be made. We are, therefore, requesting the rates be increased by an amount of $1.00 per customer per month. For a residential customer the new rate will be $5.50 per month and for customers over sixty -five (65) years of age the cost will be $3.50 per month. One change in collection procedure will be free pick -up of appliances, furniture, etc, for South Bend Solid Waste customers. If you have any questions please contact me at your convenience.
