GAMMON �9 Clerk ORDINANCE NO. 7484 -85 AN ORDINANCE ESTABLISHING A NEW SCHEDULE OF RATES AND CHARGES FOR SERVICES RENDERED BY THE WATERWORKS OF THE CITY OF SOUTH BEND BY AMENDING CHAPTER 17, ARTICLE 4 OF THE MUNICIPAL CODE OF SOUTH BEND. STATEMENT OF PURPOSE AND INTENT: The Common Council of the City of South Bend, Indiana, last established a schedule of rates and charges for services rendered by the Waterworks of the City of South Bend by Ordinance No. 6829 -80, adopted September 15, 1980. Based on a recent cost of service analysis prepared by certified public accounts, the Board of Waterworks Commissioners has recommended to the Common Council that a revenue increase is necessary to maintain a sound financial condition for the Waterworks by providing sufficient working capital. Since the City has an obligation to provide and maintain reasonably adequate service and facilities for supply and distribution of water to users of the water service the Common Council now finds that it is necessary that charges for services by the South Bend Waterworks be increased in order to meet its obligations. It is the intent and purpose of this ordinance that the rates established herein be applicable to all users of water furnished by the waterworks of the City of South Bend, including, but not limited to, the users of the South Bend - Clay waterworks facilities, and that the City of South Bend proceed to establish rates to be approved by the Public Service Commission providing for a pro rata increase in rates in conformity with this ordinance for the South Bend - Clay waterworks facilities users applying the tracking procedure as approved by the Public Service Commission of the State of Indiana. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. Chapter 17, Article 4, Section 45 of the Municipal Code of South Bend shall be amended as follows: Sec. 17 -45 Water Rates Established; amounts. The Common Council shall review on a regular basis all rates and charges established pursuant to this Article. Said review shall be conducted at aJ_ae� no less than four -year intervals, beginning with four (4) years from the effective date of this Section. The Water Utility Director shall file all pertinent data needed by the Council, on or before June lst of the year in which the rates and charges shall be reviewed. Section II. Chapter 17, Article 4, Section 45.1 shall be amended as follows : Sec. 17 -45.1 Charges for family dwelling unit located within apartment complex, hotel, etc. There shall be, and are hereby established for the use of and the services rendered by the water works system of the City of South Bend, for a family dwelling unit located in an apartment complex, hotel or motel, or mobile home park, the following rates and charges: A minimum charge shall be levied for each family dwelling unit located in an apartment complex, hotel or motel or mobile home park of three dollars ($3.00) per month per family dwelling unit, or of the metered cubic feet consumption for the apartment complex, hotel or motel or mobile home park as computed in accordance with section 1- 4� 17-45, whichever is greater. Section III. This ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor, legal publication, and approval by the Public Service Commission of Indiana. The existing rates and charges of the Waterworks of the City of South Bend shall continue in effect until the ordinance is approved by the Public Service Commission of Indiana. Based on this study they have recommended a 5.2% rate increase be initiated. The Board of Water Works Commissioners after careful review of the documentation has agreed with the recommendation. The Water Works Commissioners passed a resolution on June 17, 1985, approving the 5.2% increase and recommending that the South Bend Common Council concur in their decision. Upon passage by the Council the proposed rates will be forwarded to the Public Service Commission of Indiana for final approval. The 5.2% revenue increase will insure that the Water Utility is maintained in sound physical and financial condition. If you have any questions please contact me at your convenience.
