AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68,
AS AMENDED, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
(Chapter 21, Municipal Code).
Indiana: BE IT ORDAINED by the Common Council of the City of South Bend,
Section 1. Ordinance No. 4990 -68, as amended, which ordinance is
commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be
and the same hereby is amended in order that the zoning classification of the
following described real estate in the City of South Bend, St. Joseph County,
State of Indiana:
Lots 6 and 7 in Bergan's Replat of Lots
Numbered 2, 3 and 4 of M. E. Listenberger's
First Addition to the City of South Bend,
and the vacated alley lying between Lot 1
of M. E. Listenberger's First Addition to
the City of South Bend and Lots 1 and 6 of
Bergan's Replat of Lots Numbered 2, 3 and 4
of M. E. Listenberger's First Addition to
the City of South Bend, also known as 1117 and
1121 E. Corby Street,
be and the same is hereby established as C Commercial zoning classification
and E Height and Area District.
Section 2. This Ordinance shall be in full force and effect from
and after its passage by the Common Council, approval by the Mayor and legal
publication.

PETITION TO REZONE REAL ESTATE
We, the undersigned, make application and petition the
Common Council of the City of South Bend, Indiana to amend the
zoning ordinance as herein requested.
1. The property sought to be rezoned is located at:
1117 and 1121 E. Corby Street, South Bend, Indiana,
being Lots 6 and 7 in Bergan's Replat of Lots
Numbered 2, 3 and 4 of M. E. Listenberger's First
Addition to the City of South Bend.
2. Name and address of all property owners:
Richard T. Kruk and Neoma F. Kruk
1830 Inwood Rd.
South Bend, IN 46614
3. It is desired and requested that this property be
rezoned from B Residential, to C Commercial.
4. This rezoning is requested to allow the following
uses:
To allow the area to be used as a construction site
for an addition to, and as a parking site for, the
gasoline service station known as Dick's Standard
Service Station, 1102 South Bend Avenue, South
Bend, Indiana.
5. Attached is a copy of (a) legal description of the
property; (b) a list of names and addresses of all
property owners within 300 feet of the petition
property; (c) a site plan; and (d) addressed,
stamped envelopes of all property owners within
300 feet of the petition property.

RE: A proposed ordinance and site development plan of Richard T. and Neoma F.
Kruk to zone from 11131' Residential, "A" Height and Area to "Cr' Commercial,
"E" Height and Area, property located at 1117 and 1121 E. Corby Street,
City of South Bend
Gentlemen:
The above referenced ordinance and site development plan of Richard T. and
Neoma F. Kruk was legally advertised June 7, 1985. The Area Plan Commission
gave It a public hearing on June 18, 1985, at which time the following action
was taken:
Upon a motion by Joseph Serge, being seconded by C. J.
Witz and unanimously carried, the proposed ordinance
and site development plan of Richard T. and Neoma F.
Kruk to zone from 116" Residential, "A" Height and Area
to "C" Commercial, "E" Height and Area, property
located at 1117 and 1121 E. Corby Street, City of South
Bend is sent to the Common Council with a favorable
recommendation subject to a Final Site Development Plan
showing a detailed screening plan per the South Bend
Municipal Code
PLEASE NOTE that the Ordinance has been amended by the petitioner to include a
Height and Area designation different than that used for the Common Councils
first reading. The amended Ordinance was the Ordinance legally advertised and
heard by the Area Plan Commission.
The above recommendation is made subject to a final site plan showing a
detailed screening plan per the South Bend Municipal Code.

Attached, for your consideration In the review of this matter, Is a copy of the
Area Plan Commission's Staff Report.

REQUESTED ACTION: The petitioners are requesting a zone change from
"B" Residential, "A" Height and Area, to "C"
Commercial, "E" Height and Area to allow for the
addition of an attached car wash to an existing gas
station, and the construction of a parking lot.
EXISTING LAND USE: The property is vacant.
SURROUNDING LAND USE AND ZONING Located to the north is a parking area for the gas
station zoned "C" Commercial, to the east Is a
single- family home zoned "B" Residential, to the
south across Corby Street are single - family houses
zoned "A" Residential, and to the west is the gas
station zoned "C" Commercial.
ACCESS: Access to the site will be from the existing gas
station parking lot, with an exit onto Corby Street.
DRAINAGE: Storm water drainage will be handled by drywells.
DATA: The total site to be rezoned Is 6,535 square feet.
Of that, the buildings will occupy 728 square feet
or 11.2% of the site; the parking and drives will
occupy 5,807 square feet or 88.8% of the site.
SITE PLAN: The site plan is preliminary.
AGENCY COMMENTS: The City Engineer made the following comments:
"1. City water and sanitary sewer available
to site.
2. Site drainage must be addressed. Must
contain storm water at a rate of 30
gallons /100 sq. ft. of roof and paved
areas.
3. Parking is sufficient."
