Cottrell and Board Members Eddie Miller, John Collins, and Luther Taylor present. Board member Laura Vasquez was absent. Also present was Fire Chief Stephen Cox, Police Chief Ronald Teachman, and Attorney Andrea Beachkofsky. ADDITION TO THE AGENDA Ms. Beachkofsky noted the addition to the agenda of the Findings of Fact regarding Charges No. 2013 -02, Patrolman Jeff McKee. Board members discussed the following agenda items: - Letter from Common Council Ms. Beachkofsky informed the Board that she distributed a copy of the Whistleblower Ordinance for their review. She stated the Board needs to respond to Councilman Davis's letter regarding their position on this process. - Permanent Promotion — Fire Department Fire Chief Stephen Cox stated the Fire Department started doing Captain promotions the same as the Police Department last year. The process is to promote to Special Assignment for one year, after which time a review is done. He noted that former Fire Chief, Howard Buchanon, promoted Rob Rose to Special Assignment without going through the Board of Safety last year. Mr. Rose has requested that his promotion now be approved by the Board of Safety and will be present for the pinning of his badge along with Mike Schmuhl, Chief of Staff, Mayor's office, Ms. Beachkofsky stated Mr. Rose filled a vacancy that occurred a year ago. Chief Cox noted Mr. Rose has done an exemplary job. - Monthly Statistical Analysis — January 2013 — Fire Department Fire Chief Stephen Cox noted that the property damage statistics show a tremendous difference from 2012 to 2013. He explained that this is due to a large commercial fire at the Jefferson Apartment complex, which incurred over $1,000,000.00 in damage. - Annual Statistical Analysis — 2012 — Fire Department Fire Chief Stephen Cox stated 2012 property damage statistics were notably higher due to a couple of commercial fires including the Jefferson Apartment Complex, Hurwich Farms Apartment Complex, and the Plumrose Meat Packaging Plant. He noted, however, that the numbers of EMS calls are almost the same numbers as 2011. Chief Cox stated that the pattern over the last ten (10) years has been a significant climb in these statistics, so this is fantastic for the City. He noted that they are utilizing the same number of EMS people and equipment. A summary is as follows: Annual Annual 2011 2012 STRUCTURE FIRES Property Damage -- Buildings & Contents (Estimates) $3,190,766.00 1 $3,723,353.02 INSPECTIONS (Fire Prevention/Ins ection Bureau) 3,553 Inspections 3,325 Total Inspections (1,822 Re-Inspections) (1,080 Re-Inspections) INVESTIGATIONS (Police /Fire Arson Bureau 251 214 Investigations Investi ations 40 34 Arson Arson POLICE DEPARTMENT ACCEPT AND APPROVE PROMOTIONS - TYLER DONLON - ANDREW HINES - DEVONJOHNSON - ERIC MENTZ - DANIEL NAPOLITAN - TIMOTHY TAYLOR In a letter to the Board, Chief Teachman recommended that Patrolmen 2nd Class, Tyler Donlon, Andrew Hines, Devon Johnson, Eric Mentz, Daniel Napolitan, and Timothy Taylor be promoted to the rank of Patrolman 1" Class effective March 10, 2013. Chief Teachman stated in his letter that all of the candidates have met the requirements of the application process of the South Bend Police Department. Upon a motion made by Mr. Miller, seconded by Mr. Collins and carried, the recommended promotions were approved. TABLE RESPONSE TO LETTER FROM COMMON COUNCIL President Cottrell stated the Board has reviewed the letter regarding the Whistleblower Protection Ordinance, and the Board's policy on this issue, from Councilman Oliver Davis, dated September 20, 2012. He asked Mr. Davis if he had any further comments, or new additions regarding his letter. Councilman Davis stated he may need to restate the Council's position due to learning that new legislation has come out since last year that may affect the position of the Council. He noted, however, his letter correctly states the issue. Ms. Beachkofsky questioned what new legislation? Mr. Davis stated he was informed by the Common Council legal counsel that something on a local level may need to be revised to meet new State legislation. Ms. Beachkofsky stated she was not aware of any new legislation that has come out regarding the Whistleblower Policy. She questioned if it was State or Federal law? Mr. Davis stated he was not sure, he was just informed that new legislation has come out that may affect local law. Ms. Beachkofsky stated that IC 36 -1 -8 -8 is the current law that protects employees and covers the Board of Safety. She noted it includes protocols that any employee of the City would need to invoke. She stated the Council approved their local ordinance that mimics the State law, however local law doesn't pre -empt State law. President Cottrell questioned the need for anything in addition to State law at this point then. Mr. Davis stated it was his understanding that we do need local law and offered to find out what new changes in law have occurred and forward copies to the Board members if they didn't mind waiting. President Cottrell state he would suggest tabling this matter until more information could be obtained. Upon a motion by Mr. Taylor, seconded by Mr. Collins and carried, the response to Councilman Davis's letter was tabled until the next regular meeting of the Board of Safety. Ms. Beachkofsky stated she would review State legislature and confirm and get a copy to the Board members. She noted it is probably best to see the local level deal with an issue before it goes to the State level. FILING OF QUARTERLY REPORT FOR SPECIALIZED TRAINING — OCTOBER NOVEMBER, AND DECEMBER 2012 REGULAR MEETING FEBRUARY 20. 2013 22 Captain Dave Hecklinski, Training Division, South Bend Police Department, submitted to the Board a written Quarterly Report for Specialized Training for the period of October, November, and December 2012. The report indicated the specialized training attended; the names of the officers who attended; and the costs involved. Chief Ronald Teachman stated that beyond the report, he would like to inform the Board that training will be his priority as the new Chief. He stated the Police Department will focus on training of first line supervisors, which has not been done in the past; expanding training to low cost or no cost, online and webinar training; and working with other departments such as the Prosecutor's Office to utilize their resources for training. There being no questions concerning this report, the Quarterly Report for Specialized Training as submitted was accepted and filed. FILING OF MONTHLY STATISTICAL ANALYSIS REPORT — JANUARY 2013 Police Chief Ronald Teachman stated the process of filing Monthly Reports will continue, but he has some concerns about the future reporting. He noted what these reports reflect is sometimes not what is actually happening in our community, but what is being reported to the Police Department. In certain crimes, he added, what is reported is consistent with what has happened, such as in murder. In sexual assault cases, often it is just what is reported that is being shown, not the actual number of cases of sexual assault; many go unreported. In his former position as Chief of Police in another City, Chief Teachman explained, they worked closely with women's centers and developed programs to help victims of sexual assault come forth and report the crimes. He stated he is hoping to work on a similar program, adding more female Police officers to work with female victims, but he noted this may result in an increase in crime statistics due to increased reporting. Mr. Cottrell indicated that unless there were questions or objections by members of the Board, the statistical analysis report for the month of January, 2013, as submitted by the Police Department, would be accepted for filing. There being no objections, the following report was accepted for filing: APPROVE FINDINGS OF FACT — CHARGES NO. 2013 -02 — JEFF MCKEE On January 9, 2013, former Police Chief Charles Hurley filed disciplinary Charges against South Bend Police Officer Jeff McKee, pursuant to I.C. 36-8-3-4. On January 18, 2013, Patrolman McKee accepted his charges and did not request a Hearing of the Board. Therefore, the Board is now presenting its Findings of Fact regarding the Charges, for approval. Upon a motion by Mr. Miller, seconded by Mr. Collins and carried, the Findings of Fact were accepted and the Board of Public Safety found that for his actions, Officer Jeff McKee shall be suspended from the South Bend Police Department for twenty-one (21) consecutive calendar days without pay, with a starting date to be determined by Police Chief Teachman.
