ORDINANCE NO. 7441_.&s- AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 4 OF THE MUNICIPAL CODE OF SOUTH BEND AT SECTION 4-22 REGULATING THE LICENSING OF CARNIVALS AND CIRCUSES STATEMENT OF INTENT AND PURPOSE: The Common Council believes it is in the best interest of the City of South Bend to amend Section 4-22 of the South Bend Municipal Code providing for the licensing of carnivals and circuses to include an exemption from certain zoning regulation for carnivals and circuses held on the county fair grounds by certain not-for-profit organizations . NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend , Indiana, as follows : SECTION I. Section 4-22 of the Municipal Code of the City of South Bend , Indiana, is amended at subsection (k) to read as follows : Section 4-22 (k) . (k) Exemptions . The provisions of this section shall not apply to carnivals or circuses connected with and exhibited upon the grounds used by a county fair association association during the time any association is conducting a county fair in the City. The zoning restrictions of subsection (e) shall not apply to carnivals or circuses held on the St. Joseph County Fair Grounds provided that they meet the requirements of Section 21-112 of this Code and have been approved by the City Board of Zoning Appeals pursuant to Sections 21-110 and 21-ill of this Code . SECTION II. This ordinance shall be in full force and effect from and after its passage by the Common Council , approval by the Mayor and legal publication. Beverlie Beck President South Bend Common Council 4th Floor County City Building South Bend , Indiana 46601 Re: Circus Licensing Ordinance Amendment Dear Beverlie : Attached for filing is a proposed amendment to §4-22 of the South Bend Municipal Code regulating the licensing of carnivals and circuses . - Currently the Ordinance permits carnivals and circuses to be held on the county fair grounds only if they are connected with the county fair itself. The proposed ordinance amendment would allow carnivals and circuses sponsored by certain not-for-profit groups to be held on the fair grounds if they meet the requirements of §21-112 of the Code and if they have been approved by the City Board of Zoning Appeals pursuant to §§ 21-110 and 21-111 of the Code . This change is being submitted in order to clarify the authority of the County Fair Association to lease their property for certain events and to provide a reasonable location for use by certain not-for-profit organizations in sponsoring those events.
