GAMMON Approved and signed by me 1\-'1Aeal 27 1985 lett. 11--4/1Y- Mayor • ORDINANCE NO.7 5'- g'5 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING ARTICLE 9 OF CHAPTER 20 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS "MOBILITY HANDICAPPED PARKING" In 1978, the Common Council passed legislation which has assisted mobility handicapped persons in their access to parking. Presently the local ordinance permits persons with "Disabled Veteran Registration Plates", "Special Registration Plates", or "South Bend Handicapped Parking Permits" to legally park in locations designated for the exclusive use of mobility handicapped persons. The Council recognized that there are several commercial operations who transport handicapped individuals for a fee, who are prohibited from using such handicapped parking spaces because they do not meet one (1) of the three (3) classes of "Qualified Persons". The Council believes that these handicapped individuals who are transported by commercial vehicles designed for the handicapped, should also have the right to utilize designated handicapped parking spaces. This bill incorporates the appropriate amendments which are believed to be in the best interest of the City. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. Article 9 of Chapter 20 of the Municipal Code of the City of South Bend, Indiana, is amended in part as follows: Article 9. Mobility Handicapped Parking. Section 20-110 Qualified Persons. (c) South Bend Handicapped Parking Permit. ..A..person-or `authorized 'commerical.vehicle -specifically designed to transport mobility- handicapped persons -for- a fee, who have been—issued a handicapped parking permit by the City bearing the permit number, permit holder's name, signature of the authorizing City official(s) , and the official international wheelchair symbol or a reasonable facsimile thereof shall be entitled to all of the parking privileges authorized by this Article. Section 20-111 Application and Permit Process. (c). (2 ) Whether the applicant is an individual, partnership or corporation. If an individual, the name and business and residence address of the applicant shall be given; if a partnership, the name and business and residence address of each partner shall be given; if a corporation, the name, date and state under which such corporation was organized, and the name and business address, resident agent, and a copy of the Certificate of Incorporation. (3 ) Number of vehicles which are specifically designed to transport mobility handicapped individuals which are owned and/or leased by the applicant; listed by year, make, license plate number of vehicle, and commercial marking on vehicles which would display the permit. (4 ) Written Proof of Liability Insurance. (5 ) An annual fee of twenty-five ( $25. 00 ) dollars. (43)- (d) Within thirty ( 30 ) days of filing a complete application form with the Board of Public Works, the Board shall instruct the City Controller 's office to issue a South Bend Handicapped Parking Permit to the applicant if it is found that the material facts of the application are true. In the case of commercial applications, South Bend Handicapped Parking Permits shall be issued to applicants conforming with the provisions of this Article, and shall be issued in the following number: Number of Vehicles Specially Designed to Transport Handicapped Persons Maximum per Business Permits Allowed 1 1 2 3 3 4 5 5 Over 5 6 -( )- (e) Upon the issuance of such permit by the City Controller' s office, the permit shall be displayed in the front windshield of the driver' s side, by the permit holder. (f ) Commercial businesses issued permits under this Article shall be permitted to use designated parking places only when in the process of loading or unloading mobility handicapped individuals. -(-e-)- (g) Any permit issued pursuant to this Article shall expire on December 31st of the year issued. SECTION II. This Ordinance shall be in full force and effect from and after its passage by the Common Council and approval of the Mayor, and legal publication. At Large K.CEKANSKI-FARRAND Under current provisions, only individuals who have Council Attorney met the current standards requiring a written certificate from a licensed physician may obtain a local permit. I have been contacted by commerical businesses engaged in transporting mobility handicapped individuals . They believe as I, that they should be able to apply for a permit so that they can transport and pickup handicapped individuals by using handicapped parking spaces. Currently such commercial vehicles can only use loading zones , which in many instances are farther away than the designated handicapped parking areas. I believe that the attached amendments are reasonable and in the best interests of our citizens. I look forward to discussing this bill with you and to seek your support.
