ORDINANCE 7434-85
AN ORDINANCE APPROPRIATING FUNDS IN THE AMOUNT OF
$20, 000. 00 FROM THE GENERAL PARK FUND TO THE PARK
MAINTENANCE FUND . 01 TO BE USED TO SUPPLEMENT THE
1985 PARK MAINTENANCE BUDGET.
STATEMENT OF PURPOSE AND INTENT:
WHEREAS, the Department of Public Parks has a surplus of funds
(20, 000 . 00 ) in the General Park Fund because of monies saved from the
1984 Park Maintenance Budget and higher than anticipated miscella-
neous revenue received in 1984 which funds revert to General Park
Fund at the end of the calendar year and,
WHEREAS, it has been ascertained that a fence is needed along the
entire length of the East Race for the safety of all persons visiting
the East Race and,
WHEREAS, the Department of Public Parks does not have funds
budgeted in the 1985 budget or the 1982 Park Bond Issue for the
purchase and erection of such a fence.
NOW, THEREFORE BE IT ORDAINED by the South Bend Common Council,
as follows :
SECTION I. That $20, 000. 00 be appropriated out of the General
Park Maintenance Fund . 01 to supplement the 1985 Park Maintenance
budget as follows :
01. 0399 Other Contractuals $20, 000. 00
$20, 000. 00
SECTION II. The appropriation of funds set forth above is
required for the proper and efficient operation and function of the
Department of Public Parks of South Bend and an extraordinary
emergency is declared to exist concerning the foregoing
appropriation.
SECTION III. This ordinance shall be in full force and effect
from and after its passage by the Common Council, its approval by the
Mayor and approval by the State Board of Tax Commissioners.

Dear Council Members,
After a season of operation of the East Race Waterway it has become
apparent that a fence is needed along the entire length of the East Race
to protect persons from falling into the rapid flowing waters of the Race.
I would like to have the fence erected before we open the East Race
in 1985 and would request the Council to approve the enclosed ordinance
appropriating $40,000.00 from the General Park Fund to Account #0399.0,
Other Contractual Services.
The Park Department had a balance left in our 1984 budget which by
state law reverts into the General Park Fund which could be used to finance
the costs of erecting the fence. I am very much concerned about the
aesthetics along the East Race and feel the proposed fence will not detract
from the environment. We have installed a small section of the fence at
the flood gates for review.
Your approval of this ordinance will be appreciated.
