GAMMON Approved and signed by me 7`— / 7__ 1 9 Mayor ORDINANCE NO. 7 V3/-ec AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE BOUNDARIES OF THE CITY OF SOUTH BEND, INDIANA, CERTAIN REAL ESTATE LOCATED WITHIN PENN TOWNSHIP, ST. JOSEPH COUNTY, INDIANA STATEMENT OF PURPOSE AND INTENT A petition for the voluntary annexation of property located in Penn Township, St. Joseph County, Indiana, has been filed by the owner of One Hundred Percent ( l00%) of the territory to be annexed, said owner being Hilltop Lutheran Church of the Ascension Inc. Hilltop Lutheran Church of the Ascension, Inc. operates a church facility which is physically located on land which is partially already within the boundaries of the City of South Bend and partially on land described in this ordinance . The City of South Bend furnishes water and police protection to the facility, however , because of the location of the building annexation is necessary to clear up existing confusion as to responsibility for police and fire protection. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA Section 1 . That the petition for voluntary annexation executed by Hilltop Lutheran Church of the Ascension, Inc. , an Indiana not-for-profit corporation, for annexation of certain territory to the City of South Bend , be incorporated herein and made a part hereof and marked as Exhibit "A" attached. Section 2 . That the real estate petitioned to be annexed is located in St. Joseph County, Penn Township, Indiana, is contiguous to the boundaries of the City of South Bend, is owned wholly by Hilltop Lutheran Church of the Ascension, Inc. , and is described as follows : The South 10 acres of the North half of the West 30 acres of the South half of the North West one quarter of Section 29 Twp. 37 North Range 3 East Penn TWD. . St. Joseph and said real estate is now hereby annexed to and brought within the City of South Bend. Section 3. This ordinance shall be in full force and effect from and after its enactment , approval by the Mayor , and legal publication. 'em.er of the /. on Council PETITION FOR VOLUNTARY ANNEXATION The undersigned, for its petition for annexation to the City of South Bend, Indiana, hereby states that: 1 . Petitioner is the sole owner of a portion of real estate located in St . Joseph County, Indiana, and described as follows : The South 10 acres of the North half of the West 30 acres of the South half of the North West one quarter of Section 29 Twp. 37 North Range 3 East Penn Twp. , St. Joseph County, Indiana 2 . It is the operator of a church known as Hilltop Lutheran Church of the Ascension, Inc. and has constructed a church building on said real estate , which building has been furnished municipal services including water and police protection. 3 . A portion of the real estate on which the church building is situated was previously annexed into the City of South Bend, thus creating confusion as to the responsibility for police and fire protection. 4. The real estate described herein is contiguous to the City of South Bend pursuant to requirements of State statutes . WHEREFORE , the undersigned petitions the Common Council of the City of South Bend that the territory owned by it and described herein be annexed to the City of South Bend.
