AMENDMENT TO OWNER -ENGINEER AGREEMENT Amendment No. 1 1. Background Data: a. Effective Date of Owner -Engineer Agreement: August 23.2022 b. Owner: Board of Public Works, City of South Bend, IN C. Engineer: Jones Petrie Rafinski Corporation d. Project: COSB Project No. 122-043, COSB Guardrail and Handrail Improvements Project 2. Description of Modifications: a. The Scope of Services currently authorized to be performed by Engineer in accordance with the Agreement and previous amendments, if any, is modified as follows: 1) Combining the COSB Guardrail Installation and Replacement Project and the COSB Handrail Installation Project from separate contract documents as already prepared under separate COSB project numbers into a single set of contract documents. Among the related additional services was the complicated listing of MBE/WBE goal percentages by the separate divisions of the combined projects. 2) Revising the project bid deadline date at the many parts of the contract documents. 3) Due to the result of no bidders submitting bids for the initial bidding of the combined projects, the revising of the new bid deadline for the re -bidding of the combined projects is necessary to be done as part of additional services. Adjusted Agreement amount: $ 39,818.00 The foregoing Agreement Summary is for reference only and does not alter the terms of the Agreement, including those set forth in Exhibit C. Owner and Engineer hereby agree to modify the above -referenced Agreement as set forth in this Amendment. All provisions of the Agreement not modified by this or previous Amendments remain in effect.
