ORDINANCE AMENDING CHAPTER TWO, ARTICLE XIII
OF THE SOUTH BEND MUNICIPAL CODE BY ADDING
AN ADDITIONAL ECONOMIC DEVELOPMENT TARGET AREA
THERETO, COMMONLY KNOWN AS 2920 W. SAMPLE STREET.
STATEMENT OF PURPOSE AND INTENT:
The 1983 Indiana General Assembly amended I.C. 36-7-12
to provide at I.C. 36-7-12-38 for the designation of economic
development target areas by the Common Council upon favorable
recommendation of the Economic Development Commission.
I.C. 36-7-12-2 provides that the statutory exclusion of
a facility as an "economic development facility" will not be
applicable in the case of a facility to be located in an
economic development target area if the fiscal body of the
governmental unit in question finds that the proposed facility
will not have an adverse competitive impact on other facilities
of the same kind already operating in the same market area, and
if the proposed facility will contribute significantly to the
creation of permanent new job opportunities.
NOW, THEREFORE, BE IT ORDAINED BY THE SOUTH BEND COMMON
COUNCIL, as follows:
SECTION I. The South Bend Economic Development
Commission has recommended favorably the designation of an
additional geographic area within the City of South Bend as an
economic development target area.
SECTION II. Chapter 2 of the South Bend Municipal Code
shall be amended to add an additional subsection to Article 13,
"Economic Development Target Areas" as follows:
Article 13. Economic Development Target Areas.
Section 2-151. Pursuant to I.C. 36-7-12-38, the
following specific geographic territories of the City of South
Bend shall be economic development target areas:
d. The area commonly known as 2920
W. Sample Street.
SECTION III. The specific geographic area designated
above as AND economic development target area is more
particularly described as follows:
A lot or parcel of land in the Northwest Quarter of the
Northwest Quarter of Section Fifteen (15) , Township
Thirty-seven (37 ) North, Range Two (2 ) East, described
as follows, to-wit: Beginning on the South line of
Sample Street in the City of South Bend, Indiana, at a
point 330 feet East and 35 feet South of the Northwest
corner of said Section 15; thence East along the South
line of Sample Street 400 feet; thence South a distance
of 536.78 feet more or less to the Northerly right of
way line of the New Jersey, Indiana and Illinois Rail-
road; thence Southwesterly along said Northerly right
of way line of the New Jersey, Indiana and Illinois
Railroad 437 .58 feet more or less to a point due South
of the place of beginning; thence North 714.1 feet more
or less to the place of beginning.
ALSO, a lot or parcel of land in the Northwest Quarter
of Section Fifteen (15) , Township Thirty-seven (37 )
North, Range Two (2 ) East in the City of South Bend,
St. Joseph County, Indiana described as beginning 35
feet South and 165 feet East of the Northwest Corner of
Section 15, Township 37 North, Range 2 East, which
beginning point is on the South line of Sample Street;
thence East (bearing assumed) 165 feet along the South
line of said Sample Street; thence South zero degrees
04 minutes West 714.01 feet to the Northerly
Right-of-Way line of the New Jersey, Indiana and
Illinois Railroad Right-of-way; thence South 65 degrees
59 minutes 50 seconds West 251.6 feet along said
Northerly Right-of-way; thence North zero degrees 02
minutes 50 seconds East 587 .24 feet to a point 229 feet
South and 65 feet West of place of beginning; thence
North 89 degrees 50 minutes 50 seconds East 65 feet;
thence North zero degrees 02 minutes 50 seconds East
229 feet to place of beginning.
EXCEPTING THEREFROM, A parcel of land being a part of
the Northwest Quarter of Section Fifteen (15) , Township
Thirty-seven (37 ) North, Range Two (2 ) East in the City
of South Bend, St. Joseph County, Indiana, described as
follows:
Starting at a point 35 feet South and 165 feet East of
the Northwest corner of Section 15, Township 37 North,
Range 2 East which point is on the South line of East
Sample Street; thence South 0 degrees 2 minutes 50
seconds West, 229 feet to the true point of beginning
for this description; thence continuing as an extension
to the last described line South 0 degrees 2 minutes 50
seconds to the Northerly right-of-way line of the
Norfolk and Western Railroad (N.J.I. and I.R.R. ) ;
thence South 65 degrees 59 minutes 50 seconds West in a

Southwesterly direction along the railroad right-of-way
to a point which is 109.4 feet Northeasterly as
measured on said railroad right-of-way from the West
line of Section 15, Township 37 North, Range 2 East;
thence North 0 degrees 2 minutes 50 seconds East,
587.24 feet to a point (which point is 264 feet South
and 100 feet East of the Northwest corner of said
Section 15) ; thence North 89 degrees 50 minutes 50
seconds East, 65 feet to the point of beginning.
SECTION IV. Pursuant to the requirements of I.C.
36-7-12-2 the Common Council hereby finds that the facility to
be located at 2920 W. Sample Street will not have an adverse
competitive impact on other facilities of the same kind already
operating in the same market area and will contribute
significantly to the creation of permanent new job
opportunities.
SECTION V. This ordinance shall be in full force and
effect from and after its passage and signature by the Mayor.

Re: Designation of 2920 W. Sample Street
as an. Economic. Development_ Target_ Area
Dear Council Members:
GEM Partnership, an Indiana partnership, respectfully
requests that the property for which it seeks the issuance of
economic development revenue bonds be declared an Economic
Development Target Area.
An inducement resolution regarding this project was
previously filed with the South Bend Economic Development
Commission and subsequently approved by the South Bend Common
Council on July 2, 1985. The public hearing on the GEM project
will be held before the Council on August 5, 1985.
The purpose of the enclosed resolution is to insure
compliance of GEM Partnership with the requirements of Indiana
Code 36-7-12-1, et seq.
It is the purpose of the partnership to obtain industrial
development revenue bonds issued by the City of South Bend, in
the aggregate principal amount of approximately $1,000,000. The
proceeds of the bond issue will be used to purchase the Sears
Warehouse building and associated property and to carry out such
construction as is required to convert the building into a
distribution and operation center for General Microcomputer as
follows:
1. Warehouse space: 40,000 square feet
2. Service space: 5,000 square feet
3. Manufacturing space: 10,000 square feet
4. Office space: 30,000 square feet
(2 levels of 15,000
square feet each)
5. Parking space: 200 cars (estimated)

It is estimated that this project will result in the
creation of approximately 25 new jobs within one year of General
Microcomputer's occupancy of the facility. It is further
estimated that these new jobs will generate an annual payroll of
approximately $300,000 per year.
