ORDINANCE NO.74593-85
AN ORDINANCE AMENDING AND SUPPLEMENTING ARTICLE 8,
SUBDIVISIONS, OF CHAPTER 21 , OF THE SOUTH BEND
MUNICIPAL CODE, AS AMENDED, BY MODIFYING PROVISIONS
RELATIVE TO FLOODPLAIN REGULATIONS AS PRESCRIBED
BY THE FEDERAL EMERGENCY MANAGEMENT AGENCY
STATEMENT OF PURPOSE AND INTENT
The City of South Bend has adopted provisions relative to flood plain
regulations, so as to minimize or eliminate existing or potential flood hazards
within such areas; and
It is in the public interest for the City of South Bend to continue
participation in the National Flood Insurance Program; and
Certain provisions of the City of South Bend Municipal Code must be
modified to establish compliance with the regulatory requirements of the
National Flood Insurance Program.
NOW, THEREFORE, be it ordained by the Common Council of the City of
South Bend, Indiana, as follows:
Section I
That Article 8, Subdivisions, of Chapter 21 , Zoning, of the City of South
Bend Municipal Code, be amended by adding the following Section:
Sec. 21-142. Subdivisions in flood hazard areas.
(a) Proposed subdivisions shall be reviewed to determine
whether the subdivision lies in a flood hazard area. If
the subdivision is to be located in a flood hazard area,
the Subdivider's Registered Land Surveyor shall forward
pertinent plans and materials to the Department of
Natural Resources for review and comment. Appropriate
changes and modifications may be required in order to
assure that the development of the subdivision is
consistent with the need to minimize flood damages; all
public utilities and facilities, such as sewer, gas,
electrical , and water systems are located and constructed
to minimize or eliminate flood damage; adequate drainage
is provided so as to reduce exposure to flood hazards;
and that on-site waste disposal systems, if provided,
will be so located as to avoid impairment of them or
contamination from them during the occurrence of the
regulatory flood.
(b) All subdivisions to be located in a flood hazard area
shall have the elevation of the 100-year flood stated and
the area delineated thereon.

That Article 8, Subdivisions, of Chapter 21 , Zoning, of the City of South

Bend Municipal Code, be amended by adding the following Sub-Section to Section
21-144(a):
Sec. 21-144(a)(15) Elevation of the 100-year flood, when applicable.

That Article 8, Subdivisions, of Chapter 21 , Zoning, of the City of South
Bend Municipal Code, be amended by deleting in its entirety the following Sub-
Section of Section 21-145(a):

That Article 8, Subdivisions, of Chapter 21 , Zoning, of the City of South
Bend Municipal Code, be amended by adding the following Sub-Section to Section
21-145(a):
Sec. 21-145(a)(1) If the Subdivision falls within a designated flood
hazard area, the Subdivision shall be reviewed by the
Department of Natural Resources in accordance with Section
21-142(a) of this Article.
SECTION VI
That Article 8, Subdivisions, of Chapter 21 , Zoning, of the City of South
Bend Municipal Code, be amended by deleting in its entirety the following Sub-
Section of Section 21-149(a):

That Article 8, Subdivisions, of Chapter 21 , Zoning, of the City of South
Bend Municipal Code, be amended by adding the following Sub-Section to Section
21-149(a):
Sec. 21-149(a)(1) If the Subdivision falls within a designated flood
hazard area, the Subdivision shall be reviewed by the
Department of Natural Resources in accordance with Section
21-142(a) of this Article.
SECTION VIII
That Article 8, Subdivisions, of Chapter 21 , Zoning, of the City of South
Bend Municipal Code, be amended by deleting in its entirety the following Sub-
Section of Section 21-150(a):

That Article 8, Subdivisions, of Chapter 21 , Zoning, of the City of South
Bend Municipal Code, be amended by adding the following Sub-Section to Section
21-150(a):

That Article 8, Subdivisions, of Chapter 21 , Zoning, of the City of South
Bend Municipal Code, be amended by deleting in its entirety the following Sub-
Section of Section 21-154(a):

SECTION XI
That Article 8, Subdivisions, of Chapter 21 , Zoning, of the City of South
Bend Municipal Code, be amended by adding the following Sub-Section to Section
21-154(a):
Sec. 21-14(a)(1 ) If the Subdivision Replat falls within a designated
flood hazard area, the Subdivision shall be reviewed by the
Department of Natural Resources in accordance with Section
21-142(a) of this Article.
SECTION XII
This Ordinance shall be in full force and effect from and after its passage
by the Common Council , approval by the Mayor, and legal publication.
