AN ORDINANCE AMENDING THE ZONING ORDINANCE
FOR PROPERTY LOCATED AT 3308 E. JEFFERSON BLVD. ,
IN THE CITY OF SOUTH BEND, INDIANA
BE IT ORDAINED by the Common Council of the City of South Bend, Indiana:
SECTION I. Ordinance No. 4990-68, as amended, which ordinance is commonly
known as the Zoning Ordinance of the City of South Bend, Indiana, be and the
same hereby is amended in order that the zoning classification of the following
described real estate in the City of South Bend, St. Joseph County, State of
Indiana:
Lots 6 through 12, then west 16.33 ft. of Lot 13, and Lots
14 through 18 of Jerome 1st Add. ; plus that portion of
vacated Sunnymede Ave. south of and adjacent to Lots 7
through 12 of Jerome 1st Add. ; plus a parcel of land, the
point of beginning being at the southwest corner of Lot 18
of Jerome 1st Add. ; thence west along the north line of
the right-of-way of the Grand Trunk Western Railway Company
a distance of 145.53 ft. , more or less, to a point 308.32 ft.
east of the intersection of the east line of 32nd Street and
the north line of the right-of-way of the Grand Trunk Western
Railway Company; thence north, parallel with the west line of
Jerome 1st Add. a distance of 190 ft. , more or less, thence
east parallel with the north line of the right-of-way of the
Grand Trunk Western Railway Company, a distance of 148 ft. ,
more or less, to the west line of Jerome 1st Add. , thence
south along said west line 190.23 ft. to the southwest corner
of Lot 18 of said sub. and the point of beginning.

SECTION II. This ordinance shall be in full force and effect from and
after its passage by the Common. Council, approval by the mayor, and legal
publication.

RE: A proposed ordinance and site development plan of Charles W. Cole, Jr. to
zone from "A" Residential , "A" Height and Area to "B" Residential , "D"
Height and Area, property located at 3308 E. Jefferson Boulevard, City of
South Bend
Gentlemen:.
The above referenced ordinance and site development plan of Charles W. Cole,
Jr. was legally advertised June 7, 1985. The Area Plan Commission gave it a
public hearing on June 18, 1985, at which time the following action was taken:
Upon a motion by Leroy Yoder, being seconded by Rene
Vandewalle and carried, with nine favorable votes and
three "nays" and Chuck Sausman abstaining, the proposed
ordinance and site development plan of Charles W. Cole,
Jr. to zone from "A" Residential , "A" Height and Area
to "B" Residential, "D" Height and Area, property
located at 3308 E. Jefferson Boulevard, City of South
Bend is sent to the Common Council with a favorable
recommendation subject to a Final Site Development Plan
showing screening of all parking spaces within fifty
feet of the property line per the South Bend Municipal
Code
PLEASE NOTE that the Ordinance has been amended by the petitioner to include a
legal description different than that used for the Common Council 's first
reading. The amended Ordinance was the Ordinance legally advertised and heard
by the Area Plan Commission.
The above recommendation is made subject to a final site plan showing screening
of all parking spaces within fifty feet of the property line per the South Bend
Municipal Code.

STAFF REPORT
CHARLES W. COLE, JR. #943-85 June 6, 1985
3308 E. Jefferson Blvd. , South Bend
REQUESTED ACTION: The petitioners are requesting a zone change from
"A" Residential, "A" Height and Area, to "B"
Residential , "D" Height and Area to allow for the
construction of multi-family housing.
EXISTING LAND USE: The property is vacant.
SURROUNDING LAND USE AND ZONING: Located to the north are single-family homes zoned
"A" Residential and a CPA firm zoned "B"
Residential ; to the east across 35th Street are
single-family homes zoned "A" Residential ; to the
south is the Grand Trunk Western Railroad tracks;
and to the west is a single-family home zoned "A"
Residential and offices zoned "B" Residential .
ACCESS: Access to the site will be from both Jefferson
Boulevard and 35th Street.
DRAINAGE: Storm water drainage will be handled by connecting
to the City storm sewer system.
DATA: The total site to be rezoned is 5.21 acres. Of
that, the buildings will occupy .97 acres, or
18.6% of the site; the parking and drives would
occupy .99 acres or 19.08% of the site; and 3.24
acres or 62.32% of the site will be open space.
SITE PLAN: The site plan is preliminary.
AGENCY COMMENTS: The City Engineer made the following comments:
"1 . Storm system meets City requirements.
2. City water is available to (the) site.
3. City sanitary is available to (the) site.
4. Show detail of curb cuts onto Jefferson
and Thirty-fifth Street.
5. Show detail of individual parking spaces
on plans. Must have one
space/apartment."

At Large I have several serious concerns regarding the proposed
ALBPASZEK rezoning from "A" Residential, "A" Height and Area, to
At Large "B" Residential, "D" Height and Area. These concerns

At large include the following:
K.CEKANSKI-FARRAND (1) The fact that there is a petition containing
Council Attorney at least 92 remonstrators against the rezoning.
(2) That the proposed use is so intensive for property
so close to railroad tracks .
(3) That the proposed setbacks of fifteen feet (15 ' )
are not enough and that at least thirty feet (30' )
should be considered as being an appropriate
setback from adjoining properties.
(4) That the wooded area should remain intact and a
privacy fence should be a condition.
(5) That Sunnymede has not been extended, and
increased traffic should not be placed on 35th
Street since that would adversely affect that
neighborhood.
(6) That the proposed ingress and egress to the proposed
rezoned land is unacceptable based on the high
volume traffic in the area.

I question whether such expensive condominiums are appropriate
so close to railroad tracks .
In light of the above concerns, I believe the Area Plan Commission
must give serious consideration to each, in determining whether the
proposed rezoning is in fact the highest and best use for the land in
question.
