17 , SECTION 2-205 COMMONLY KNOWN AS FEES
CHARGED FOR LEGAL ADVERTISEMENTS OF THE
MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
INDIANA
STATEMENT OF PURPOSE AND INTENT
On January 28 , 1985, the Common Council passed Ordinance No.
7428-85, which amended the Tax Abatement procedures.
Included within that Ordinance was a section establishing
a filing fee of $150. 00. The fee was based upon an in-house study
conducted by the City of the costs incurred by the City to comply
with all required legal publications for such actions.
The following ordinance amends the current Section addressing
legal advertisement costs so that it is consistent, and includes
fees for petitions for impact areas.
NOW, THEREFORE, BE it ordained by the Common Council of the
City of South Bend, Indiana, as follows :
SECTION I. Chapter 2, Article 17, Section 2-205 of the
Municipal Code of the City of South Bend, Indiana is amended to read
as follows :
Sec. 2-205 Fees charged for legal advertisements.
(a) All petitioners seeking tam-abatements; voluntary
annexations , vacation of public ways, or rezonings ,
except those rezonings petitioned for by the Area
Plan Commission or a member of the Common Council,
shall remit the sum of one hundred dollars ($100. 00)
at the time of filing said petition. Said sum is
non-refundable and shall be used to fulfill all legal
advertisement requirements of such proceedings
incurred by the City.
(b) All petitioners seeking tax abatements or impact
area designations,except those impact areas petitioned
for by a member of the Common Council, shall remit
the sum of one hundred and fifty dollars ($150. 00) at
the time of filing said petition. Said sum is non-
refundable and shall be used to fulfill all legal
advertisement requirements of such proceedings incurred
by the City.
SECTION II. This ordinance shall be in full force and effect
from and after its passage of the Common Council and approval by the
Mayor.

Council Attorney In January we passed a tax abatement ordinance incorporat-
ing a $150.00 fee. The attached Bill would also have a
$150. 00 charge for each such petition, as well as for impact
area petitions.
