ORDINANCE NO. 75 /-- " AN ORDINANCE AMENDING CHAPTER 21 OF THE SOUTH BEND MUNICIPAL CODE, ENTITLED ZONING, AT SUB-SECTIONS 21-1(a) (3. 1) AND 21-172 STATEMENT OF PURPOSE AND INTENT: In revaluating zoning requirements within the South Bend Central Development Area, and in particular the requirements for signs and billboards therein, the Council finds it necessary to clarify the area designated as the "Associated Sphere of Influence" for sign and billboard requirements within that area. NOW, THEREFORE, BE IT ORDAINED by the South Bend Common Council , as follows : Section I: Section 21-1(a) (3. 1) of the South Bend Municipal Code shall be deleted in its entirety and a new Section 21-1(a) (3 . 1) is adopted to read as follows : Section 21-1(a) (3. 1) Associated Sphere of Influence means the area described as follows : Beginning at the point of intersection of the centerline of Jefferson Boulevard and the center of the St. Joseph River, thence southeasterly along the center of the St. Joseph River to the centerline of Monroe Street extended , thence southwesterly along the centerline of Monroe Street and its extension to the centerline of Lincolnway East, thence southeasterly along the centerline of Lincolnway East to the extended centerline of the east-west alley between South and Bronson Streets, thence west along the center line of said alley and its extension to the north right-of-way line of the Penn Central Railroad, thence west along said right-of-way line to the extended centerline of the north-south alley located between Williams and Taylor Streets, thence north along the centerline of said alley and its extension to the centerline of Lincolnway West, thence northwesterly along the centerline of Lincolnway West to a point of intersection with the extended centerline of Taylor Street, thence northeasterly along the centerline of Taylor Street and its extension to a point of intersection with the extended centerline of the first north-south alley west of Portage Avenue, thence north along the centerline of said alley and its extension to the south line of Burrough' s Sub . of B.O.L. 115, thence northeasterly along said south line to the east line of said sub . , thence north along said east line 7' to the centerline of the east-west alley, thence east along the centerline of said alley and its extension to the centerline of the north-south alley located between Niles Avenue and Hill Street, thence south along the centerline of said alley to the Section II: Section 21-172(b) shall be amended to read as follows : Section 21-172(b) The Design Review Committee shall have the following powers and duties in all matters relative to the erection or alteration of signs within the adepted-Recevolepment-Rpoject-A'eas_and withih-ene-half-(1/2).-Meek-beyond-the-boundaries_o£ saeh-apeaa Associated Sphere of Influence : ( 1) Review applications for sign permits and, within fifteen ( 15) working days of receipt of the application: (a) Return the application to the Building Commissioner with a letter of approval stating that the proposed sign is in conformance with this article, and authorizing the issuance of a sign permit; or (b) Deny the application, stating in writing the reason for such denial . Failure of the Development Design Review Committee to take such action shall constitute approval of the application. ( 2) Make recommendations relative to amendment, supplement, change or repeal of this article, according to the provisions of this article . ( 3) Maintain a permanent record of all actions of the Committee . Section III. The Area Plan Commission gave it a public hearing on August 20, 1985, at which time the following action was taken: Upon a motion by Robert Lehman, being seconded by Joseph Serge and unanimously carried, the proposed ordinance initiated by Councilman Beverlie Beck amending Article 1 , General Provisions, of Chapter 21 , Zoning, of the Municipal Code of the City of South Bend, Indiana to modify the definition of "Associated Sphere of Influence" is sent to the Common Council with a favorable recommendation The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. " When this portion of the Municipal Code was originally written it was designed to limit the number of billboards in the Central Downtown Urban Renewal Area to the number then in existence. In 1981 Section 21-1 ( 3 . 1 ) was broadened to refer to any redevelopment area. With the subsequent merger and expansion of the Downtown, East Bank and Monroe Sample areas we have inadvertently extended the limitations on billboards to the new South Bend Central Development Area. This was brought to our attention by Scott Miller, President of Burkhart Advertising. Our department has met with Mr. Miller, as well as with representatives of the Area Plan Commission and the City Attorney' s Office. The enclosed ordinance is a .direct result of those meetings. It reestablishes a legal description for the area where the number of billboards is limited.
